9 1113), which relates to requirements and
10 specifications for license plates; clarifying certain
10 provision; construing certain provision; providing
11 for certain traffic stop in certain circumstance;
11 designating the cause of a certain traffic stop as a
12 secondary offense; updating statutory references;
12 updating statutory language; and providing an
13 effective date.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
17
18 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1113, as
18
19 last amended by Section 72, Chapter 452, O.S.L. 2024 (47 O.S. Supp.
19
20 2025, Section 1113), is amended to read as follows:
20
21 Section 1113. A. 1. Except for all-terrain vehicles, utility
21
22 vehicles and motorcycles used exclusively off roads and highways,
22
23 upon the filing of a registration application and the payment of the
23
24 fees provided for in the Oklahoma Vehicle License and Registration

1 Act, Service Oklahoma or the Corporation Commission, as applicable,
1
2 shall assign to the vehicle described in the application a
2
3 distinctive number, and issue to the owner of the vehicle a
3
4 certificate of registration, one license plate, and a yearly decal.
4
5 Service Oklahoma shall assign an all-terrain vehicle, utility
5
6 vehicle, or motorcycle used exclusively off roads and highways a
6
7 distinctive number and issue to the owner a certificate of
7
8 registration and a decal but not a license plate. For each
8
9 subsequent registration year, Service Oklahoma shall issue a yearly
9
10 decal to be affixed to the license plate, except for an all-terrain
10
11 vehicle, utility vehicle, or motorcycle used exclusively off roads
11
12 and highways. The initial decal for an all-terrain vehicle, utility
12
13 vehicle, or motorcycle shall be attached to the front of the vehicle
13
14 and shall be in clear view. The decal shall be on the front or on
14
15 the front fork of the motorcycle used exclusively off roads and
15
16 highways and the decal shall be in clear view. The yearly decal
16
17 shall have an identification number and the last two numbers of the
17
18 registration year for which it shall expire. Except as provided by
18
19 Section 1113A of this title, the license plate shall be affixed to
19
20 the exterior of the vehicle until a replacement license plate is
20
21 applied for. If the owner applies for a replacement license plate,
21
22 Service Oklahoma shall charge the fee provided for in Section 1114
22
23 of this title. The yearly decal will validate the license plate for
23
24 each registration period other than the year the license plate is

1 issued. The license plate and decal shall be of such size, color,
1
2 design, and numbering as Service Oklahoma may direct. However,
2
3 yearly decals issued to the owner of a vehicle who has filed an
3
4 affidavit with the appropriate licensed operator in accordance with
4
5 Section 7-607 of this title shall be a separate and distinct color
5
6 from all other decals issued under this section. Before the
6
7 effective date of this act August 25, 2017, Service Oklahoma shall
7
8 also issue a monthly decal which shall include a two-letter
8
9 abbreviation corresponding to the county in which the vehicle is
9
10 registered. Service Oklahoma shall issue all decals in the
10
11 possession of Service Oklahoma on the effective date of this act
11
12 August 25, 2017, before issuing any decals which do not contain the
12
13 county abbreviation.
13
14 2. a. The operation of a street-legal utility vehicle on the
14
15 streets and highways of this state requires the
15
16 vehicle be issued a certificate of registration and
16
17 license plate to be renewed annually. Upon the filing
17
18 of a registration application and the payment of the
18
19 fees provided for in the Oklahoma Vehicle License and
19
20 Registration Act, Service Oklahoma or the Corporation
20
21 Commission, as applicable, shall assign to the vehicle
21
22 described in the application a distinctive number, and
22
23 issue to the owner of the vehicle a certificate of
23
24 registration, one license plate and a yearly decal.

