21 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

22 SECTION 1. AMENDATORY Section 10, Chapter 366, O.S.L.
22
23 2024, as amended by Section 4, Chapter 187, O.S.L. 2025 (21 O.S.
23
24 Supp. 2025, Section 20J), is amended to read as follows:

1 Section 20J. A. Upon the effective date of this act On or

2 after January 1, 2026, Class B5 shall include the following criminal

3 offenses:

4 1. Second or subsequent conviction for assault and battery
4
5 against a current or former intimate partner or a family or
5
6 household member, as provided for in subsection C of Section 644 of
6
7 Title 21 of the Oklahoma Statutes this title;
7
8 2. Second or subsequent conviction for domestic abuse committed
8
9 in the presence of a child, as provided for in subsection G of
9
10 Section 644 of Title 21 of the Oklahoma Statutes this title;
10
11 3. Assault and battery by strangulation or attempted
11
12 strangulation against an intimate partner or a family or household
12
13 member, as provided for in subsection J of Section 644 of Title 21
13
14 of the Oklahoma Statutes this title;
14
15 4. Aggravated assault and battery, as provided for in Section
15
16 646 of Title 21 of the Oklahoma Statutes this title;
16
17 5. Battery or assault and battery upon a police officer,
17
18 sheriff, deputy sheriff, highway patrolman, corrections personnel,
18
19 or other state peace officer, as provided for in subsection B of
19
20 Section 649 of Title 21 of the Oklahoma Statutes this title;

21 6. Striking or mistreating a police dog or police horse during
21
22 the commission of a misdemeanor or felony, as provided for in
22
23 subsection D of Section 649.1 of Title 21 of the Oklahoma Statutes

24 this title;

2 horse during the commission of a misdemeanor or felony, as provided

3 15. Committing a gang-related offense as a condition of

4 membership in a criminal street gang, as provided for in Section

6 16. Stalking, as provided for in subsection B of Section 1173
6
7 of Title 21 of the Oklahoma Statutes this title;

8 17. Second or subsequent conviction of stalking or committing
8
9 the act of stalking within ten (10) years of the completion of
9
10 sentence for a prior conviction of stalking, as provided for in
10
11 subsection C of Section 1173 of Title 21 of the Oklahoma Statutes

12 this title;

13 18. Intentionally or recklessly spreading an infectious
13
14 disease, as provided for in Section 1192.1 of Title 21 of the

5
6 Section 1697 of Title 21 of the Oklahoma Statutes this title;

7 31. Second or subsequent offense of watching, gazing, or

8 looking upon a person in a clandestine manner as provided for in
8
9 paragraph 2 of subsection A of Section 1171 of this title;
9
10 32. Using photographic, electronic, or video equipment in
10
11 clandestine manner as provided for in subsection B of Section 1171
11
12 of this title;

13 33. Second or subsequent offense of using photographic,
13
14 electronic, or video equipment in clandestine manner to capture
14
15 image of private area without consent as provided for in paragraph 2
15
16 of subsection C of Section 1171 of this title;

17 34. Failing to stop for an accident resulting in a nonfatal
17
18 injury to another person, as provided for in Section 10-102 of Title
18
19 47 of the Oklahoma Statutes;

20 32. 35. Personal injury accident while driving or operating a

21 motor vehicle under the influence of alcohol or other intoxicating
21
22 substance while having a previous conviction for driving or

23 operating a motor vehicle while under the influence of alcohol or

2 subsection A of Section 11-904 of Title 47 of the Oklahoma Statutes;

3 33. 36. Failure to register as a sex offender, as provided for
3
4 in Section 583 of Title 57 of the Oklahoma Statutes;
4
5 34. 37. Furnishing false or misleading information in the
5
6 registration required by the Sex Offenders Registration Act, as
6
7 provided for in Section 586 of Title 57 of the Oklahoma Statutes;
7
8 35. 38. Failure to comply with the Sex Offenders Registration
8
9 Act, as provided for in subsection A of Section 587 of Title 57 of
9
10 the Oklahoma Statutes;
10
11 36. 39. Failure to comply with established guidelines of
11
12 global-positioning-system Global Positioning System (GPS) monitoring
12
13 pursuant to the provisions of the Sex Offenders Registration Act, as
13
14 provided for in subsection B of Section 587 of Title 57 of the
14
15 Oklahoma Statutes;
15
16 37. 40. Temporarily or permanently residing within a two-
16
17 thousand-foot radius of a public or private school site or other
17
18 listed places by a person required to register pursuant to the Sex
18
19 Offenders Registration Act, as provided for in subsection A of
19
20 Section 590 of Title 57 of the Oklahoma Statutes;
20
21 38. 41. Residing with a minor child after being convicted of an
21
22 offense that involved a minor child by a person required to register
22
23 pursuant to the Sex Offenders Registration Act, as provided for in
23
24 subsection B of Section 590 of Title 57 of the Oklahoma Statutes;

