7   An Act relating to voter registration; amending 26

7   O.S. 2021, Sections 4-112, as amended by Section 18,

8   Chapter 282, O.S.L. 2022, 4-114, and 4-120, as last

8   amended by Section 1, Chapter 302, O.S.L. 2025 (26

9   O.S. Supp. 2025, Sections 4-112 and 4-120), which

9   relate to applications, maintenance of registration

10  information, and cancellation; requiring certain

10  information to be included on voter registration

11  applications; requiring county election boards to

11  transmit certain information to the State Election

12  Board in certain circumstance; requiring the

12  maintenance of certain records; requiring the

13  Secretary of the State Election Board to issue

13  certain reports; modifying reasons for cancellation;

14  updating statutory language; and declaring an

14  emergency.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17

18  SECTION 1.      AMENDATORY  26 O.S. 2021, Section 4-112, as

18

19 amended by Section 18, Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2025,
19

20 Section 4-112), is amended to read as follows:
20

21  Section 4-112. A. The Secretary of the State Election Board

21

22 shall devise and distribute a registration application form to be
22

23 used for registering voters. Such registration application shall
23

24 contain the following information:

1   1. The applicant's full name and date of birth, county and

2 place of residence, and mailing address pursuant to the provisions
2

3 of subsection G of this section;
3

4   2. A space or section to designate a political party recognized

4

5 by the laws of the State of Oklahoma this state with which the
5

6 applicant chooses to be affiliated;
6

7   3. The Oklahoma driver license or identification card number if

7

8 the applicant has been issued a current and valid driver license or
8

9 identification card by Service Oklahoma, or if the applicant does
9

10 not have a valid Oklahoma driver license or identification card, the
10

11 last four digits of the voter's Social Security number;
11

12  4. An oath of the eligibility of the applicant to become a

12

13 registered voter; and
13

14  5. A space or section to indicate whether the applicant has

14

15 previously been registered to vote in another state;
15

16  6. A space or section to provide the address where the

16

17 applicant was registered to vote at the time of submitting the
17

18 application including the street number, city or town, state and zip
18

19 code, or a detailed description of the location if no street address
19

20 is available, if applicable;
20

21  7. A statement and corresponding space or section to sign

21

22 acknowledging and agreeing that by completing and submitting the
22

23 signed application, and upon its approval, the applicant requests
23

24 the cancellation of his or her registration by the former state

1 pursuant to 52 U.S.C., Section 20507(a)(3)(A) and directs the State
1

2 Election Board to forward the request to the chief election official
2

3 of that state; and
3

4  5. 8. Such other information as may be deemed necessary by the

4

5 Secretary to identify such applicant and to ascertain his or her
5

6 eligibility.
6

7  B. A voter registration application shall be signed by the

7

8 applicant in writing. The applicant shall personally subscribe his
8

9 or her name to or make his or her mark on the application, and no
9

10 agent, representative, or employee of the applicant may sign or mark
10

11 on the applicant's behalf. The signature or mark must be the
11

12 original, handwritten signature, autograph, or mark of the
12

13 applicant. No facsimile, reproduction, typewritten, or other
13

14 substitute signature, autograph, or mark will be valid.
14

15 Notwithstanding any law to the contrary, the Secretary of the State
15

16 Election Board shall prescribe procedures to authorize any person
16

17 incapable of personally making a mark to complete a voter
17

18 registration application with assistance of an official of any voter
18

19 registration agency or licensed operator specified in Sections 4-
19

20 109.2 and 4-109.3 of this title. Provided, for applications
20

21 submitted electronically, in lieu of the signature requirements set
21

22 forth in this subsection, the applicant shall consent to the use of
22

23 his or her driver license or identification card signature as
23

24 provided in Section 4-109.4 of this title.

