7 An Act relating to the Corporation Commission;
7 defining term; establishing moratorium; requiring
8 certain study; requiring electronic submission of
8 certain report; authorizing promulgation of rules;
9 and providing for codification.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 860 of Title 17, unless there is
14
15 created a duplication in numbering, reads as follows:
15
16 A. For the purposes of this section, "data center" means a
16
17 facility that is designed to have a load of one hundred (100)
17
18 megawatts or more and the primary purpose of which is the storage,
18
19 management, and processing of digital data via the interconnection
19
20 and operation of information technology and network
20
21 telecommunications equipment, including all related facilities and
21
22 infrastructure for backup electricity generation, power
22
23 distribution, environmental control, cooling, and security.

1 B. There is hereby established a moratorium on the building or

2 establishing of data centers in this state until November 1, 2029.

3 C. 1. Before November 1, 2029, the Corporation Commission
3
4 shall conduct a study on the potential impacts that data centers
4
5 might have on the following, including, but not limited to:
5
6 a. the water supply of this state, including, but not
6
7 limited to, aquifers, streams, lakes, and wastewater
7
8 treatment plants,
8
9 b. utility rates,
9
10 c. property values within a three-mile radius of a
10
11 proposed data center, and
11
12 d. other pertinent areas as determined by the Commission.

13 2. In addition to the provisions of paragraph 1 of this
13
14 subsection, the Corporation Commission shall conduct a study, in the
14
15 interest of security reasons, of ideal locations for data centers in
15
16 this state.

17 D. The Corporation Commission shall electronically submit a
17
18 report of the study findings pursuant to subsection C of this
18
19 section to the Legislature and include recommendations for
19
20 regulating data centers to promote the health of the electric grid,
20
21 waters, and environment of this state, as well as recommendations
21
22 for the sourcing of data center components that limit threats to the
22
23 privacy and security of the citizens of this state.

1 E. The Corporation Commission shall promulgate rules to

2 effectuate the provisions of this section.