1 39. 42. Two or more sex offenders residing together in a
1
2 dwelling during the term of registration as a sex offender, as
2
3 provided for in subsection A of Section 590.1 of Title 57 of the
3
4 Oklahoma Statutes; and
4
5 40. 43. Establishing, leasing, operating, or owning any
5
6 structure where persons required to register pursuant to the Sex
6
7 Offenders Registration Act are allowed to reside, as provided for in
7
8 subsection E of Section 590.1 of Title 57 of the Oklahoma Statutes.
8
9 B. Any person convicted of a Class B5 criminal offense set
9
10 forth in this section shall be punished in accordance with the
10
11 corresponding penalties provided for in the Oklahoma Statutes.
11
12 SECTION 2. AMENDATORY Section 14, Chapter 366, O.S.L.
12
13 2024 (21 O.S. Supp. 2025, Section 20N), is amended to read as
13
14 follows:
14
15 Section 20N. A. Upon the effective date of this act On or
15
16 after January 1, 2026, Class D1 shall include the following criminal
16
17 offenses:
17
18 1. Public warehouse and/or or commodity stock fraud, as
18
19 provided for in Section 9-34 of Title 2 of the Oklahoma Statutes;
19
20 2. False issuance of warehouse receipt, as provided for in
20
21 Section 9-35 of Title 2 of the Oklahoma Statutes;
21
22 3. Misrepresentation of charter, as provided for in Section 9-
22
23 36 of Title 2 of the Oklahoma Statutes;

1 4. Tampering with anhydrous equipment, as provided for in
1
2 subsection A of Section 11-10 of Title 2 of the Oklahoma Statutes;

3 5. Willfully burn forest, grass, crops, or woodlands, as

4 provided for in Section 16-25 of Title 2 of the Oklahoma Statutes;
4
5 6. Willful and unlawful burning of forest, grass, croplands,
5
6 rangeland, or other wild lands by owner, as provided for in Section
6
7 16-28.1 of Title 2 of the Oklahoma Statutes;
7
8 7. Possession of incendiary device with the intent to burn, as
8
9 provided for in Section 16-34 of Title 2 of the Oklahoma Statutes;
9
10 8. Operate aircraft not registered with the Federal Aviation
10
11 Administration Office of Aircraft Registry or foreign country, as
11
12 provided for in subsection A of Section 258 of Title 3 of the
12
13 Oklahoma Statutes;
13
14 9. Supply false information in regard to aircraft ownership, as
14
15 provided for in subsection B of Section 258 of Title 3 of the
15
16 Oklahoma Statutes;
16
17 10. Concealing identity of aircraft, as provided for in
17
18 subsection C of Section 258 of Title 3 of the Oklahoma Statutes;
18
19 11. Destruction of registration or serial number on aircraft,
19
20 as provided for in subsection A of Section 259 of Title 3 of the
20
21 Oklahoma Statutes;
21
22 12. Destruction of registration or serial number on aircraft
22
23 with intent to conceal, as provided for in subsection B of Section
23
24 259 of Title 3 of the Oklahoma Statutes;

1 13. Sell, purchase, or possess aircraft with removed or
1
2 falsified identification number with intent to misrepresent the
2
3 identity of aircraft, as provided for in subsection D of Section 259

5 14. Operating aircraft under the influence of alcohol, second
5
6 or subsequent offense within ten (10) years, as provided for in
6
7 subsection A of Section 301 of Title 3 of the Oklahoma Statutes;

8 15. Operating aircraft under the influence of intoxicant,

9 second or subsequent offense with ten (10) years, as provided for in

19 B. Any person convicted of a Class D1 criminal offense set

20 forth in this section shall be punished by imprisonment in the
20
21 custody of the Department of Corrections for a term of not more than
21
22 five (5) years and shall serve at least twenty percent (20%) of the
22
23 sentence imposed before release from custody including release to
23
24

1 electronic monitoring pursuant to Section 510.9 of Title 57 of the
1
2 Oklahoma Statutes.