1 For each subsequent registration year, Service
1
2 Oklahoma shall issue a yearly decal to be affixed to
2
3 the license plate. The initial decal for a street-
3
4 legal utility vehicle shall be attached to the front
4
5 of the vehicle and shall be in clear view. The yearly
5
6 decal shall have an identification number and the last
6
7 two numbers of the registration year for which it
7
8 shall expire. Except as provided by Section 1113A of
8
9 this title, the license plate shall be affixed to the
9
10 exterior of the vehicle until a replacement license
10
11 plate is issued. If the owner applies for a
11
12 replacement license plate, Service Oklahoma shall
12
13 charge the fee provided for in Section 1114 of this
13
14 title. The yearly decal will validate the license
14
15 plate for each registration period other than the year
15
16 the license plate is issued. The license plate and
16
17 decal shall be of such size, color, design, and
17
18 numbering as Service Oklahoma may direct. However,
18
19 yearly decals issued to the owner of a vehicle who has
19
20 filed an affidavit with the appropriate licensed
20
21 operator in accordance with Section 7-607 of this
21
22 title shall be a separate and distinct color from all
22
23 other decals issued under this section.

1 b. Service Oklahoma shall design and issue a temporary
1
2 tag to out-of-state owners of street-legal utility
2
3 vehicles. The temporary tag shall be recognized in
3
4 lieu of registration in this state. The temporary tag
4
5 shall clearly indicate the date of issuance and the
5
6 date of expiration, which shall be five (5) days,
6
7 including the day of issuance. Upon application for a
7
8 temporary tag, the out-of-state owner shall show proof
8
9 of insurance coverage that satisfies the requirements
9
10 of the Compulsory Insurance Law pursuant to Section 7-
10
11 600 et seq. of this title. Service Oklahoma is
11
12 authorized to promulgate rules and procedures to
12
13 implement the provisions of this paragraph.
13
14 3. a. The operation of a military surplus vehicle, as
14
15 defined by Section 1-133.1a of this title, on the
15
16 streets and highways of this state requires that the
16
17 vehicle be issued a certificate of registration and
17
18 license plate to be renewed annually. Upon the filing
18
19 of a registration application and the payment of the
19
20 fees provided for in the Oklahoma Vehicle License and
20
21 Registration Act, Service Oklahoma or the Corporation
21
22 Commission, as applicable, shall design and assign
22
23 license plates of a distinctive design in lieu of the
23
24 usual license plates that shall show, in addition to

1 the identification number, that the vehicle meets the
1
2 qualifications of a military surplus vehicle, as the
2
3 case may be, owned by an Oklahoma military surplus
3
4 vehicle collector. The registration shall be valid
4
5 for one (1) year and may be renewed by payment of such
5
6 annual fee. The yearly decal shall have an
6
7 identification number and the last two numbers of the
7
8 registration year for which it shall expire. Except
8
9 as provided by Section 1113A of this title, the
9
10 license plate shall be affixed to the exterior of the
10
11 vehicle until a replacement license plate is issued.
11
12 If the owner applies for a replacement license plate,
12
13 Service Oklahoma shall charge the fee provided for in
13
14 Section 1114 of this title. The yearly decal will
14
15 validate the license plate for each registration
15
16 period other than the year the license plate is
16
17 issued. The license plate and decal shall be of such
17
18 size, color, design, and numbering as Service Oklahoma
18
19 may direct. However, yearly decals issued to the
19
20 owner of a vehicle who has filed an affidavit with the
20
21 appropriate licensed operator in accordance with
21
22 Section 7-607 of this title shall be a separate and
22
23 distinct color from all other decals issued under this
23
24 section.

