7 An Act relating to professions and occupations;
7 amending 59 O.S. 2021, Section 475.3, as last amended
8 by Section 11, Chapter 147, O.S.L. 2024 (59 O.S.
8 Supp. 2025, Section 475.3), which relates to the
9 State Board of Licensure for Professional Engineers
9 and Surveyors; extending sunset date; updating
10 statutory language; providing an effective date; and
10 declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 59 O.S. 2021, Section 475.3, as
14
15 last amended by Section 11, Chapter 147, O.S.L. 2024 (59 O.S. Supp.
15
16 2025, Section 475.3), is amended to read as follows:
16
17 Section 475.3. A. The State Board of Licensure for
17
18 Professional Engineers and Surveyors is hereby re-created, to
18
19 continue until July 1, 2026 July 1, 2036, in accordance with the
19
20 provisions of the Oklahoma Sunset Law, whose duty it shall be to
20
21 administer the provisions of this act. The Board shall consist of
21
22 four professional engineers and two professional surveyors, at least
22
23 one of whom is shall not be a professional engineer, all of whom
23
24 shall be appointed by the Governor, with the advice and consent of

1 the Oklahoma State Senate. The Governor shall also appoint one lay
1
2 member. The professional engineers and professional surveyors shall
2
3 have the qualifications required by this act.

4 B. Each member of the Board shall file with the Secretary of
4
5 State a written oath or affirmation for the faithful discharge of
5
6 official duties.

7 C. Appointments to the Board shall be in such manner and for
7
8 such period of time so that no two terms, with the exception of the
8
9 term of the lay member, shall expire in the same year. On the
9
10 expiration of the term of any member, except the term of the lay
10
11 member, the Governor shall in the manner herein provided appoint for
11
12 a term of six (6) years a professional engineer or professional
12
13 surveyor having the qualifications required in this act. The lay
13
14 member of the Board shall be appointed by the Governor to a term
14
15 coterminous with that of the Governor. The lay member shall serve
15
16 at the pleasure of the Governor. Provided, the lay member may
16
17 continue to serve after the expiration of the member's term until
17
18 such time as a successor is appointed. Members may be reappointed
18
19 to succeed themselves. Each member may hold office until the
19
20 expiration of the term for which he or she was appointed or until a
20
21 successor has been duly appointed and has qualified. In the event
21
22 of a vacancy on the Board due to resignation, death, or for any
22
23 cause resulting in an unexpired term, if not filled by the Governor

1 within three (3) months, the Board may appoint a provisional member

2 to serve in the interim until the Governor acts.

3 SECTION 2. This act shall become effective July 1, 2026.
3
4 SECTION 3. It being immediately necessary for the preservation
4
5 of the public peace, health, or safety, an emergency is hereby
5
6 declared to exist, by reason whereof this act shall take effect and
6
7 be in full force from and after its passage and approval.
