7 An Act relating to groundwater permits; defining
7 terms; establishing moratorium on issuance of certain
8 groundwater permits; prescribing study to be
8 conducted on certain groundwater basins; specifying
9 terms of moratorium; providing for codification; and
9 declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 1022 of Title 82, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. As used in this section:
16
17 1. "Basin" means a major groundwater basin or minor groundwater
17
18 basin as defined in Section 1020.1 of Title 82 of the Oklahoma
18
19 Statutes; and
19
20 2. "Domestic use" means domestic use as defined in Section
20
21 1020.1 of Title 82 of the Oklahoma Statutes.

22 B. A moratorium is hereby established on the issuance of any
22
23 regular, temporary, or special permit for groundwater use, other
23
24 than for domestic use. Except as provided for in this section, no

1 permit may be issued for the use of groundwater from any basin in

2 this state until the Oklahoma Water Resources Board completes a
2
3 hydrological study and approves a maximum annual yield for a
3
4 particular basin that will ensure that any permit for the removal of
4
5 water from the groundwater basin will not reduce the natural flow of
5
6 water from springs or streams emanating from the basin. Once the
6
7 study and determination of maximum annual yield is completed, the
7
8 Board may resume the issuance of groundwater permits for such basin.
8
9 C. 1. The provisions of this section shall be applicable to
9
10 any groundwater permit application for which no final adjudication
10
11 has been made by the Oklahoma Water Resources Board before the
11
12 effective date of this act.

13 2. Any revalidation of a temporary permit in effect upon the
13
14 effective date of this act shall be considered a new permit
14
15 application and subject to the provisions of this section.
15
16 SECTION 2. It being immediately necessary for the preservation
16
17 of the public peace, health or safety, an emergency is hereby
17
18 declared to exist, by reason whereof this act shall take effect and
18
19 be in full force from and after its passage and approval.
