7 An Act relating to professions and occupations;
7 amending 59 O.S. 2021, Section 46.4, as last amended
8 by Section 4, Chapter 138, O.S.L. 2024 (59 O.S. Supp.
8 2025, Section 46.4), which relates to the Board of
9 Governors of the Architects, Landscape Architects and
9 Licensed Interior Designers of Oklahoma; extending
10 sunset date; updating statutory language; providing
10 an effective date; and declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 59 O.S. 2021, Section 46.4, as
14
15 last amended by Section 4, Chapter 138, O.S.L. 2024 (59 O.S. Supp.
15
16 2025, Section 46.4), is amended to read as follows:

17 Section 46.4. There is hereby re-created, to continue until
17
18 July 1, 2026 July 1, 2036, in accordance with the provisions of the
18
19 Oklahoma Sunset Law, a board to be known as the "Board of Governors
19
20 of the Architects, Landscape Architects and Licensed Interior
20
21 Designers of Oklahoma", hereinafter referred to as the Board. The
21
22 Board shall be composed of eleven (11) members including six persons
22
23 who are duly licensed to practice architecture and are in good
23
24 standing in this state, two persons who are duly licensed to

1 practice landscape architecture and are in good standing in this

2 state, two persons who are duly licensed interior designers and who
2
3 are active and in good standing, and one lay member. Each member of
3
4 the Board shall be a qualified elector of this state, and the
4
5 architect, landscape architect, and licensed interior designer
5
6 members shall have had five (5) years' licensing experience as the
6
7 professional position requires in this state. Re-creation of the
7
8 Board shall not alter existing staggered terms. Board members,
8
9 other than the lay member, shall be appointed for a period of five
9
10 (5) years thereafter; provided, that nothing herein shall affect the
10
11 tenure of office of anyone who is a member of the Board on May 31,
11
12 1957. A member may be reappointed to succeed such membership. The
12
13 architect, landscape architect, or the licensed interior designer
13
14 members may be appointed by the Governor from a list of nominees
14
15 submitted by respective professional societies of this state.
15
16 Membership in a professional society shall not be a prerequisite to
16
17 appointment to the Board. The lay member of the Board shall be
17
18 appointed by the Governor to a term coterminous with that of the
18
19 Governor. The lay member shall serve at the pleasure of the
19
20 Governor. Provided, the lay member may continue to serve after the
20
21 expiration of the term of the member until such time as a successor
21
22 is appointed. Vacancies which may occur in the membership of the
22
23 Board shall be filled by appointment by the Governor. Each person
23
24 who has been appointed to fill a vacancy shall serve for the

1 remainder of the term for which the member the person shall whom he
1
2 or she will succeed was appointed and until a successor, in turn,
2
3 has been appointed and shall have qualified. Each member of the
3
4 Board, before entering upon the discharge of the duties of the
4
5 member, shall make and file with the Secretary of State a written
5
6 oath or affirmation for the faithful discharge of official duties.

7 Each member of the Board and staff shall be reimbursed for travel
7
8 expenses pursuant to the State Travel Reimbursement Act.
8
9 SECTION 2. This act shall become effective July 1, 2026.
9
10 SECTION 3. It being immediately necessary for the preservation
10
11 of the public peace, health, or safety, an emergency is hereby
11
12 declared to exist, by reason whereof this act shall take effect and
12
13 be in full force from and after its passage and approval.
