7 An Act relating to the Supplemental Nutrition
7 Assistance Program (SNAP); directing the Department
8 of Human Services to seek certain federal waiver;
8 requiring resubmission of waiver request under
9 certain conditions; describing waiver; specifying
9 implementation deadline; requiring submission of
10 certain annual report; providing for codification;
10 and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 241.5 of Title 56, unless there
15
16 is created a duplication in numbering, reads as follows:
16
17 A. The Department of Human Services shall, on or before the
17
18 effective date of this act, submit a request for a federal waiver to
18
19 the United States Department of Agriculture Food and Nutrition
19
20 Service to seek authorization to impose restrictions on the foods
20
21 eligible for purchase with Supplemental Nutrition Assistance Program
21
22 (SNAP) benefits that are designed to improve the nutritional content
22
23 of SNAP-eligible foods and maximize program efficiency including,
23
24 but not limited to, restrictions based on food type, brand, volume,

1 and nutritional content. The Department may use guidelines of the
1
2 Special Supplemental Nutrition Program for Women, Infants, and
2
3 Children (WIC) in establishing the restrictions described in this
3
4 subsection. If the waiver request is denied, the Department shall
4
5 modify and resubmit the waiver request within sixty (60) days of
5
6 denial. The Department shall continue modifications and submissions
6
7 until the waiver request is approved.

8 B. The waiver request shall include:

9 1. A justification citing:
9
10 a. public health concerns,
10
11 b. SNAP's statutory intent, and
11
12 c. cost savings to taxpayers;
12
13 2. An implementation plan ensuring that existing point-of-sale
13
14 systems used by retailers in this state have the ability to properly
14
15 enforce the restriction;
15
16 3. A strategy for education and outreach informing SNAP
16
17 recipients of alternative healthy food options; and
17
18 4. A reporting mechanism to track the impact of the waiver,
18
19 including spending patterns and health outcomes.

20 C. If the waiver is approved, the Department shall implement
20
21 the restriction within six (6) months of receiving federal
21
22 authorization.

1 D. The Department shall electronically submit an annual report
1
2 to the President Pro Tempore of the Senate, the Speaker of the House
2
3 of Representatives, and the Governor that includes:
3
4 1. The status of the waiver request;
4
5 2. Data on SNAP spending patterns in this state; and
5
6 3. Any identified challenges or recommendations for further
6
7 policy action.

8 SECTION 2. This act shall become effective September 1, 2026.
