7 An Act relating to elections; creating the In-Person
7 Absentee Voting Expansion Grant Program; stating
8 purpose; providing eligibility criteria; providing
8 requirements for grant application; authorizing the
9 State Election Board to promulgate rules, forms, and
9 procedures; providing allowable sources of funding
10 for grant program; requiring the Legislature to
10 provide certain funding; providing for codification;
11 and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 7-140 of Title 26, unless there
16
17 is created a duplication in numbering, reads as follows:

18 A. There is hereby created within the State Election Board the
18
19 In-Person Absentee Voting Expansion Grant Program for the purpose of
19
20 providing financial assistance to county election boards to
20
21 establish and operate additional in-person absentee voting sites for
21
22 statewide elections held in November of even-numbered years.
22
23 B. Counties that meet the following criteria may apply in even-
23
24 numbered years for funding under the In-Person Absentee Voting

1 Expansion Grant Program for each additional in-person absentee

2 voting location:

3 1. Counties with more than four hundred thousand (400,000)
3
4 registered voters may receive up to six grants for up to six
4
5 additional in-person absentee voting locations;
5
6 2. Counties with more than one hundred thousand (100,000)
6
7 registered voters may receive up to five grants for up to five
7
8 additional in-person absentee voting locations;
8
9 3. Counties with more than fifty thousand (50,000) registered
9
10 voters may receive up to four grants for up to four additional in-
10
11 person absentee voting locations; and
11
12 4. Counties with more than twenty-five thousand (25,000)
12
13 registered voters or encompassing more than one thousand five
13
14 hundred (1,500) square miles in land area may receive up to two
14
15 grants for up to two additional in-person absentee voting locations.

16 C. County election boards that operate two or more in-person
16
17 absentee voting locations with county election board funds may apply
17
18 in even-numbered years for grants to cover expenses related to the
18
19 establishment and operation of the in-person absentee voting
19
20 locations.

21 D. Beginning July 1, 2027, the State Election Board shall award
21
22 grants in the amount of Twenty-five Thousand Dollars ($25,000.00)
22
23 for each approved grant application to cover expenses related to
23
24 establishing and operating one in-person absentee voting location

1 including, but not limited to, staffing, facility rental, equipment,

2 security, and administrative costs. Such grants shall only be used
2
3 for expenses related to the establishment and operation of an in-
3
4 person absentee voting location authorized by subsection B of this
4
5 section.

6 E. County election boards applying for grants shall submit a
6
7 grant application to the State Election Board in the manner
7
8 prescribed by rule. Applications shall include a proposed location
8
9 and justification based on population distribution, travel distance,
9
10 access needs, and expected voter turnout, a staffing and security
10
11 plan, and any additional information required by the State Election
11
12 Board. The State Election Board shall review and approve
12
13 applications based on compliance with this section and availability
13
14 of program funding or an allocation to the revolving fund described
14
15 in Section 2 of this act.

16 F. The Secretary of the State Election Board shall promulgate
16
17 rules, forms, and procedures necessary to implement the In-Person
17
18 Absentee Voting Expansion Grant Program including, but not limited
18
19 to, criteria for distributing funds, timelines for applications,
19
20 reporting requirements, and allowable expenditures.

21 SECTION 2. NEW LAW A new section of law to be codified
21
22 in the Oklahoma Statutes as Section 7-140.1 of Title 26, unless
22
23 there is created a duplication in numbering, reads as follows:

1 There is hereby created in the State Treasury a revolving fund
1
2 for the State Election Board to be designated the "In-Person
2
3 Absentee Voting Expansion Grant Program Revolving Fund". The fund
3
4 shall be a continuing fund, not subject to fiscal year limitations,
4
5 and shall consist of all monies received by the State Election Board
5
6 from the Legislature provided for the purpose of administering the
6
7 In-Person Absentee Voting Expansion Grant Program. All monies
7
8 accruing to the credit of the fund are hereby appropriated and may
8
9 be budgeted and expended by the State Election Board for the purpose
9
10 provided for in Section 1 of this act. Expenditures from the fund
10
11 shall be made upon warrants issued by the State Treasurer against
11
12 claims filed as prescribed by law with the Director of the Office of
12
13 Management and Enterprise Services for approval and payment.

14 SECTION 3. This act shall become effective January 1, 2027.
