7 An Act relating to state government; defining term;
7 authorizing the State Purchasing Director to prepare
8 a bid-preference program; providing for codification;
8 and providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 85.49 of Title 74, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. As used in this act, "eligible new corporation" means any
15
16 corporation that has been in operation for fewer than five (5)
16
17 years, and is validly licensed as provided in the applicable laws of
17
18 this state on and after the effective date of this act.
18
19 B. For competitive bids submitted to the state pursuant to the
19
20 Oklahoma Central Purchasing Act or pursuant to the Public
20
21 Competitive Bidding Act of 1974 by eligible new corporations, the
21
22 State Purchasing Director shall prepare and implement a bid-
22
23 preference program. The program shall require that, if the
23
24 percentage of such funds expended on eligible new corporations is

1 less than ten percent (10%), a percentage shall be added to the

2 price of the lowest bid and if the eligible new corporation submits
2
3 a bid that falls below the lowest bid plus the percentage, it shall
3
4 receive the contract.

5 SECTION 2. This act shall become effective November 1, 2026.
