7         An Act relating to state government; defining terms;

7         prohibiting state agencies from charging for certain

8         cost; providing exception; providing for

8         codification; providing an effective date; and

9         declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      NEW LAW        A new section of law to be codified

13

14 in the Oklahoma Statutes as Section 85.80 of Title 74, unless there
14

15 is created a duplication in numbering, reads as follows:
15

16  A. As used in this section:

16

17  1. "State agency" means any board, commission, department,

17

18 authority, bureau, office, or other entity of this state created
18

19 with authority to make rules or formulate orders as defined in the
19

20 Administrative Procedures Act; and
20

21  2. "Cost of labor" means a lump sum or hourly rate charged for

21

22 an employee's expertise, time, and skill in performing a specific
22

23 duty.

1   B. Except as provided in subsection C of this section, no state

1

2 agency, when performing a service for or on behalf of another state
2

3 agency, shall charge the state agency receiving the service for the
3

4 cost of labor associated with such service.
4

5   C. The provisions of this section shall not apply to services

5

6 performed by employees of the Office of the State Auditor and
6

7 Inspector.

8   SECTION 2. This act shall become effective July 1, 2026.

8

9   SECTION 3. It being immediately necessary for the preservation

9

10 of the public peace, health or safety, an emergency is hereby
10

11 declared to exist, by reason whereof this act shall take effect and
11

12 be in full force from and after its passage and approval.
