7 An Act relating to the state Medicaid program;
7 amending 63 O.S. 2021, Section 5009.6, which relates
8 to diabetes self-management; removing obsolete
8 language; providing for Medicaid coverage of diabetes
9 self-management education and support (DSMES);
9 directing promulgation of certain rules; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 63 O.S. 2021, Section 5009.6, is
14
15 amended to read as follows:
15
16 Section 5009.6. A. The Oklahoma Health Care Authority shall
16
17 examine the feasibility of a state plan amendment to the Oklahoma
17
18 Medicaid Program for diabetes self-management training (DSMT).
18
19 B. By December 1, 2018, the Authority shall submit a report to
19
20 the President Pro Tempore of the Senate, the Speaker of the House of
20
21 Representatives and the Governor estimating the potential costs to
21
22 the state, clinical findings, reviews of pilot projects and research
22
23 from other states on the effects of DSMT on persons with a diabetes
23
24 diagnosis.

1 C. Beginning July 1, 2019, and subject to the availability of

2 funding and receipt of any necessary federal approval, the Oklahoma
2
3 Health Care Authority shall draft a state plan amendment for DSMT
3
4 cover diabetes self-management education and support (DSMES) under
4
5 the state Medicaid program for persons with a diabetes diagnosis.
5
6 The provisions of this subsection shall only apply if the report
6
7 required by subsection B of this section demonstrates DSMT to be
7
8 evidence-based and essential to qualifying participants in the
8
9 Oklahoma Medicaid Program.

10 D. As used in this section, "diabetes self-management training
10
11 (DSMT)" means the process of facilitating the knowledge, skill and
11
12 ability necessary for diabetes self-care. This process requires
12
13 incorporating the patient's unique needs and experiences into an
13
14 individualized education and support plan that promotes new
14
15 behaviors and solutions, including, but not limited to, healthy
15
16 eating, physical activity, self-monitoring and medication use.
16
17 B. The Oklahoma Health Care Authority Board shall promulgate
17
18 rules as necessary to implement this section including, but not
18
19 limited to, rules on provider eligibility and requirements, scope of
19
20 services, coverage, and reimbursement.
20
21 SECTION 2. This act shall become effective November 1, 2026.
