7   An Act relating to crimes and punishments; amending

7   21 O.S. 2021, Section 1685, as amended by Section

8   165, Chapter 486, O.S.L. 2025 (21 O.S. Supp. 2025,

8   Section 1685), which relates to animal cruelty;

9   updating statutory language; requiring the Department

9   of Corrections to create certain database;

10  authorizing promulgation of rules; and providing an

10  effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      AMENDATORY  21 O.S. 2021, Section 1685, as

14

15 amended by Section 165, Chapter 486, O.S.L. 2025 (21 O.S. Supp.
15

16 2025, Section 1685), is amended to read as follows:
16

17  Section 1685. A. Any person who shall willfully or maliciously

17

18 torture, destroy or kill, or cruelly beat or injure, maim or
18

19 mutilate any animal in subjugation or captivity, whether wild or
19

20 tame, and whether belonging to the person or to another, or deprive
20

21 any such animal of necessary food, drink, shelter, or veterinary
21

22 care to prevent suffering; or who shall cause, procure or permit any
22

23 such animal to be so tortured, destroyed or killed, or cruelly
23

24 beaten or injured, maimed or mutilated, or deprived of necessary

1 food, drink, shelter, or veterinary care to prevent suffering; or
1

2 who shall willfully set on foot, instigate, engage in, or in any way
2

3 further any act of cruelty to any animal, or any act tending to
3

4 produce such cruelty, shall, upon conviction, be guilty of a Class
4

5 B5 felony offense and shall be punished punishable by imprisonment
5

6 in the State Penitentiary not exceeding custody of the Department of
6

7 Corrections for not more than five (5) years, or by imprisonment in
7

8 the county jail for not exceeding more than one (1) year, or by a
8

9 fine not exceeding more than Five Thousand Dollars ($5,000.00). Any
9

10 animal so maltreated or abused shall be considered an abused or
10

11 neglected animal.

12  B. The Department of Corrections shall create a searchable

12

13 database on its website of the names of individuals who have been
13

14 convicted of, or who have entered a plea of guilty or nolo
14

15 contendere to, a violation of this section. The Department shall
15

16 promulgate rules to effectuate the provisions of this subsection.
16

17  SECTION 2. This act shall become effective November 1, 2026.