1 b. Each military surplus vehicle collector, as defined by
1
2 Section 1-133.1b of this title, who applies for
2
3 military surplus vehicle license plates will be issued
3
4 a military surplus collector's identification number
4
5 that will appear on each license plate. Second and
5
6 all subsequent registrations under this section by the
6
7 same collector will bear the same collector's
7
8 identification number followed by a suffix letter for
8
9 vehicle identification.
9
10 c. A military surplus vehicle collector must shall own
10
11 and have registered one or more vehicles with regular
11
12 Oklahoma license plates that are used for regular
12
13 transportation.
13
14 d. There shall be a one-time processing fee of Twenty
14
15 Dollars ($20.00) to defray the cost of issuing the
15
16 original military surplus vehicle collector's military
16
17 surplus vehicle designation license plates to ensure
17
18 that each collector will be issued only one
18
19 collector's identification number.
19
20 4. a. The license plate shall be securely attached to the
20
21 rear of the vehicle, except truck-tractor plates which
21
22 shall be attached to the front of the vehicle.
22
23 Service Oklahoma may, with the concurrence of the
23
24 Department of Public Safety, by Joint Rule, change and

1 direct the manner, place, and location of display of
1
2 any vehicle license plate when such action is deemed
2
3 in the public interest. The license plate, decal and
3
4 all letters and numbers on the license plate shall be
4
5 clearly visible at all times. The operation of a
5
6 vehicle in this state, regardless of where such
6
7 vehicle is registered, upon which the license plate is
7
8 covered, overlaid, or otherwise screened with any
8
9 material, whether such material be clear, translucent,
9
10 tinted, or opaque, in a manner which covers or
10
11 obscures the decal and all letters and numbers on such
11
12 plate, shall be a violation of this paragraph.
12
13 b. The provisions of this paragraph shall not be
13
14 construed to consider a decorative frame around a
14
15 license plate to be a violation of this paragraph if
15
16 such decorative frame allows for the clear display of
16
17 the decal and all letters and numbers on the license
17
18 plate. A decorative frame shall only serve as the
18
19 basis for a traffic stop if a law enforcement officer
19
20 is unable to read the decal and all letters and
20
21 numbers on the license plate due to the placement of
21
22 such decorative frame. A traffic stop of a vehicle in
22
23 violation of this paragraph due to the placement of a
23
24 decorative frame shall be considered a stop for a

1 secondary offense, and evidence obtained solely as a
1
2 result of such stop shall be inadmissible in any civil
2
3 or criminal proceeding except as otherwise permitted
3
4 by law.
4
5 5. Upon payment of the annual registration fee provided in
5
6 Section 1133 of this title, Service Oklahoma or the Corporation
6
7 Commission, as applicable, or a licensed operator may issue a
7
8 permanent nonexpiring license plate to an owner of one hundred or
8
9 more commercial motor vehicles and for vehicles registered under the
9
10 provisions of Section 1120 of this title. Upon payment of the
10
11 annual registration fee, Service Oklahoma or the Corporation
11
12 Commission shall issue a certificate of registration that shall be
12
13 carried at all times in the vehicle for which it is issued.
13
14 Provided, if the registrant submits its application through
14
15 electronic means, such qualified owners of one hundred or more
15
16 commercial motor vehicles, properly registered pursuant to the
16
17 provisions of Section 1133 of this title, may elect to receive a
17
18 permanent certificate of registration that shall be carried at all
18
19 times in the vehicle for which it is issued.
19
20 6. Every vehicle owned by an agency of this state shall be
20
21 exempt from the payment of registration fees required by this title.
21
22 Provided, such vehicle shall be registered and shall otherwise
22
23 comply with the provisions of the Oklahoma Vehicle License and
23
24 Registration Act.

