7 An Act relating to the Corporation Commission;
7 defining terms; directing Commission to enact certain
8 requisition; specifying terms of requisition;
8 providing for preference of certain acquisition;
9 prescribing contents of study; directing publishing
9 and transmission of study by certain date; making an
10 appropriation; stating purpose; providing for
10 codification; and declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 803 of Title 17, unless there is
15
16 created a duplication in numbering, reads as follows:
16
17 A. 1. Not later than thirty (30) days after the effective date
17
18 of this act, the Corporation Commission shall submit a requisition
18
19 pursuant to Section 85.1 et seq. of Title 74 of the Oklahoma
19
20 Statutes to contract with an outside consulting firm to conduct a
20
21 technical and legal feasibility study on nuclear energy generation
21
22 in this state.
22
23 2. The submitted requisition shall require the contract be
23
24 awarded to an outside consulting firm that has:

1 a. professional experience consulting on nuclear energy

2 projects,
2
3 b. a significant portion of its revenue earned from
3
4 nuclear energy project licensing, and
4
5 c. experience in submitting and obtaining regulatory
5
6 permissions for new reactor designs and licenses under
6
7 10 C.F.R., Part 52.

8 3. If the price, fitness, availability, and quality are
8
9 otherwise equal, acquisition preference shall be given to consulting
9
10 firms that have at least forty percent (40%) of their assets owned
10
11 by one or more military veterans and are managed by military
11
12 veterans as defined by 38 U.S.C., Section 101(2).
12
13 B. The feasibility study shall evaluate and consider:
13
14 1. Advantages and disadvantages of generating nuclear energy in
14
15 this state, including, but not limited to, the economic and
15
16 environmental impacts;
16
17 2. Methods to maximize existing workforce and products made in
17
18 this state for the construction of nuclear energy generation
18
19 facilities;
19
20 3. Design characteristics, including recommendations for design
20
21 specification and site selection;
21
22 4. Environmental and ecological impacts;
22
23 5. Land and siting criteria, including specific geographic
23
24 areas that are best suited for new nuclear generation;

1 6. Safety criteria;

2 7. Engineering and cost-related information;

3 8. Small modular nuclear reactor and microreactors capability;

4 and
4
5 9. Socioeconomic factors, including, but not limited to:

6 a. workforce education, training, and development,

7 b. local and state tax base,
7
8 c. supply chain capability,
8
9 d. permanent and temporary job creation,
9
10 e. timeline for development, including areas of potential
10
11 efficiencies, and potential leveraging of existing
11
12 facilities within this state,
12
13 f. benefits that may be gained by coordinating with other
13
14 clean energy technologies, including, but not limited
14
15 to, hydrogen, direct air capture of carbon dioxide,
15
16 and energy storage,
16
17 g. literature review of studies that have assessed the
17
18 potential impact of nuclear energy generation in
18
19 supporting an energy transition, and
19
20 h. policy recommendations to support nuclear energy
20
21 generation, including a survey of federal programs to
21
22 financially assist the development of a nuclear
22
23 project in this state.

1 C. The Corporation Commission in conjunction with retail
1
2 electric suppliers and municipally owned electric utilities shall
2
3 cooperate in providing information relevant to the feasibility
3
4 study, providing for reasonable safeguards to protect confidential
4
5 information.
5
6 D. Not later than nine (9) months after the effective date of
6
7 this act, the Corporation Commission shall electronically deliver
7
8 the feasibility study findings to the President Pro Tempore of the
8
9 Senate, the Speaker of the House of Representatives, and the
9
10 Governor.

11 SECTION 2. There is hereby appropriated to the Corporation
11
12 Commission from any monies not otherwise appropriated from the
12
13 General Revenue Fund of the State Treasury for the fiscal year
13
14 ending June 30, 2024, the sum of Three Hundred Seventy-five Thousand
14
15 Dollars ($375,000.00) or so much thereof as may be necessary to
15
16 perform the feasibility study as provided for in Section 1 of this
16
17 act.

18 SECTION 3. It being immediately necessary for the preservation
18
19 of the public peace, health or safety, an emergency is hereby
19
20 declared to exist, by reason whereof this act shall take effect and
20
21 be in full force from and after its passage and approval.
