7 An Act relating to the Oklahoma Jail Standards Act;
7 amending 74 O.S. 2021, Section 193, as amended by
8 Section 19, Chapter 11, O.S.L. 2025 (74 O.S. Supp.
8 2025, Section 193), which relates to right of entry;
9 authorizing entry of certain individuals for certain
9 purpose; requiring certain verification; defining
10 terms; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 74 O.S. 2021, Section 193, as
14
15 amended by Section 19, Chapter 11, O.S.L. 2025 (74 O.S. Supp. 2025,
15
16 Section 193), is amended to read as follows:
16
17 Section 193. A. Inspectors employed by the State Department of
17
18 Health shall be permitted to enter all jail premises and
18
19 administrative offices for the purpose of performing their assigned
19
20 duties.
20
21 B. The results of these inspections shall be presented in the
21
22 form of a written report to the person immediately responsible for
22
23 the administration of the facility inspected and such other offices
23
24 the Department deems appropriate. The report shall contain:

1 1. A list of deficiencies in the condition or operation of the

2 facility and specific proposals for their solution; and
2
3 2. A statement as to whether or not the facility inspected is
3
4 in substantial compliance with the jail standards established
4
5 pursuant to the Oklahoma Jail Standards Act.
5
6 C. Any elected official or religious leader of this state shall
6
7 be permitted to enter all jail premises operated in this state,
7
8 whether publicly or privately owned, for the purpose of informal
8
9 inspections that are not subject to the requirements of the Oklahoma
9
10 Jail Standards Act. Such official or religious leader must first
10
11 verify his or her identity and official capacity before admittance
11
12 to a jail premise. For the purposes of this subsection, "elected
12
13 official" means a person elected to a state office in the
13
14 legislative or executive branch of this state and "religious leader"
14
15 means an individual who is associated with, and is an authorized
15
16 representative of, a recognized church or religious denomination,
16
17 including, but not limited to, a clergy member, minister, pastor,
17
18 priest, rabbi, or imam.

19 SECTION 2. This act shall become effective November 1, 2026.