3 C. 1. Every person who, having been previously convicted of
3
4 one or two Class C or Class D criminal offenses, commits a Class D1
4
5 criminal offense shall, upon conviction, be punished by imprisonment
5
6 in the custody of the Department of Corrections for a term of not
6
7 less than one (1) year nor more than seven (7) years and shall serve
7
8 at least twenty percent (20%) of the sentence imposed before release
8
9 from custody including release to electronic monitoring pursuant to
9
10 Section 510.9 of Title 57 of the Oklahoma Statutes.
10
11 2. Every person who, having been previously convicted of three
11
12 Class C or Class D criminal offenses, or one or more Class Y, Class
12
13 A, or Class B criminal offenses, commits a Class D1 criminal offense
13
14 shall, upon conviction, be punished by imprisonment in the custody
14
15 of the Department of Corrections for a term of not less than two (2)
15
16 years nor more than ten (10) years and shall serve at least thirty
16
17 percent (30%) of the sentence imposed before release from custody
17
18 including release to electronic monitoring pursuant to Section 510.9

20 D. Unless specifically exempted pursuant to subsection E of

23 E. The criminal offenses listed in paragraphs 98, 108, 212 211,

24 213 212, and 229 228 of subsection A of this section shall be exempt

1 from the penalty provisions provided for in subsections B and C of
1
2 this section. Persons convicted of the criminal offenses provided
2
3 for in paragraphs 98, 108, 212 211, 213 212, and 229 228 of
3
4 subsection A of this section shall be punished in accordance with
4
5 the corresponding penalties provided for in the Oklahoma Statutes
5
6 including Section 51.1 of Title 21 of the Oklahoma Statutes this
6
7 title.

8 F. All Class D1 criminal offenses shall be punishable by the
8
9 corresponding fines as provided for in the Oklahoma Statutes.
9
10 SECTION 3. AMENDATORY 21 O.S. 2021, Section 1171, as
10
11 amended by Section 403, Chapter 486, O.S.L. 2025 (21 O.S. Supp.
11
12 2025, Section 1171), is amended to read as follows:
12
13 Section 1171. A. Every 1. Any person who hides, waits, or
13
14 otherwise loiters in the vicinity of any private dwelling house,
14
15 apartment building, any other place of residence, or in the vicinity
15
16 of any locker room, dressing room, restroom, or any other place
16
17 where a person has a right to a reasonable expectation of privacy,
17
18 with the unlawful and willful intent to watch, gaze, or look upon
18
19 any person in a clandestine manner, shall, upon conviction, be
19
20 guilty of a misdemeanor. The violator shall be punished punishable
20
21 by imprisonment in the county jail for a term of not more than one
21
22 (1) year, or by a fine not to exceed Five Thousand Dollars
22
23 ($5,000.00), or by both such fine imprisonment and imprisonment
23
24 fine.

1 2. Any person convicted of a second or subsequent offense
1
2 shall, upon conviction, be guilty of a Class B5 felony offense
2
3 punishable by imprisonment in the custody of the Department of
3
4 Corrections for a term not more than five (5) years, or by a fine
4
5 not to exceed Five Thousand Dollars ($5,000.00), or by both such
5
6 imprisonment and fine.

7 B. Every Any person who uses photographic, electronic, or video
7
8 equipment in a clandestine manner for any illegal, illegitimate,
8
9 prurient, lewd, or lascivious purpose with the unlawful and willful
9
10 intent to view, watch, gaze, or look upon any person without the
10
11 knowledge and consent of such person when the person viewed is in a
11
12 place where there is a right to a reasonable expectation of privacy,
12
13 or who publishes or distributes any image obtained from such act,
13
14 shall, upon conviction, be guilty of a Class D1 Class B5 felony
14
15 offense. The violator shall be punished punishable by imprisonment
15
16 as provided for in subsections B through F of Section 20N of this
16
17 title in the custody of the Department of Corrections for a term not
17
18 more than five (5) years, or by a fine not exceeding to exceed Five
18
19 Thousand Dollars ($5,000.00), or by both such fine imprisonment and
19
20 imprisonment fine.

