7 An Act relating to the State Department of Education;
7 directing the Department to establish and maintain
8 the Oklahoma High Dosage Tutoring Program; defining
8 terms; providing for assessment of participating
9 students; requiring electronic reporting of
9 assessment results; directing priority for
10 participation to be given to certain school
10 districts; directing certain high dosage tutors to be
11 awarded certain bonus amounts based on certain
11 criteria; providing for conditional participation for
12 a high dosage tutor who fails to achieve certain
12 growth in certain cohort; providing for loss of
13 program eligibility; requiring certain written
13 consent for students to participate; allowing for
14 removal of students from participation under certain
14 circumstances; providing for promulgation of rules;
15 creating the High Dosage Tutoring Revolving Fund;
15 specifying sources of fund; providing for
16 expenditures; providing purpose of fund; providing
16 for codification; providing an effective date; and
17 declaring an emergency.

20 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

21 SECTION 1. NEW LAW A new section of law to be codified
21
22 in the Oklahoma Statutes as Section 1210.508J of Title 70, unless
22
23 there is created a duplication in numbering, reads as follows:

1 A. The State Department of Education shall establish and

2 maintain the Oklahoma High Dosage Tutoring Program to provide
2
3 tutoring in the subject of reading to students in grades
3
4 prekindergarten through three.
4
5 B. For the purposes of this section:
5
6 1. "Cohort" means a student or group of students of no more
6
7 than five who receive subject-specific high dosage tutoring in
7
8 reading and are at least one-half grade level behind in reading
8
9 prior to participating in the Oklahoma High Dosage Tutoring Program;
9
10 and
10
11 2. "High dosage tutoring" means in-person, subject-specific
11
12 tutoring conducted by an individual employed by or contracted with a
12
13 school district participating in the Oklahoma High Dosage Tutoring
13
14 Program after school hours for a minimum of three one-hour sessions
14
15 per week per cohort. Tutoring shall be conducted during a minimum
15
16 of ten (10) weeks in the fall semester and a minimum of twelve (12)
16
17 weeks in the spring semester.

18 C. 1. Participating school districts shall assess
18
19 prekindergarten through third grade students participating in high
19
20 dosage reading tutoring using the screening instrument required by
20
21 Section 1210.508C of Title 70 of the Oklahoma Statutes to track
21
22 academic growth.

23 2. Results of screening instruments administered pursuant to
23
24 this subsection shall be electronically reported to the State

1 Department of Education three times a year at intervals determined
1
2 by the Department.

3 D. The State Department of Education shall give priority for
3
4 participation in the Oklahoma High Dosage Tutoring Program to school
4
5 districts federally designated for additional targeted support and
5
6 improvement or comprehensive support and improvement under the
6
7 Elementary and Secondary Education Act of 1965 as reauthorized by
7
8 P.L. No. 114-95, also known as the Every Student Succeeds Act.
8
9 Participation in the program shall be approved on a first-come,
9
10 first-served basis without any limitation other than the amount of
10
11 funds available for the program and the number of school districts
11
12 that apply.

13 E. High dosage tutors employed by or contracted with public
13
14 school districts participating in the Oklahoma High Dosage Tutoring
14
15 Program shall be awarded bonuses in the following amounts:
15
16 1. One Thousand Six Hundred Dollars ($1,600.00) for each cohort
16
17 educated by a high dosage tutor per semester; and
17
18 2. One Thousand Dollars ($1,000.00) for each academic grade
18
19 level increase in reading that each student within a cohort
19
20 experiences within one academic year.
20
21 F. 1. If the students in a high dosage tutor's cohort do not
21
22 improve by at least half a grade level in reading within the first
22
23 year of the program, the tutor shall be placed on a conditional one-
23
24 year term of participation.

1 2. If the students in a high dosage tutor's cohort fail to

2 achieve half a grade level of growth during the one-year conditional
2
3 term of participation, he or she shall lose eligibility to
3
4 participate in the program. A tutor who loses eligibility pursuant
4
5 to this paragraph may be reconsidered as a high dosage tutor after
5
6 two years.

7 3. If the students in a high dosage tutor's cohort achieve half
7
8 a grade level of growth during the one-year conditional term of
8
9 participation, the tutor's conditional status shall be lifted.
9
10 G. High dosage tutors shall be provided the necessary
10
11 information for each student's academic performance level in
11
12 reading, as determined by the student's current teacher.
12
13 H. 1. School districts participating in the Oklahoma High
13
14 Dosage Tutoring Program shall obtain written consent from a
14
15 student's parent or legal guardian prior to allowing the student to
15
16 participate in high dosage tutoring.
16
17 2. If a student participating in high dosage tutoring fails to
17
18 attend a tutoring session, the tutor shall notify the student's
18
19 school district, and the school district shall notify the student's
19
20 parent or legal guardian.

21 3. If the parent or legal guardian of a student participating
21
22 in high dosage tutoring no longer wishes for the student to
22
23 participate, a student fails to attend nine high dosage tutoring
23
24 sessions during a semester, or a student's behavior during tutoring

1 sessions requires disciplinary action, the student may be removed
1
2 from the cohort. The performance of a student subject to the
2
3 provisions of this paragraph shall not count against the high dosage
3
4 tutor.

5 I. The State Board of Education shall promulgate rules to
5
6 implement the provisions of this section.
6
7 SECTION 2. NEW LAW A new section of law to be codified
7
8 in the Oklahoma Statutes as Section 1210.508K of Title 70, unless
8
9 there is created a duplication in numbering, reads as follows:

10 There is hereby created in the State Treasury a revolving fund
10
11 for the State Department of Education to be designated the "High
11
12 Dosage Tutoring Revolving Fund". The fund shall be a continuing
12
13 fund, not subject to fiscal year limitations, and shall consist of
13
14 all monies received by the State Department of Education from gifts,
14
15 grants, donations, bequests, federal funds provided for the purpose
15
16 of funding high dosage tutoring, or state appropriations provided
16
17 for the purpose of implementing the provisions of Section 1 of this
17
18 act. All monies accruing to the credit of the fund are hereby
18
19 appropriated and may be budgeted and expended by the State
19
20 Department of Education for the purpose provided for in this
20
21 section. Expenditures from the fund shall be made upon warrants
21
22 issued by the State Treasurer against claims filed as prescribed by
22
23 law with the Director of the Office of Management and Enterprise
23
24 Services for approval and payment.

1 SECTION 3. This act shall become effective July 1, 2026.

2 SECTION 4. It being immediately necessary for the preservation
2
3 of the public peace, health, or safety, an emergency is hereby
3
4 declared to exist, by reason whereof this act shall take effect and
4
5 be in full force from and after its passage and approval.
