7   An Act relating to groundwater use; amending 82 O.S.

7   2021, Section 1020.17, which relates to spacing

8   rules; conforming statutory reference; removing

8   requirement for certain public hearing; authorizing

9   adoption of certain spacing; and providing an

9   effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  82 O.S. 2021, Section 1020.17, is

13

14 amended to read as follows:
14

15  Section 1020.17. The Oklahoma Water Resources Board may

15

16 promulgate rules under Article I of the Administrative Procedures
16

17 Act which establish a proper spacing of wells which, in its
17

18 judgment, is necessary to an orderly withdrawal of water in relation
18

19 to the allocation, by regular permits and temporary permits, of
19

20 water to the land overlying the basin or subbasin. The Board shall
20

21 conduct at least one public hearing at a location within or in close
21

22 proximity to each major basin or subbasin before adopting rules
22

23 establishing well spacing for such basin or subbasin may adopt
23

1 specific spacing for each basin as part of establishing a maximum
1

2 annual yield pursuant to Section 1020.6 of this title.

3   SECTION 2. This act shall become effective November 1, 2026.
