7   An Act relating to veterans; requiring the Oklahoma

7   Department of Veterans Affairs to create certain

8   program to provide certain headstone or marker;

8   providing certain requirements for certain headstone

9   or marker; providing certain burial grant for certain

9   eligible persons; providing certain eligibility

10  requirements; requiring certain promulgation of

10  rules; creating certain revolving fund; providing for

11  codification; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

15

16 in the Oklahoma Statutes as Section 37 of Title 72, unless there is
16

17 created a duplication in numbering, reads as follows:
17

18  A. The Oklahoma Department of Veterans Affairs shall establish

18

19 a program to provide any eligible person or veteran of the Oklahoma
19

20 National Guard who meets the requirements set forth in subsection B
20

21 of this section to receive either a proper memorial headstone or
21

22 marker meeting the same physical standards for size, material,
22

23 composition, placement, and informational content of the provisions
23

24 of 38 U.S.C., Section 2306 or Two Hundred Dollars ($200.00) for

1 reimbursement for a memorial headstone or marker. The program shall

2 provide a burial grant for any veteran or any person who qualifies
2

3 for reimbursement, as determined by the Oklahoma Department of
3

4 Veterans Affairs. Reimbursement shall be provided from the National
4

5 Guard Veteran Burial Revolving Fund established in Section 2 of this
5

6 act.

7   B. To be eligible for the program, the member shall:

7

8   1. Have served six (6) or more years in the Oklahoma National

8

9 Guard;
9

10  2. Have died as a resident of this state;

10

11  3. Have been separated or discharged from service honorably or

11

12 under honorable conditions; and
12

13  4. Not qualify to receive a proper memorial headstone or marker

13

14 pursuant to 38 U.S.C., Section 2306.
14

15  C. An application process for the implementation of this

15

16 program shall be developed by the Oklahoma Department of Veterans
16

17 Affairs.
17

18  D. The Oklahoma Veterans Commission shall promulgate any rules

18

19 necessary for the implementation of this act.
19

20  SECTION 2.     NEW LAW  A new section of law to be codified

20

21 in the Oklahoma Statutes as Section 38 of Title 72, unless there is
21

22 created a duplication in numbering, reads as follows:

23  There is hereby created in the State Treasury a revolving fund

23

24 to be designated the "National Guard Veteran Burial Revolving Fund",

1 which shall be administered by the Oklahoma Department of Veterans
1

2 Affairs. The fund shall be a continuing fund, not subject to fiscal
2

3 year limitations, and shall consist of any legislative
3

4 appropriations, donations, and gifts received from any individuals
4

5 or organizations. All monies accruing to the credit of the fund are
5

6 appropriated and may be budgeted and expended by the Oklahoma
6

7 Department of Veterans Affairs to provide a proper memorial
7

8 headstone or marker to an eligible person or veteran of the Oklahoma
8

9 National Guard who meets the requirements set forth in Section 1 of
9

10 this act.

11  SECTION 3. This act shall become effective November 1, 2026.
