7 An Act relating to construction zones; defining term;
7 requiring the Department of Public Safety and
8 Department of Transportation to place certain devices
8 and signage in construction zones; stating allowable
9 use; providing permissible image retention;
9 prohibiting certain uses; requiring certain
10 calibration; requiring certain audit; providing
10 penalty; providing for codification; and providing an
11 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 11-806.3 of Title 47, unless
16
17 there is created a duplication in numbering, reads as follows:

18 A. For the purposes of this section, "automated enforcement
18
19 device" means a system operated by a law enforcement agency in this
19
20 state that:
20
21 1. Is capable of detecting a speeding violation; and
21
22 2. Photographs or records an image of the vehicle used in
22
23 committing a speeding violation, the operator of the vehicle, or the
23
24 license plate of the vehicle.

1 B. 1. The Department of Public Safety and the Department of
1
2 Transportation may place automated enforcement devices at the start
2
3 of a construction zone. A sign shall be placed one hundred (100)
3
4 feet before the automated enforcement device to warn drivers that
4
5 their speed will be monitored and an image may be captured while
5
6 entering the construction zone.

7 2. The automated enforcement device shall only capture an image
7
8 and alert a peace officer if a driver is exceeding the speed limit
8
9 in a work zone in excess of ten (10) miles per hour of a speed limit
9
10 violation.

11 3. Any image captured but not used as evidence must be deleted
11
12 from the automated enforcement device within fifteen (15) minutes.

13 4. Any image captured that is used as evidence of a speed limit
13
14 violation shall be deleted within twenty-four (24) hours of
14
15 resolution of the citation.

16 5. The Department of Public Safety shall not retain, except as
16
17 required in this subsection, sell, or transfer any image captured by
17
18 an automated enforcement device.

19 6. The automated enforcement device shall only be used to
19
20 capture an image and shall not be used for purposes of
20
21 identification or analysis.

22 7. The automated enforcement device shall be calibrated every
22
23 time its position is changed. The results of the calibration shall
23
24 be made available to the public.

1 8. An independent audit of the calibration records and image

2 retention shall be conducted at least twice a year for each
2
3 automated enforcement device. If an audit reveals that images were
3
4 retained in violation of this subsection, the vendor of the device
4
5 shall be fined One Thousand Dollars ($1,000.00) per image.

6 SECTION 2. This act shall become effective November 1, 2026.
