7 An Act relating to railroads; creating the Railroad
7 Crossing Transparency and Safety Accountability Act;
8 providing short title; requiring the Rail Programs
8 Division of the Department of Transportation to
9 analyze certain data on annual basis; requiring
9 submission of certain report; directing the public
10 availability of certain report within certain time
10 frame; requiring certain appearance by the Division
11 before certain committees of the Legislature;
11 construing provision; providing for codification; and
12 providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 340 of Title 66, unless there is
17
18 created a duplication in numbering, reads as follows:
18
19 A. This act shall be known and may be cited as the "Railroad
19
20 Crossing Transparency and Safety Accountability Act".
20
21 B. The Rail Programs Division of the Department of
21
22 Transportation shall, on an annual basis, compile, analyze, and
22
23 review statewide railroad-crossing safety data. Such data shall
23
24 include, but not be limited to:

1 1. Collison and incident history at public railroad crossings;

2 2. Train volume, train speed, and operation characteristics;
2
3 3. Vehicular traffic counts and roadway characteristics at
3
4 crossings;
4
5 4. Sight-distance evaluations and engineering safety
5
6 assessments;
6
7 5. Federal hazard index calculations and any related federal
7
8 ranking methodologies; and
8
9 6. Additional criteria used by the Division in determining
9
10 railroad-crossing risk and project priority.

11 C. No later than February 1 annually, the Division shall
11
12 electronically submit to the President Pro Tempore of the Senate,
12
13 the Speaker of the House of Representatives, and the chairs of the
13
14 Senate and House of Representatives transportation committees or
14
15 successor committees a report, to be entitled the "Annual Railroad
15
16 Crossing Safety and Improvement Report". The report shall include,
16
17 at a minimum:

18 1. A complete list of all railroad-crossing improvement
18
19 projects ranked by priority for the upcoming fiscal year;
19
20 2. A detailed explanation of the criteria, formulas, and
20
21 methodologies used to establish priority rankings;
21
22 3. Identification of all crossings determined to be high-risk,
22
23 unsafe, or recommended for urgent corrective action;

1 4. A description of all projects funded or proposed for funding

2 under federal programs, including, but not limited to, Section 130
2
3 funds;

4 5. The status of all ongoing, planned, postponed, or completed
4
5 railroad-crossing improvement projects;
5
6 6. A summary of expenditures made during the preceding fiscal
6
7 year for railroad-crossing improvements, including state, federal,
7
8 and matching funds; and
8
9 7. Any recommendations for statutory, regulatory, or funding
9
10 changes necessary to enhance railroad-crossing safety in this state.

11 D. No later than thirty (30) days after the submission of the
11
12 report required in subsection C of this section, the report shall be
12
13 made publicly available on the website of the Department in a format
13
14 easily accessible to the public, local governments, and other
14
15 interested parties.

16 E. During each regular session of the Legislature, the Rail
16
17 Programs Division shall appear before the Senate and House of
17
18 Representatives transportation committees or successor committees to
18
19 present key findings from the report, provide updates on high-
19
20 priority crossings, respond to legislative inquiries regarding
20
21 prioritization criteria, and discuss ongoing railroad-crossing
21
22 safety initiatives.

23 F. Nothing in this section shall be construed to limit the
23
24 authority of the Department of Transportation to administer federal

1 railroad safety programs or to coordinate with railroad companies,

2 local governments, and federal agencies on matters relating to
2
3 railroad-crossing safety.

4 SECTION 2. This act shall become effective November 1, 2026.
