7   An Act relating to probate procedure; amending 58

7   O.S. 2021, Section 162, which relates to appointment

8   of agents by nonresident representatives; modifying

8   residency requirement; updating statutory language;

9   making language gender neutral; and providing an

9   effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  58 O.S. 2021, Section 162, is

13

14 amended to read as follows:
14

15  Section 162. Every executor, administrator, or guardian

15

16 appointed in, but residing out of, the state, shall, before entering
16

17 upon the duties of his or her trust, in writing, appoint an agent
17

18 residing in the county where he is appointed this state, and shall
18

19 by such writing stipulate and agree that the service of any legal
19

20 process against him or her as such executor, administrator, or
20

21 guardian if made on said the agent shall be of the same legal effect
21

22 as if made on himself or herself personally within the state. Such
22

23 writing shall give the proper address of such the agent and shall be
23

1 filed in the office of the judge of the district court where such

2 the appointment is made.

3   SECTION 2. This act shall become effective November 1, 2026.
