7 An Act relating to poultry feeding operations;
7 establishing a moratorium on registration of new
8 poultry feeding operations; providing exception;
8 authorizing Oklahoma Department of Agriculture, Food,
9 and Forestry to conduct certain inspection; requiring
9 Department to cease registration under certain
10 circumstance; providing for promulgation of rules;
10 providing for codification; and providing an
11 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 10-9.4a of Title 2, unless there
16
17 is created a duplication in numbering, reads as follows:

18 A. Beginning on the effective date of this act, the Oklahoma
18
19 Department of Agriculture, Food, and Forestry shall declare and
19
20 establish a moratorium on the registration of any new poultry
20
21 feeding operations.
21
22 B. The provisions of this section shall not apply to existing
22
23 poultry feeding operations; provided, however, the Department shall
23
24 be authorized to review, inspect, or investigate existing poultry
24

1 feeding operations, and, if such review, inspection, or
1
2 investigation results in a penalty pursuant to Section 10-9.11 of
2
3 Title 2 of the Oklahoma Statutes, the Department shall cease
3
4 registration of the violating poultry feeding operation. The
4
5 Department shall not reissue a certification for any operation whose
5
6 certification was revoked pursuant to this subsection.
6
7 C. The Department shall promulgate any rules necessary to
7
8 implement the provisions of this section.

9 SECTION 2. NEW LAW A new section of law to be codified
9
10 in the Oklahoma Statutes as Section 20-44a of Title 2, unless there
10
11 is created a duplication in numbering, reads as follows:

12 A. Beginning on the effective date of this act, the Oklahoma
12
13 Department of Agriculture, Food, and Forestry shall declare and
13
14 establish a moratorium on new concentrated animal feeding operations
14
15 licenses for persons engaging in poultry feeding operations for
15
16 which registration is not required pursuant to subsection B of
16
17 Section 10-9.3 of Title 2 of the Oklahoma Statutes.
17
18 B. The provisions of this section shall not apply to existing
18
19 concentrated animal feeding operations licenses for persons engaging
19
20 in poultry feeding operations; provided, however, the Department
20
21 shall be authorized to review, inspect, or investigate existing
21
22 concentrated animal feeding operations for persons engaging in
22
23 poultry feeding operations, and, if such review, inspection, or
23
24 investigation violates the provisions of Section 20-61 of Title 2 of

1 the Oklahoma Statutes, the Department shall revoke the license of
1
2 such individuals engaging in the poultry feeding operation. The
2
3 Department shall not reissue a license for any operation whose
3
4 license was revoked pursuant to this subsection.

5 C. The Department shall promulgate any rules necessary to
5
6 implement the provisions of this section.

7 SECTION 3. This act shall become effective November 1, 2025.