1   C. Persons who do not indicate a recognized political party or

2 political organization on their registration application shall be
2

3 designated as Independents.
3

4   D. Any person may apply in writing to the Secretary of the

4

5 State Election Board for permission to print, copy, or otherwise
5

6 prepare and distribute the registration applications designed by the
6

7 Secretary of the State Election Board. The Secretary may revoke any
7

8 such permission at any time.
8

9   E. All registration applications shall be distributed to the

9

10 public at no charge.
10

11  F. The Secretary also shall prescribe procedures to accept and

11

12 use the National Mail Voter Registration Form, or its successor, as
12

13 required by the National Voter Registration Act of 1993. Provided,
13

14 to be accepted as a valid voter registration application, the form
14

15 shall include the applicant's original, handwritten signature,
15

16 autograph, or mark as described in subsection B of this section.
16

17  G. Applicants for voter registration or for change of voter

17

18 registration in any way shall provide a residence address and, if
18

19 different from the residence address, a mailing address. A
19

20 residence address shall include the street address of the residence,
20

21 including a full house number, street name or number, apartment or
21

22 suite number, if applicable, and zip code. If a street address is
22

23 not available for the residence, applicants shall provide such
23

24 information as the Secretary of the State Election Board deems

1 necessary for voter registration purposes. A post office box may
1

2 not be given as a residence address. A mailing address, which shall
2

3 include the city and zip code, may be the actual emergency
3

4 notification or 911 9-1-1 address on file in the local community, a
4

5 rural route and box number, a post office box number, or a street
5

6 address.
6

7   H. A full or partial Social Security number or driver license

7

8 number in a voter registration record or a voter registration
8

9 application shall not be considered a public record and shall be
9

10 kept confidential by the State Election Board and each county
10

11 election board.
11

12  SECTION 2.      AMENDATORY  26 O.S. 2021, Section 4-114, is

12

13 amended to read as follows:
13

14  Section 4-114. A. The secretary of each county election board

14

15 shall cause the registration information of every registered voter
15

16 in the county to be entered into the voter registration database.
16

17  B. If a voter successfully registers to vote in this state and

17

18 the registration application indicated that the applicant was
18

19 previously registered to vote in another state, the county election
19

20 board shall cause the following information to be recorded and
20

21 transmitted to the State Election Board:
21

22  1. The voter's full legal name;

22

23  2. The voter's date of birth;

23

24  3. The last four digits of the voter's Social Security number;

1   4. The voter's driver license number;

2   5. Any unique voter identification number assigned to the

2

3 voter, if applicable;
3

4   6. The voter's current address of residence;

4

5   7. The voter's previous address of residence; and

5

6   8. A copy of the voter's registration application.

7   C. The Secretary of the State Election Board shall prescribe

7

8 the manner and frequency in which county election boards must record
8

9 and transmit the information under subsection B of this section.
9

10 Such transmissions shall occur no fewer than four (4) times in each
10

11 calendar year.
11

12  D. If a registered voter's information is transmitted to the

12

13 State Election Board pursuant to subsection B of this section, a
13

14 record of the transmission shall be included in the corresponding
14

15 voter's registration record. The record shall be treated as a voter
15

16 list maintenance record and shall be stored with the voter's
16

17 registration record while the voter is registered in this state.
17

18  E. After receiving a voter's information pursuant to subsection

18

19 B of this section, the Secretary of the State Election Board shall
19

20 send notice to the chief election official of the jurisdiction where
20

21 the voter was previously registered to vote informing him or her
21

22 that the identified voter was successfully registered to vote in
22

23 this state, that the voter listed a residential address located in
23

24 this state on his or her registration application, and the voter has

1 requested cancellation of his or her voter registration in the
1

2 recipient official's state. The Secretary shall include with the
2

3 notice a copy of the voter's registration application or the
3

4 information obtained pursuant to subsection B of this section and
4

5 shall provide any other information requested by the recipient
5

6 official's state.
6

7   F. The Secretary of the State Election Board shall cause a

7

8 report to be issued publicly no fewer than four (4) times in each
8

9 calendar year that reports:
9

10  1. The total number of notices sent pursuant to subsection E of

10

11 this section since the last report, the states to which such notices
11

12 were sent, and the number of notices sent to each listed state; and
12

13  2. The total number of records received indicating registered

13

14 voters in this state have applied to register to vote in another
14

15 state and their current registration status.
15

16  SECTION 3.       AMENDATORY  26 O.S. 2021, Section 4-120, as

16

17 last amended by Section 1, Chapter 302, O.S.L. 2025 (26 O.S. Supp.
17

18 2025, Section 4-120), is amended to read as follows:
18

19  Section 4-120. A. The registration of any registered voter

19

20 shall be canceled only for one of the following reasons:
20

21  1. Written notice from the voter pursuant to Section 4-120.1 of

21

22 this title;
22

23  2. Death;

23

24  3. Conviction of a felony;

1   4. Judicial determination of mental incapacitation under Title

1

2 30 of the Oklahoma Statutes;
2

3   5. Registration in another county or state, including receipt

3

4 by a county or state election official of information from an
4

5 election official in another state indicating that a registered
5

6 voter in this state has registered to vote in that state;
6

7   6. Failure to respond to a confirmation of address mailing and

7

8 failure to vote as prescribed in Section 4-120.2 of this title;
8

9   7. The surrendering of the voter's Oklahoma driver license to

9

10 Service Oklahoma upon being issued a driver license in another
10

11 state;
11

12  8. Being excused from jury duty for not being a citizen of the

12

13 United States; or
13

14  9. Determination that the voter is not a citizen of the United

14

15 States.
15

16  B. For purposes of this section, paragraphs 5 and 7 of

16

17 subsection A of this section shall constitute confirmation from the
17

18 voter to cancel his or her voter registration due to a change of
18

19 residence.
19

20  C. A list of voter registrations that were canceled during the

20

21 previous twenty-four (24) months, and the reason for the
21

22 cancellation, shall be made available to the public.
22

23  SECTION 4. It being immediately necessary for the preservation

23

24 of the public peace, health or safety, an emergency is hereby

1 declared to exist, by reason whereof this act shall take effect and
1

2 be in full force from and after its passage and approval.
