9 municipalities; requiring matching funds amount;
10 prescribing purpose of allocated funds; providing for
10 review of applications by the Oklahoma Department of
11 Commerce; amending 68 O.S. 2021, Section 1353, as
11 last amended by Section 4, Chapter 441, O.S.L. 2024
12 (68 O.S. Supp. 2024, Section 1353), which relates to
12 apportionment of revenue; requiring certain
13 apportionment; updating statutory references;
13 providing for noncodification; providing for
14 codification; providing an effective date; and
14 declaring an emergency.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17
18 SECTION 1. NEW LAW A new section of law not to be
18
19 codified in the Oklahoma Statutes reads as follows:
19
20 This act shall be known and may be cited as the "Oklahoma
20
21 Neighborhood Revitalization Act".
21
22 SECTION 2. NEW LAW A new section of law to be codified
22
23 in the Oklahoma Statutes as Section 38-124 of Title 11, unless there
23
24 is created a duplication in numbering, reads as follows:

1 There is hereby created in the State Treasury a revolving fund
1
2 for the Oklahoma Department of Commerce to be designated the
2
3 "Oklahoma Neighborhood Revitalization Fund". The fund shall be a
3
4 continuing fund, not subject to fiscal year limitations, and shall
4
5 consist of all monies received by the Oklahoma Department of
5
6 Commerce from the apportionment of sales tax prescribed by
6
7 subsection E of Section 1353 of Title 68 of the Oklahoma Statutes
7
8 and provided for the purpose of implementing Section 3 of this act.
8
9 All monies accruing to the credit of the fund are hereby
9
10 appropriated and may be budgeted and expended by the Oklahoma
10
11 Department of Commerce for the purpose provided for in this act.
11
12 Expenditures from the fund shall be made upon warrants issued by the
12
13 State Treasurer against claims filed as prescribed by law with the
13
14 Director of the Office of Management and Enterprise Services for
14
15 approval and payment.
15
16 SECTION 3. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 38-125 of Title 11, unless there
17
18 is created a duplication in numbering, reads as follows:
18
19 A. The monies in the Oklahoma Neighborhood Revitalization Fund
19
20 shall be allocated by the Oklahoma Department of Commerce only to
20
21 municipalities having a population of less than twenty-five thousand
21
22 (25,000) persons according to the latest Federal Decennial Census
22
23 for improvements to sidewalks, street lighting, signage, roadside
23

1 beautification, and other improvements that have a positive impact
1
2 on the aesthetic character of the municipality.
2
3 B. A municipality seeking funds for distribution pursuant to
3
4 the provisions of Section 2 of this act shall make application to
4
5 the Oklahoma Department of Commerce on such forms as may be
5
6 prescribed by the Department for such purpose. The initial
6
7 application shall be filed not later than May 1, 2026.
7
8 C. A municipality shall be required to provide twenty percent
8
9 (20%) of the total project costs in order to be eligible for
9
10 distribution of funds from the Oklahoma Neighborhood Revitalization
10
11 Fund.
11
12 D. The Department shall not consider any project that has a
12
13 total project cost exceeding Five Hundred Thousand Dollars
13
14 ($500,000.00).
14
15 E. The Department shall review applications in the order in
15
16 which they are received and shall distribute funds based on analysis
16
17 of considerations of such factors as the Department may determine to
17
18 be relevant. The initial distribution of funds shall take place not
18
19 later than October 1, 2026. The Department shall transfer the
19
20 approved funds to the municipality for deposit into the municipal
20
21 general fund or such other public fund as the municipality shall
21
22 specify in its application.

23 F. Funds distributed pursuant to the provisions of this section
23
24 shall only be used by a municipality for the purposes provided in

1 subsection A of this section and shall not be used for any other

2 purpose.

3 G. No municipality may be awarded more than one project under
3
4 the provisions of this section within a single fiscal year.
4
5 SECTION 4. AMENDATORY 68 O.S. 2021, Section 1353, as
5
6 last amended by Section 4, Chapter 441, O.S.L. 2024 (68 O.S. Supp.
6
7 2024, Section 1353), is amended to read as follows:
7
8 Section 1353. A. It is hereby declared to be the purpose of
8
9 the Oklahoma Sales Tax Code to provide funds for the financing of
9
10 the program provided for by the Oklahoma Social Security Act and to
10
11 provide revenues for the support of the functions of the state
11
12 government of Oklahoma, and for this purpose it is hereby expressly
12
13 provided that, revenues derived pursuant to the provisions of the
13
14 Oklahoma Sales Tax Code, subject to the apportionment requirements
14
15 for the Oklahoma Tax Commission and Office of Management and
15
16 Enterprise Services Joint Computer Enhancement Fund provided by
16
17 Section 265 of this title, and further subject to the apportionment
17
18 requirement provided in subsection subsections D and E of this
18
19 section, shall be apportioned as follows:
19
20 1. Except as provided in subsection C of this section, the
20
21 following amounts shall be paid to the State Treasurer to be placed
21
22 to the credit of the General Revenue Fund to be paid out pursuant to
22
23 direct appropriation by the Legislature:

10 the State Department of Education:

