7   An Act relating to schools; creating the Menstrual

7   Products for Schools Revolving Fund; specifying

8   sources of fund; providing for expenditures;

8   providing purpose of fund; directing the State

9   Department of Education to utilize the fund to assist

9   certain schools in making menstrual products

10  available in certain restrooms; defining term;

10  providing for codification; providing an effective

11  date; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

15

16 in the Oklahoma Statutes as Section 1-127 of Title 70, unless there
16

17 is created a duplication in numbering, reads as follows:
17

18  A. There is hereby created in the State Treasury a revolving

18

19 fund for the State Department of Education to be designated the
19

20 "Menstrual Products for Schools Revolving Fund". The fund shall be
20

21 a continuing fund, not subject to fiscal year limitations, and shall
21

22 consist of all monies received by the Department from gifts, grants,
22

23 donations, bequests, and state appropriations provided for the
23

24 purpose of implementing the provisions of subsection B of this

1 section. All monies accruing to the credit of the fund are hereby
1

2 appropriated and may be budgeted and expended by the Department for
2

3 the purpose provided for in this subsection. Expenditures from the
3

4 fund shall be made upon warrants issued by the State Treasurer
4

5 against claims filed as prescribed by law with the Director of the
5

6 Office of Management and Enterprise Services for approval and
6

7 payment.

8   B. Subject to the availability of funding, the State Department

8

9 of Education shall utilize the Menstrual Products for Schools
9

10 Revolving Fund created in subsection A of this section to assist
10

11 each school district and public charter school in this state in
11

12 making menstrual products available, at no cost, in school restrooms
12

13 designated for use by females and single-occupancy restrooms.
13

14  C. For the purposes of this section, "menstrual products" means

14

15 tampons and sanitary napkins for use in connection with the
15

16 menstrual cycle.
16

17  SECTION 2. This act shall become effective July 1, 2026.

17

18  SECTION 3. It being immediately necessary for the preservation

18

19 of the public peace, health, or safety, an emergency is hereby
19

20 declared to exist, by reason whereof this act shall take effect and
20

21 be in full force from and after its passage and approval.