21 C. Every 1. Any person who uses photographic, electronic, or

22 video equipment in a clandestine manner for any illegal,
22
23 illegitimate, prurient, lewd, or lascivious purpose with the
23
24 unlawful and willful intent to view, watch, gaze, or look upon any

1 person and capture an image of a private area of a person without
1
2 the knowledge and consent of such person and knowingly does so under
2
3 circumstances in which a reasonable person would believe that the
3
4 private area of the person would not be visible to the public,
4
5 regardless of whether the person is in a public or private place
5
6 shall, upon conviction, be guilty of a misdemeanor. The violator
6
7 shall be punished punishable by imprisonment in the county jail for
7
8 a term of not more than one (1) year, or by a fine not exceeding to
8
9 exceed Five Thousand Dollars ($5,000.00), or by both such fine
9
10 imprisonment and imprisonment fine.

11 2. Any person convicted of a second or subsequent offense

21 SECTION 4. AMENDATORY 57 O.S. 2021, Section 582, as
21
22 amended by Section 14, Chapter 151, O.S.L. 2024 (57 O.S. Supp. 2025,
22
23 Section 582), is amended to read as follows:

2 Registration Act shall apply to any person residing, working, or

3 attending school within the State of Oklahoma this state who, after
3
4 November 1, 1989, has been convicted, whether upon a verdict or plea
4
5 of guilty or upon a plea of nolo contendere, or received a suspended
5
6 sentence or any probationary term, or is currently serving a
6
7 sentence or any form of probation or parole for a crime or an
7
8 attempt to commit a crime provided for in Section 843.5 of Title 21
8
9 of the Oklahoma Statutes if the offense involved sexual abuse or
9
10 sexual exploitation as those terms are defined in Section 1-1-105 of
10
11 Title 10A of the Oklahoma Statutes, Section 681, if the offense
11
12 involved sexual assault, 741, if the offense involved sexual abuse
12
13 or sexual exploitation, Section 748, if the offense involved human
13
14 trafficking for commercial sex, Section 843.1, if the offense
14
15 involved sexual abuse or sexual exploitation, Section 852.1, if the
15
16 offense involved sexual abuse of a child, 856, if the offense
16
17 involved child sex trafficking or human trafficking for commercial
17
18 sex, 865 et seq., 885, 886, 888, 891, if the offense involved sexual
18
19 abuse or sexual exploitation, 1021, 1021.2, 1021.3, 1024.2, 1029, if
19
20 the offense involved child sex trafficking, 1040.8, if the offense
20
21 involved child pornography sexual abuse material, 1040.12a, 1040.13,
21
22 1040.13a, 1087, 1088, 1111.1, 1114 or, 1123, paragraph 2 of

23 subsection A of Section 1171, subsection B of Section 1171, or

3 B. The provisions of the Sex Offenders Registration Act shall

4 apply to any person who after November 1, 1989, resides, works, or

5 attends school within the State of Oklahoma this state and who has
5
6 been convicted or received a suspended sentence at any time in any
6
7 court of another state, the District of Columbia, Puerto Rico, Guam,
7
8 American Samoa, the Northern Mariana Islands, and the United States
8
9 Virgin Islands, a federal court, an Indian tribal court, a military
9
10 court, or a court of a foreign country for a crime, attempted crime,
10
11 or a conspiracy to commit a crime which, if committed or attempted
11
12 in this state, would be a crime, an attempt to commit a crime, or a
12
13 conspiracy to commit a crime provided for in any of the laws listed
13
14 in subsection A of this section.

