7 An Act relating to the Oklahoma Campus Security Act;
7 amending 74 O.S. 2021, Section 360.18, which relates
8 to authorization to establish campus police
8 departments; requiring certain campus police officers
9 to complete certain training; requiring certain
9 employed campus police officers to complete certain
10 training within certain time period; updating
10 statutory language; providing an effective date; and
11 declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 74 O.S. 2021, Section 360.18, is
15
16 amended to read as follows:
16
17 Section 360.18. A. Governing boards of institutions of higher
17
18 education or private schools, boards of education of public school
18
19 districts, and airport public trusts are authorized to establish
19
20 campus police departments pursuant to the provisions of the Oklahoma
20
21 Campus Security Act. In the case of airport public trusts operating
21
22 more than one airport, the board of trustees of such airport public
22
23 trust is authorized to establish campus police departments at any
23

1 airport it operates, but is not required to establish campus police

2 departments at all airports operated by such airport public trust.

3 These B. The governing boards may employ and commission campus
3
4 police officers and may designate uniforms, badges, and insignia to
4
5 be worn by such officers and displayed on vehicles or other
5
6 equipment of the department. Campus police departments shall use
6
7 the following words or phrases, alone or in any combination, in
7
8 conjunction with the uniform, badges, insignia, or on vehicles
8
9 utilized by these departments: university police, university public
9
10 safety department, campus police department, campus police officer,
10
11 campus public safety department, campus public safety officer,
11
12 airport officer, airport police officer, airport security officer,
12
13 airport public safety officer, or any standardized title such as
13
14 director, chief, major, captain, lieutenant, sergeant, or corporal.
14
15 Upon appointment, each such officer shall be given a written
15
16 commission, with a photo identification, evidencing the officer's
16
17 appointment and authority. The form of this commission shall be
17
18 prescribed by the governing boards specified in Section 360.15 et
18
19 seq. of this title. Persons employed by a governing board which has
19
20 established a campus police department but who are not campus police
20
21 officers shall not be permitted to wear uniforms, badges, or
21
22 insignia specified in this subsection or receive commissions or
22
23 photo identification of the type provided campus police officers.

1 C. Campus police officers employed by governing boards of
1
2 institutions of higher education and public school district boards
2
3 of education shall complete a minimum of six (6) hours of evidence-
3
4 based sexual assault and sexual violence training as provided for in
4
5 subsection B of Section 3311.5 of Title 70 of the Oklahoma Statutes.
5
6 A campus police officer employed as of the effective date of this
6
7 act who has not completed the sexual assault and sexual violence
7
8 training required by this subsection shall complete such training
8
9 within one (1) year.

10 B. D. The commission of a campus police officer may be
10
11 suspended or revoked by the governing board for any reason. Such
11
12 commission also may be suspended or revoked by the district attorney
12
13 in whose district the officer is employed for cause related to the
13
14 campus police officer's ability to exercise the powers of such
14
15 commission in the interest of public security or suspended or
15
16 revoked by the district attorney upon conviction of the campus
16
17 police officer for larceny, theft, embezzlement, false pretense,
17
18 fraud, any nonconsensual sex offense, any offense involving a minor
18
19 as a victim, any offense involving the possession, use, distribution
19
20 or sale of a controlled dangerous substance, or any offense
20
21 involving a firearm. The commission of a campus police officer
21
22 convicted of a felony or of a crime involving moral turpitude shall
22
23 be revoked by the district attorney upon conviction. The commission
23
24 of a campus police officer no longer employed by the governing

1 board, except an officer who is retiring, shall be relinquished to
1
2 the board, or its representative, at the time of cessation of the
2
3 employment. When a commission is revoked or relinquished, the
3
4 campus police department shall take possession of all campus police
4
5 officer insignia, badges, identification cards, and weapons issued
5
6 to the officer. A person who fails to relinquish the insignia,
6
7 badges, identification cards or weapons, upon conviction, shall be
7
8 deemed guilty of a misdemeanor and shall be punished by the
8
9 imposition of a fine of not more than One Thousand Dollars
9
10 ($1,000.00) or by imprisonment in the county jail for not to exceed
10
11 one (1) year, or by both such fine and imprisonment.
11
12 C. E. Governing boards shall notify the Council on Law
12
13 Enforcement Education and Training (CLEET) when an officer is
13
14 commissioned or a commission is relinquished or revoked. The
14
15 governing boards shall provide CLEET with all information regarding
15
16 commissioned officers requested by CLEET.
16
17 D. F. A campus police officer employed pursuant to the Oklahoma
17
18 Campus Security Act shall not be able to participate in either the
18
19 Oklahoma Police Pension and Retirement System or the Oklahoma Law
19
20 Enforcement Retirement System, unless otherwise entitled to by law.
20
21 SECTION 2. This act shall become effective July 1, 2026.
21
22 SECTION 3. It being immediately necessary for the preservation
22
23 of the public peace, health, or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and
1
2 be in full force from and after its passage and approval.
