7 An Act relating to schools; directing the State
7 Department of Education to establish certain
8 guidelines to administer certain physical fitness
8 test; directing guidelines to be based on certain
9 recommendations; providing for contents of
9 guidelines; requiring school districts to administer
10 certain test beginning in certain school year;
10 directing school districts to use student performance
11 results in certain manner; providing for promulgation
11 of rules; providing for codification; providing an
12 effective date; and declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 11-103.9c of Title 70, unless
17
18 there is created a duplication in numbering, reads as follows:

19 A. The State Department of Education shall establish guidelines
19
20 for school districts in this state to assess the overall fitness of
20
21 students and encourage physical activity and healthy habits by
21
22 administering the Presidential Fitness Test. The physical fitness
22
23 test guidelines shall be based on the recommendations of the
23
24 President's Council on Sports, Fitness, and Nutrition, which was

1 reconstituted by Executive Order 14327. The guidelines shall

2 include:

3 1. Training for personnel to administer the test;
3
4 2. Exemption guidelines for students with disabilities, medical
4
5 conditions, or other factors that would impact their ability to
5
6 complete the test; and
6
7 3. An option for a parent or legal guardian of a student to opt
7
8 the student out of the test.

9 B. Beginning in the 2026-2027 school year, school districts in
9
10 this state shall administer the Presidential Fitness Test to
10
11 students using the guidelines established pursuant to subsection A
11
12 of this section.

13 C. School districts shall utilize student performance results
13
14 on the Presidential Fitness Test to:
14
15 1. Promote the physical and mental benefits of daily movement,
15
16 exercise, and good nutrition;
16
17 2. Modify physical activity opportunities offered to students;
17
18 and
18
19 3. Encourage participation in physical activities available to
19
20 students inside and outside the school setting.
20
21 D. The State Board of Education may promulgate rules to
21
22 implement the provisions of this section.

23 SECTION 2. This act shall become effective July 1, 2026.

1 SECTION 3. It being immediately necessary for the preservation
1
2 of the public peace, health, or safety, an emergency is hereby
2
3 declared to exist, by reason whereof this act shall take effect and
3
4 be in full force from and after its passage and approval.
