7   An Act relating to water quality; defining term;

7   prohibiting political subdivisions from taking

8   certain action; prohibiting public or private

8   businesses from taking certain action; directing the

9   Department of Environmental Quality to promulgate

9   rules; providing for codification; and declaring an

10  emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      NEW LAW  A new section of law to be codified

14

15 in the Oklahoma Statutes as Section 2-6-112 of Title 27A, unless
15

16 there is created a duplication in numbering, reads as follows:
16

17  A. As used in this section, "fluoride" means a chemical

17

18 compound that contains the fluoride ion and is used in fluoridation,
18

19 including:
19

20  1. Fluorosilicic acid;

20

21  2. Sodium fluorosilicate; and

21

22  3. Sodium fluoride.

23  B. 1. No political subdivision of this state shall enact or

23

24 enforce an ordinance that requires or permits the introduction or

1 depositing of fluoride or any chemical compound containing fluoride
1

2 into water in, or water that will be introduced into, a public water
2

3 supply.
3

4   2. No public or private business operating within this state

4

5 shall introduce or deposit fluoride into water in, or water that
5

6 will be introduced into, a public water supply.
6

7   C. The Department of Environmental Quality shall promulgate

7

8 rules to effectuate the provisions of this section.
8

9   SECTION 2. It being immediately necessary for the preservation

9

10 of the public peace, health, or safety, an emergency is hereby
10

11 declared to exist, by reason whereof this act shall take effect and
11

12 be in full force from and after its passage and approval.
