7   An Act relating to the Oklahoma Consumer Protection

7   Act; amending 15 O.S. 2021, Section 754, which

8   relates to exemptions; modifying exemptions; and

8   providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.      AMENDATORY     15 O.S. 2021, Section 754, is

12

13 amended to read as follows:
13

14  Section 754. Nothing in the Oklahoma Consumer Protection Act

14

15 shall apply to:
15

16  1. Publishers, broadcasters, printers or other persons insofar

16

17 as an unlawful practice as defined in Section 753 of this title
17

18 involves information that has been disseminated or reproduced on
18

19 behalf of others without knowledge that it is an unlawful practice;
19

20  2. Actions or transactions regulated under laws administered by

20

21 the Corporation Commission or;
21

22  3. Actions or transactions required or authorized under

22

23 specific laws or regulations administered by any other regulatory
23

1 body or officer acting under statutory authority of this state or
1

2 the United States, or to acts;
2

3   4. Acts done by retailers or other persons acting in good faith

3

4 on the basis of information or matter supplied by others and without
4

5 knowledge of the deceptive character of such information or matter;

6 and or
6

7   3. 5. The collection of monies denominated as gross receipts

7

8 tax on mixed beverages, sales tax or use tax, or asserted injuries
8

9 or damages that are monies that have been collected as, or
9

10 denominated as, gross receipts tax on mixed beverages, sales tax or
10

11 use tax, and which have been remitted to the Oklahoma Tax Commission
11

12 or other governmental taxing authority.

13  SECTION 2. This act shall become effective November 1, 2026.