1 B. The license plates required under the provisions of this
1
2 title shall conform to the requirements and specifications listed
2
3 hereinafter as follows:
3
4 1. Each license plate shall have a space for the placement of
4
5 the yearly decals for each succeeding year of registration after the
5
6 initial issue;
6
7 2. The provisions of the Oklahoma Vehicle License and
7
8 Registration Act regarding the issuance of yearly decals shall not
8
9 apply to the issuance of apportioned license plates, including
9
10 license plates for state vehicles, and exempt plates for
10
11 governmental entities and fire departments organized pursuant to
11
12 Section 592 of Title 18 of the Oklahoma Statutes;
12
13 3. All license plates and decals shall be made with
13
14 reflectorized material as a background to the letters, numbers, and
14
15 characters displayed thereon. The reflectorized material shall be
15
16 of such a nature as to provide effective and dependable brightness
16
17 during the service period for which the license plate or decal is
17
18 issued;
18
19 4. Except as otherwise provided in this subsection, Service
19
20 Oklahoma shall design appropriate official license plates for all
20
21 state vehicles. Such license plates shall be permanent in nature
21
22 and designed in such manner as to remain with the vehicle for the
22
23 duration of the vehicle's life span or until the title is
23
24 transferred to a nongovernmental owner;

1 5. Within the limits prescribed in this section, Service
1
2 Oklahoma shall design appropriate official license plates for
2
3 vehicles of the Oklahoma Highway Patrol. The license plates shall
3
4 have the legend "Oklahoma OK" and shall contain the letters "OHP"
4
5 followed by the state seal and the badge number of the Highway
5
6 Patrol officer to whom the vehicle is assigned. The words "Oklahoma
6
7 Highway Patrol" shall also be included on such license plates;
7
8 6. Within the limits prescribed in this section, Service
8
9 Oklahoma shall design appropriate official license plates for
9
10 vehicles of the Oklahoma Military Department. Such license plates
10
11 shall have the legend "Oklahoma OK" and shall contain the letters
11
12 "OMD" followed by the state seal and three numbers or letters as
12
13 designated by the Adjutant General. The words "Oklahoma Military
13
14 Department" shall also be included on such license plates;
14
15 7. Within the limits prescribed in this section, Service
15
16 Oklahoma shall design appropriate official license plates for
16
17 vehicles of the Oklahoma Department of Corrections. Such license
17
18 plates shall contain the letters "DOC" followed by the Department of
18
19 Corrections badge and three numbers or letters or combination of
19
20 both as designated by the Director of the agency. The words
20
21 "Department of Corrections" shall also be included on such license
21
22 plates; and
22
23 8. Within the limits prescribed in this section, the Oklahoma
23
24 Tourism and Recreation Department shall design any license plates

1 required by the initiation of a license plate reissuance by Service
1
2 Oklahoma at the request of the Department of Public Safety pursuant
2
3 to the provisions of Section 1113.2 of this title. Any such new
3
4 designs shall be submitted by the Oklahoma Tourism and Recreation
4
5 Department to the Department of Public Safety for its approval prior
5
6 to being issued by Service Oklahoma.
6
7 C. Where the applicant has satisfactorily shown that the
7
8 applicant owns the vehicle sought to be registered but is unable to
8
9 produce documentary evidence of the ownership, a license plate may
9
10 be issued upon approval by Service Oklahoma or the Corporation
10
11 Commission, as applicable. In such instances the reason for not
11
12 issuing a certificate of title shall be indicated on the receipt
12
13 given to the applicant. It shall still be the duty of the applicant
13
14 to immediately take all necessary steps to obtain the Oklahoma
14
15 certificate of title and it shall be unlawful for the applicant to
15
16 sell the vehicle until the certificate has been obtained in the
16
17 applicant's name.
17
18 D. The certificate of registration provided for in this section
18
19 shall be in convenient form, and the certificate of registration, or
19
20 a certified copy or photostatic copy thereof, duly authenticated by
20
21 Service Oklahoma or the Corporation Commission, as applicable, shall
21
22 be carried at all times in or upon all vehicles so registered, in
22
23 such manner as to permit a ready examination thereof upon demand by
23
24 any peace officer of the state or duly authorized employee of the

1 Department of Public Safety. Any such officer or agent may seize
1
2 and hold such vehicle when the operator of the same does not have
2
3 the registration certificate in the operator's possession or when
3
4 any such officer or agent determines that the registration
4
5 certificate has been obtained by misrepresentation of any essential
5
6 or material fact or when any number or identifying information
6
7 appearing on such certificate has been changed, altered,
7
8 obliterated, or concealed in any way, until the proper registration
8
9 or identification of such vehicle has been made or produced by the
9
10 owner thereof.

