7 An Act relating to students; amending 70 O.S. 2021,
7 Section 5-132, as last amended by Section 1, Chapter
8 296, O.S.L. 2025 (70 O.S. Supp. 2025, Section 5-132),
8 which relates to adult high school completion;
9 clarifying eligibility; amending 70 O.S. 2021,
9 Section 628.13, which relates to concurrent
10 enrollment; prohibiting students of certain age or
10 older from participating; updating statutory
11 language; providing an effective date; and declaring
11 an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-132, as
15
16 last amended by Section 1, Chapter 296, O.S.L. 2025 (70 O.S. Supp.
16
17 2025, Section 5-132), is amended to read as follows:
17
18 Section 5-132. A. Any person lawfully present in the United
18
19 States and who is of legal age and a resident of this state, over
19
20 the age of twenty-one (21) and under the age of thirty (30), except
20
21 as provided for concurrent enrollment in Section 628.13 of this
21
22 title, and who has not completed the twelfth grade in school shall
22
23 be given the same educational privileges and opportunities provided
23
24 by law for children over the age of five (5) and under the age of

1 twenty-one (21), upon submitting to the board of education of the
1
2 school district in which the person resides, or the board's
2
3 designee, evidence satisfactory to that board showing that during
3
4 the time before he or she was age twenty-one (21) he or she was
4
5 unable to attend school for a definite period or periods of time, by
5
6 reason whereof it was impossible for him or her to complete the
6
7 twelfth grade before reaching the age of twenty-one (21). Provided
7
8 further, the pupil shall be counted in the average daily attendance
8
9 of the district where he or she attends school during the period of
9
10 time provided for in this section for the purpose of calculating
10
11 State Aid for the district. Provided that, beginning in the 2025-
11
12 2026 school year, persons applying for and approved to attend school
12
13 in accordance with the provisions of this subsection shall only be
13
14 eligible if such district offers a full-time virtual education
14
15 program and such persons only utilize the full-time virtual
15
16 education program option for the completion of their high school
16
17 education.
17
18 B. Any resident of the state who is age nineteen (19) or older,
18
19 who is not enrolled in any high school program, and who has not
19
20 completed the twelfth grade may attend any adult high school
20
21 completion program which is established by a school district and
21
22 approved by the State Board of Career and Technology Education if
22
23 such attendance has the approval of the district offering the
23
24 program. Such attendance shall not be counted in the average daily

1 attendance of the district unless the Legislature appropriates
1
2 monies for adult high school completion programs. Such attendance
2
3 shall not be counted to meet minimum numbers for accreditation of
3
4 the school district involved, and such students shall not attend
4
5 classes which that are a part of the normal class structure of the
5
6 district.
6
7 C. A person subject to the provisions of subsection A or B of
7
8 this section shall not be required to take the student assessments
8
9 required by Section 1210.508 of this title and shall not be included
9
10 in the reports required by Section 1210.545 or 24-120.1 of this
10
11 title.

12 SECTION 2. AMENDATORY 70 O.S. 2021, Section 628.13, is
12
13 amended to read as follows:
13
14 Section 628.13. A. 1. The Oklahoma State Regents for Higher
14
15 Education, in cooperation with the State Board of Education, shall
15
16 actively encourage the concurrent enrollment in college or
16
17 university courses of eligible high school students on high school
17
18 campuses, on college and university campuses, and via online
18
19 courses.
19
20 2. The State Regents and State Board shall establish concurrent
20
21 enrollment requirements with an emphasis on determining course
21
22 readiness and take all necessary actions to ensure the availability
22
23 of concurrent enrollment opportunities to students in all Oklahoma
23
24 high schools in this state.

1 B. The State Board of Education in cooperation with the
1
2 Oklahoma State Regents for Higher Education shall prepare
2
3 promotional materials explaining the requirements, features, and
3
4 opportunities of concurrent enrollment and shall ensure that the
4
5 independent school districts distribute the materials to each
5
6 student prior to enrollment for each year of high school.
6
7 C. No institution of The Oklahoma State System of Higher
7
8 Education shall deny enrollment in any course to any otherwise
8
9 eligible high school student, or a student of who is at least
9
10 thirteen (13) years of age but not twenty-one (21) years of age or
10
11 older who is receiving high-school-level instruction at home, who
11
12 meets the requirements of concurrent enrollment, nor shall any
12
13 independent school district prohibit any student who meets the
13
14 requirements of concurrent enrollment from participating if the
14
15 student is at least thirteen (13) years of age but not twenty-one
15
16 (21) years of age or older.

17 D. 1. Each high school senior who meets the eligibility
17
18 requirements for concurrent enrollment shall be entitled to receive
18
19 a tuition waiver equivalent to the amount of resident tuition for a
19
20 maximum of eighteen (18) credit hours in their his or her senior
20
21 year.

22 2. Subject to the high school senior concurrent enrollment
22
23 program being fully funded, each high school junior who meets the
23
24 eligibility requirements for concurrent enrollment shall be entitled

1 to receive a tuition waiver equivalent to the amount of resident
1
2 tuition for a maximum of nine (9) credit hours in their his or her
2
3 junior year, subject to the availability of funds.

4 3. Tuition waivers provided pursuant to this section shall be
4
5 granted without any limitation on the number of waivers granted in
5
6 any year other than the amount of funds available for the program
6
7 and the number of eligible applicants.
7
8 E. When a student earns college credit through concurrent
8
9 enrollment, school districts shall provide academic credit for any
9
10 concurrently enrolled higher education courses that are correlated
10
11 with the academic credit awarded by the institution of higher
11
12 education. Academic credit shall only be transcripted as elective
12
13 credit if there is no correlation between the concurrent enrollment
13
14 higher education course and a course provided by the school
14
15 district.
15
16 F. On or before December 1 of each year, the Oklahoma State
16
17 Regents for Higher Education shall issue an annual report on the
17
18 concurrent enrollment program implemented pursuant to this section.
18
19 The annual report shall include, but not be limited to, the
19
20 following information:

21 1. The number of students participating in concurrent
21
22 enrollment;

1 2. The number of students participating in concurrent
1
2 enrollment who received tuition waivers pursuant to subsection D of
2
3 this section;
3
4 3. The high school graduation rate of students described in
4
5 paragraphs 1 and 2 of this subsection; and
5
6 4. The number of students described in paragraphs 1 and 2 of
6
7 this subsection who earned an associate's degree or a bachelor's
7
8 degree at an institution of higher education.
8
9 The annual report shall be posted on the websites of the
9
10 Oklahoma State Regents for Higher Education and the State Department
10
11 of Education.

12 SECTION 3. This act shall become effective July 1, 2026.
12
13 SECTION 4. It being immediately necessary for the preservation
13
14 of the public peace, health, or safety, an emergency is hereby
14
15 declared to exist, by reason whereof this act shall take effect and
15
16 be in full force from and after its passage and approval.
