7 An Act relating to mental health; requiring
7 nonphysical intervention training for certain
8 facilities and programs; describing training;
8 requiring and prohibiting certain acts by staff or
9 volunteer; providing for codification; and providing
9 an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 3-336 of Title 43A, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. All clinical staff, direct care staff, and volunteers
16
17 providing direct care to minor children in any facility or program
17
18 that is certified by the Department of Mental Health and Substance
18
19 Abuse Services under Title 43A of the Oklahoma Statutes and receives
19
20 funding through a contract with the Department shall receive
20
21 nonphysical intervention training as described in subsection B of
21
22 this section, subject to such exceptions as may be provided by rules
22
23 of the Board of Mental Health and Substance Abuse Services.

1 B. The nonphysical intervention training shall teach techniques
1
2 and philosophies addressing appropriate nonviolent interventions for
2
3 potentially physical interpersonal conflicts, staff attitudes that
3
4 promote dignity and enhanced self-esteem, keys to effective
4
5 communication skills, verbal and nonverbal interaction, and
5
6 nonviolent intervention.

7 C. The staff member or volunteer:
7
8 1. Shall complete the nonphysical intervention training within
8
9 thirty (30) days of being hired, with updates each calendar year
9
10 thereafter; and
10
11 2. Shall not participate in an intervention of a minor child
11
12 without first completing the training.

13 SECTION 2. This act shall become effective November 1, 2026.
