7 An Act relating to school nutrition; creating the
7 Thrive Act; providing short title; defining terms;
8 directing school districts with certain identified
8 student percentage that opt into certain provision
9 beginning in certain school year to be eligible for
9 certain reimbursement percentage; directing the State
10 Department of Education, in certain collaboration, to
10 evaluate certain impact by certain date and with
11 certain frequency; requiring electronic submission of
11 certain evaluation; providing for promulgation of
12 rules; providing for codification; and providing an
12 effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 3-119.2 of Title 70, unless
17
18 there is created a duplication in numbering, reads as follows:

19 A. This act shall be known and may be cited as the "Thrive
19
20 Act".
20
21 B. As used in this section:
21
22 1. "Community eligibility provision" means the federal
22
23 provision created pursuant to 42 U.S.C., Section 1759a that allows
23
24 school districts to choose to receive federal special assistance

1 payments for school meals in exchange for providing free school
1
2 meals to all students enrolled in all or selected school sites
2
3 within the school district; and
3
4 2. "Identified student percentage" means the percentage of a
4
5 school district's enrollment that is certified eligible for free
5
6 meals based on a documentation of benefit of receipt or categorical
6
7 eligibility as provided for in 7 C.F.R., Section 245.6.

8 C. Beginning with the 2027-2028 school year, school districts
8
9 with an identified student percentage of forty percent (40%) or
9
10 higher that opt in to the community eligibility provision of the
10
11 National School Lunch Program and demonstrate financial need shall
11
12 be eligible to receive state child nutrition funds for:
12
13 1. One hundred percent (100%) reimbursement per meal served in
13
14 a school district with an enrollment of two thousand (2,000) or
14
15 fewer students;
15
16 2. Ninety percent (90%) reimbursement per meal served in a
16
17 school district with an enrollment of more than two thousand (2,000)
17
18 students but fewer than ten thousand (10,000) students; and
18
19 3. Eighty percent (80%) reimbursement per meal served in a
19
20 school district with an enrollment of ten thousand (10,000) or more
20
21 students.

22 D. By July 1, 2028, and by July 1 every three (3) years
22
23 thereafter, the State Department of Education, in collaboration with
23
24 an institution of higher education within The Oklahoma State System
24

1 of Higher Education, shall evaluate the impact of the provisions of

2 this section. The evaluation shall be electronically submitted to
2
3 the Governor, the President Pro Tempore of the Senate, and the
3
4 Speaker of the House of Representatives.

5 E. The State Board of Education may promulgate rules to
5
6 implement the provisions of this section.
6
7 SECTION 2. This act shall become effective July 1, 2027.
