7 An Act relating to the state Medicaid program;
7 directing the Oklahoma Health Care Authority to
8 pursue certain policies and programs; directing
8 establishment of the Diabetes Prevention Program
9 (DPP); imposing certain duty on contracted entities;
9 describing DPP; providing certain powers and duties
10 of Medicaid providers; requiring provision of
10 services by peer coaches; describing peer coach;
11 specifying certain limits on allowed coaching
11 sessions; directing development of certain payment
12 methodologies; requiring certain arrangement for
12 unlicensed peer coach; limiting effect of act;
13 authorizing certain contracts; providing certain
13 exemption; providing for codification; and providing
14 an effective date.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

18 SECTION 1. NEW LAW A new section of law to be codified
18
19 in the Oklahoma Statutes as Section 5009.6A of Title 56, unless
19
20 there is created a duplication in numbering, reads as follows:

21 A. The Oklahoma Health Care Authority shall pursue policies and
21
22 programs to assist members of the state Medicaid program in
22
23 preventing or delaying the onset of type 2 diabetes.

1 B. 1. The Authority shall establish the "Diabetes Prevention
1
2 Program" (DPP) within the fee-for-service and managed care delivery
2
3 systems of the state Medicaid program.
3
4 2. Each contracted entity shall make the DPP available to
4
5 enrolled members in accordance with this section.
5
6 3. The DPP shall be an evidence-based, lifestyle change program
6
7 designed to prevent or delay the onset of type 2 diabetes among
7
8 individuals with prediabetes.
8
9 C. A Medicaid provider may identify and recommend participation
9
10 in the DPP to a member who meets the eligibility requirements of the
10
11 federal Centers for Disease Control and Prevention (CDC) Diabetes
11
12 Prevention Recognition Program.
12
13 D. In implementing the DPP, the Authority shall require that
13
14 Medicaid providers offering DPP services:
14
15 1. Comply with guidelines issued by the CDC and obtain CDC
15
16 recognition in connection with the National Diabetes Prevention
16
17 Program; and
17
18 2. Use a CDC-approved lifestyle change curriculum that does all
18
19 of the following:

20 a. emphasizes self-monitoring, self-efficacy, and
20
21 problem-solving,
21
22 b. provides for coach feedback,
22
23 c. includes participant materials to support program
23
24 goals, and

1 d. requires participant weigh-ins to track and achieve

2 program goals.

3 E. DPP services shall be provided by peer coaches who shall
3
4 promote realistic lifestyle changes, emphasize weight loss through
4
5 healthy eating and physical activity, and implement the DPP
5
6 curriculum. A trained peer coach may be a physician, a nonphysician
6
7 practitioner, or an unlicensed person who has been trained to
7
8 deliver the required curriculum content and possesses the skills,
8
9 knowledge, and qualities specified in the National Diabetes
9
10 Prevention Program guidelines.

11 F. A member who participates in the DPP shall be allowed to
11
12 participate in twenty-two peer coaching sessions over a period of at
12
13 least one (1) year. Thereafter, the Authority shall provide a
13
14 participating member who achieves and maintains a required minimum
14
15 weight loss of five percent (5%) from the first core session, in
15
16 accordance with CDC standards, with less intensive, ongoing
16
17 maintenance sessions to help the member continue healthy behaviors.

18 G. 1. The Authority shall develop payment methodologies, or
18
19 adjust existing methodologies, for reimbursing DPP services and
19
20 activities in the Medicaid fee-for-service delivery system, not to
20
21 exceed eighty percent (80%) of the federal Medicare program
21
22 reimbursement for comparable service, billing, and diagnosis codes
22
23 under the federal Medicare program.

1 2. For purposes of reimbursement under the Medicaid fee-for-
1
2 service delivery system, an unlicensed peer coach shall have an
2
3 arrangement with a participating Medicaid provider for purposes of
3
4 reimbursement for rendered DPP services.
4
5 H. This section shall be implemented only to the extent that
5
6 the Authority obtains federal financial participation to the extent
6
7 permitted by federal law, and obtains any necessary federal
7
8 approvals.
8
9 I. For the purposes of implementing this section, the Authority
9
10 may enter into exclusive or nonexclusive contracts on a bid or
10
11 negotiated basis, including contracts for the purpose of obtaining
11
12 subject matter expertise or other technical assistance. A contract
12
13 may be statewide or on a limited geographic basis. A contract
13
14 entered into or amended pursuant to this section shall be exempt
14
15 from the Oklahoma Central Purchasing Act.

16 SECTION 2. This act shall become effective November 1, 2026.