11 a. for FY 2003, FY 2004 and FY 2005, ten and forty-two
11
12 one-hundredths percent (10.42%),
12
13 b. for FY 2006 through FY 2020, ten and forty-six one-
13
14 hundredths percent (10.46%),
14
15 c. for FY 2021:
15
16 (1) for the month beginning July 1, 2020, through the
16
17 month ending August 31, 2020, ten and forty-six
17
18 one-hundredths percent (10.46%), and
18
19 (2) for the month beginning September 1, 2020,
19
20 through the month ending June 30, 2021, eleven
20
21 and ninety-six one-hundredths percent (11.96%),
21
22 and
22
23 d. for FY 2022 and each fiscal year thereafter, ten and
23
24 forty-six one-hundredths percent (10.46%);

1 3. The following amounts shall be paid to the State Treasurer

1 hundredths percent (0.87%) shall be paid to the State

2 Treasurer to be further apportioned as follows:

3 (1) twenty-four percent (24%) shall be placed to the
3
4 credit of the Oklahoma Tourism Promotion
4
5 Revolving Fund, but in no event shall such
5
6 apportionment exceed Five Million Dollars
6
7 ($5,000,000.00) in any fiscal year,
7
8 (2) forty-four percent (44%) shall be placed to the
8
9 credit of the Oklahoma Tourism Capital
9
10 Improvement Revolving Fund, but in no event shall
10
11 such apportionment exceed Nine Million Dollars
11
12 ($9,000,000.00) in any fiscal year, and
12
13 (3) thirty-two percent (32%) shall be placed to the
13
14 credit of the Oklahoma Route 66 Commission
14
15 Revolving Fund, but in no event shall such
15
16 apportionment exceed Six Million Six Hundred
16
17 Thousand Dollars ($6,600,000.00) in any fiscal
17
18 year, and
18
19 b. any amounts which exceed the limitations of
19
20 subparagraph a of this paragraph shall be placed to
20
21 the credit of the General Revenue Fund; and
21
22 5. For the fiscal year beginning July 1, 2015, and for each
22
23 fiscal year thereafter, six one-hundredths percent (0.06%) shall be
23
24 placed to the credit of the Oklahoma Historical Society Capital

1 Improvement and Operations Revolving Fund, but in no event shall
1
2 such apportionment exceed the total amount apportioned pursuant to
2
3 this paragraph for the fiscal year ending on June 30, 2015. Any
3
4 amounts which exceed the limitations of this paragraph shall be
4
5 placed to the credit of the General Revenue Fund.
5
6 B. Provided, for the fiscal year beginning July 1, 2007, and
6
7 every fiscal year thereafter, an amount of revenue shall be
7
8 apportioned to each municipality or county which levies a sales tax
8
9 subject to the provisions of Section 1357.10 of this title and
9
10 subsection F of Section 2701 of this title equal to the amount of
10
11 sales tax revenue of such municipality or county exempted by the
11
12 provisions of Section 1357.10 of this title and subsection F of
12
13 Section 2701 of this title. The Oklahoma Tax Commission shall
13
14 promulgate and adopt rules necessary to implement the provisions of
14
15 this subsection.
15
16 C. From the monies that would otherwise be apportioned to the
16
17 General Revenue Fund pursuant to subsection A of this section, there
17
18 shall be apportioned the following amounts:
18
19 1. For the month ending August 31, 2019:
19
20 a. Nine Million Six Hundred Thousand Dollars
20
21 ($9,600,000.00) to the credit of the State Highway
21
22 Construction and Maintenance Fund created in Section
22
23 1501 of Title 69 of the Oklahoma Statutes, and
23

1 b. Two Million Dollars ($2,000,000.00) to the credit of

2 the Oklahoma Railroad Maintenance Revolving Fund
2
3 created in Section 309 of Title 66 of the Oklahoma
3
4 Statutes;

5 2. For the month ending September 30, 2019:

6 a. Twenty Million Dollars ($20,000,000.00) to the credit
6
7 of the State Highway Construction and Maintenance Fund
7
8 created in Section 1501 of Title 69 of the Oklahoma
8
9 Statutes, and
9
10 b. Two Million Dollars ($2,000,000.00) to the credit of
10
11 the Oklahoma Railroad Maintenance Revolving Fund
11
12 created in Section 309 of Title 66 of the Oklahoma
12
13 Statutes;

14 3. For the month ending October 31, 2019:

15 a. Twenty Million Dollars ($20,000,000.00) to the credit

10 a. Twenty Million Dollars ($20,000,000.00) to the credit

12 created in Section 1501 of Title 69 of the Oklahoma

14 b. Two Million Dollars ($2,000,000.00) to the credit of

15 the Oklahoma Railroad Maintenance Revolving Fund

16 created in Section 309 of Title 66 of the Oklahoma

17 Statutes.

18 D. For fiscal year 2029, and each subsequent fiscal year, Fifty
18
19 Million Dollars ($50,000,000.00) shall be placed to the credit of
19
20 the Oklahoma Capital Assets Maintenance and Protection Fund created
20
21 in Section 2 188B of this act Title 73 of the Oklahoma Statutes.
21
22 E. For fiscal year 2026, and each subsequent fiscal year, the
22
23 first Five Million Dollars ($5,000,000.00) shall be placed to the
23

1 credit of the Oklahoma Neighborhood Revitalization Fund created in

2 Section 2 of this act.
2
3 SECTION 5. This act shall become effective July 1, 2025.
3
4 SECTION 6. It being immediately necessary for the preservation
4
5 of the public peace, health or safety, an emergency is hereby
5
6 declared to exist, by reason whereof this act shall take effect and
6
7 be in full force from and after its passage and approval.