15 C. The provisions of the Sex Offenders Registration Act shall
15
16 apply to any person who resides, works, or attends school within the
16
17 State of Oklahoma this state and who has received a deferred
17
18 judgment at any time in any court of another state, the District of
18
19 Columbia, Puerto Rico, Guam, American Samoa, the Northern Mariana
19
20 Islands, and the United States Virgin Islands, a federal court, an
20
21 Indian tribal court, a military court, or a court of a foreign
21
22 country for a crime, attempted crime, or a conspiracy to commit a
22
23 crime which, if committed or attempted or conspired to be committed
23
24 in this state, would be a crime, an attempt to commit a crime, or a

1 conspiracy to commit a crime provided for in Section 843.5 of Title
1
2 21 of the Oklahoma Statutes if the offense involved sexual abuse or
2
3 sexual exploitation as those terms are defined in Section 1-1-105 of
3
4 Title 10A of the Oklahoma Statutes, Section 681, if the offense
4
5 involved sexual assault, 741, if the offense involved sexual abuse
5
6 or sexual exploitation, Section 748, if the offense involved human
6
7 trafficking for commercial sex, Section 843.1, if the offense
7
8 involved sexual abuse or sexual exploitation, Section 852.1, if the
8
9 offense involved sexual abuse of a child, 856, if the offense
9
10 involved child sex trafficking or human trafficking for commercial
10
11 sex, 865 et seq., 885, 886, 888, 891, if the offense involved sexual
11
12 abuse or sexual exploitation, 1021, 1021.2, 1021.3, 1024.2, 1029, if
12
13 the offense involved child sex trafficking, 1040.8, if the offense
13
14 involved child pornography sexual abuse material, 1040.12a, 1040.13,
14
15 1040.13a, 1087, 1088, 1111.1, 1114, or 1123, paragraph 2 of
15
16 subsection A of Section 1171, subsection B of Section 1171, or
16
17 paragraph 2 of subsection C of Section 1171 of Title 21 of the
17
18 Oklahoma Statutes. The provisions of the Sex Offenders Registration
18
19 Act shall not apply to any such person while the person is
19
20 incarcerated in a maximum or medium correctional institution of the
20
21 Department of Corrections.

22 D. On November 1, 2002, any person registered as a sex offender
22
23 pursuant to Section 741 of Title 21 of the Oklahoma Statutes shall
23
24 be summarily removed from the Sex Offender Registry by the

1 Department of Corrections and all law enforcement agencies of any
1
2 political subdivision of this state, unless the offense involved
2
3 sexual abuse or sexual exploitation.
3
4 E. The provisions of the Sex Offenders Registration Act shall
4
5 not apply to any such person who has received a criminal history
5
6 records expungement for a conviction in another state for a crime or
6
7 attempted crime which, if committed or attempted in this state,
7
8 would be a crime or an attempt to commit a crime provided for in any
8
9 laws listed in subsection A of this section.
9
10 F. The provisions of the Sex Offenders Registration Act shall
10
11 apply to any person residing, working, or attending school within
11
12 this state who, after the effective date of this act November 1,
12
13 1989, has been convicted, whether upon a verdict or plea of guilty
13
14 or upon a plea of nolo contendere, or received a suspended sentence
14
15 or any probationary term, or is currently serving a sentence or any
15
16 form of probation or parole for a crime or an attempt to commit a
16
17 crime as provided for in subsection G of Section 1040.13b of Title
17
18 21 of the Oklahoma Statutes.

19 G. The provisions of the Sex Offenders Registration Act shall
19
20 apply to any person who resides, works, or attends school within
20
21 this state and who has received a deferred judgment at any time in
21
22 any court of another state, the District of Columbia, Puerto Rico,
22
23 Guam, American Samoa, the Northern Mariana Islands, and the United
23
24 States Virgin Islands, a federal court, an Indian tribal court, a

1 military court, or a court of a foreign country for a crime, if
1
2 committed in this state, would be a crime, as provided for in
2
3 subsection F G of Section 1040.13b of Title 21 of the Oklahoma
3
4 Statutes. The provisions of the Sex Offenders Registration Act
4
5 shall not apply to any such person while the person is incarcerated
5
6 in a maximum or medium correctional institution of the Department of
6
7 Corrections.
7
8 SECTION 5. REPEALER 57 O.S. 2021, Section 582, as
8
9 amended by Section 41, Chapter 59, O.S.L. 2024 (57 O.S. Supp. 2025,
9
10 Section 582), is hereby repealed.
10
11 SECTION 6. This act shall become effective November 1, 2026.