11 E. The purchaser of a new or used manufactured home shall,
11
12 within thirty (30) days of the date of purchase, register the home
12
13 with Service Oklahoma or a licensed operator pursuant to the
13
14 provisions of Section 1117 of this title. For a new manufactured
14
15 home, it shall be the responsibility of the dealer selling the home
15
16 to place a temporary license plate on the home in the same manner as
16
17 provided in Section 1128 of this title for other new motor vehicles.
17
18 For the first year that any manufactured home is registered in this
18
19 state, Service Oklahoma shall issue a metal license plate which
19
20 shall be affixed to the manufactured home. The temporary dealer
20
21 license plate or the metal license plate shall be displayed on the
21
22 manufactured home at all times when upon a public roadway; provided,
22
23 a repossession affidavit issued pursuant to Sections 1110 and 1126
23
24 of this title shall be permissible in lieu of a current license

1 plate and decal for the purposes of removing a repossessed
1
2 manufactured home to a secure location. Manufactured homes
2
3 previously registered and subject to ad valorem taxation as provided
3
4 by law shall have a decal affixed at the time ad valorem taxes are
4
5 paid for such manufactured home; provided, for a manufactured home
5
6 permanently affixed to real estate, no decal or license plate shall
6
7 be required to be affixed and the owner thereof shall be given a
7
8 receipt upon payment of ad valorem taxes due on the home. Service
8
9 Oklahoma shall make sufficient plates and decals available to the
9
10 various licensed operators of the state in order for an owner of a
10
11 manufactured home to acquire the plate or decal. A one-dollar fee
11
12 shall be charged for issuance of any plate or decal. The fee shall
12
13 be apportioned each month to the General Revenue Fund of the State
13
14 Treasury.
14
15 F. The decal shall be easily visible for purposes of
15
16 verification by a county assessor that the manufactured home is
16
17 properly assessed for ad valorem taxation. In the first year of
17
18 registration, a decal shall be issued for placement on the license
18
19 plate indicating payment of applicable registration fees and excise
19
20 taxes. A duplicate manufactured home registration decal shall be
20
21 affixed inside the window nearest the front door of the manufactured
21
22 home. In the second and all subsequent years for which the
22
23 manufactured home is subject to ad valorem taxation, an annual decal
23
24 shall be affixed inside the window nearest the front door as

1 evidence of payment of ad valorem taxes. Service Oklahoma shall
1
2 issue decals to the various county treasurers of the state in order
2
3 for a manufactured home owner to obtain such decal each year. Upon
3
4 presentation of a valid ad valorem tax receipt, the manufactured
4
5 home owner shall be issued the annual decal.
5
6 G. Upon the registration of a manufactured home in this state
6
7 for the first time or upon discovery of a manufactured home
7
8 previously registered within this state for which the information
8
9 required by this subsection is not known, Service Oklahoma shall
9
10 obtain:
10
11 1. The name of the owner of the manufactured home;
11
12 2. The serial number or identification number of the
12
13 manufactured home;
13
14 3. A legal description or address of the location for the home;
14
15 4. The actual retail selling price of the manufactured home
15
16 excluding Oklahoma taxes;
16
17 5. The certificate of title number for the home; and
17
18 6. Any other information which Service Oklahoma deems to be
18
19 necessary.
19
20 The application for registration shall also include the school
20
21 district in which the manufactured home is located or is to be
21
22 located. The information shall be entered into a computer data
22
23 system which shall be used by Service Oklahoma to provide
23
24 information to county assessors upon request by the assessor. The

1 assessor may request any information from the system in order to

2 properly assess a manufactured home for ad valorem taxation.

3 SECTION 2. This act shall become effective November 1, 2026.
