7 An Act relating to the Corporation Commission;
7 defining terms; requiring implementation of certain
8 standards; providing for codification; and providing
8 an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 801.50 of Title 17, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. As used in this section:
15
16 1. "Affordable" means the lowest cost method of providing
16
17 electricity, factoring in the true and total cost of each generation
17
18 source including, but not limited to, potential foreign and domestic
18
19 supply chain disruptions, environmental degradation, environmental
19
20 remediation and excluding any direct or indirect payment by any
20
21 level of government in the past five (5) years;

22 2. "Dispatchable" means a source that is readily available for
22
23 use on demand and the output of which can be deployed upon request

1 of a power grid operator or adjusted according to market needs,

2 except during routine maintenance or repairs;

3 3. "Green energy" means any energy generated by utilizing those
3
4 energy sources listened in 42 U.S.C., Section 15852(b) or, in the
4
5 case of hydrocarbons, when combusted for the purpose of electricity
5
6 generation, meet the National Ambient Air Quality Standards set by
6
7 the United States Environmental Protection Agency and includes
7
8 energy generated by nuclear reactors or natural gas;
8
9 4. "Reliable" means a source of electricity that is not subject
9
10 to intermittent availability or routine expected daily weather and
10
11 has a performance standard of eighty percent (80%) or greater and
11
12 only falls below such level during routine maintenance or repairs;

14 5. "Foreign adversary nation" means any country that is
14
15 designated by the federal government as a foreign adversary or
15
16 country of concern, including any country that is:
16
17 a. designated as a foreign adversary under 15 C.F.R.,
17
18 Section 7.4 or successor regulations,
18
19 b. designated as a state sponsor of terrorism by the
19
20 United States Department of State,
20
21 c. subject to comprehensive federal sanctions
21
22 administered by the Office of Foreign Assets Control,
22
23 and

1 d. otherwise determined by the Governor, in consultation
1
2 with the Attorney General, to pose a national
2
3 security, economic security, or supply chain risk to
3
4 the United States. The term includes any entity that
4
5 is owned, controlled by, or subject to the
5
6 jurisdiction or direction of a foreign adversary
6
7 nation, including state-owned enterprises,
7
8 instrumentalities, or companies operating under
8
9 compulsory national laws.

10 B. The Corporation Commission shall implement standards to
10
11 prioritize affordable, reliable, and clean energy security within
11
12 this state by:
12
13 1. Ensuring that this state prioritizes fuel sources primarily
13
14 produced within the United States, with the exception of nuclear
14
15 resources and generation;
15
16 2. Prohibiting the use of critical materials as defined by the
16
17 federal Energy Act of 2020 that are sourced or manufactured by or in
17
18 a foreign adversary nation or subject to the provisions of 19
18
19 U.S.C., Section 1307;
19
20 3. Prioritizing infrastructure and components built in this
20
21 state and the United States that are necessary to deliver energy to
21
22 customers of this state; and
22
23 4. Ensuring a sufficient supply of green energy sources that is
23
24 dispatchable to meet the demands of residential and commercial

1 customers at all times with minimal interruptions even during high

2 usage periods.

3 SECTION 2. This act shall become effective November 1, 2026.
