7 An Act relating to tourism; amending 53 O.S. 2021,
7 Section 355, which relates to the State Register of
8 Historic Places; requiring legislative approval for
8 certain designation; amending 74 O.S. 2021, Section
9 2282, which relates to establishment of state trails
9 on federal lands; requiring legislative approval for
10 certain designation; prohibiting certain funds from
10 being expended until legislative approval; updating
11 statutory references; updating statutory language;
11 and providing an effective date.

1 4 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 53 O.S. 2021, Section 355, is
15
1 6 amended to read as follows:
16
17 Section 355. A. There is hereby created a "State Register of
17
1 8 Historic Places".
18
19 B. The State Historic Preservation Officer, in consultation
19
2 0 with the Oklahoma Historic Preservation Review Committee, shall
20
2 1 establish a listing of sites, districts, structures, buildings,
21
2 2 areas, or objects above or below the surface of the earth whether on
22
2 3 land or in the waters of the state, together with any designated
23
2 4 improvements thereon, significant in the history, architecture,

1 archeology, or culture of the state, its communities, or the nation.

2 Such listing shall constitute the Oklahoma State Register of
2
3 Historic Places. All historic places within the state listed on or
3
4 nominated to the National Register of Historic Places before or
4
5 after this act becomes law the effective date of this act shall be
5
6 deemed to be listed in the State Register. All historic places
6
7 within this state nominated to the National Register of Historic
7
8 Places after the effective date of this act shall require the
8
9 approval of the Legislature prior to designation on the State
9
1 0 Register.

11 C. The State Historic Preservation Officer, with the advice of
11
1 2 the Review Committee, shall establish the procedures and the
12
1 3 criteria for listing in the State Register.
13
14 D. Listing a privately owned property in the State Register
14
1 5 shall in no way violate or abridge the lawful owner's right to use,
15
1 6 modify, or dispose of said such property.

17 SECTION 2. AMENDATORY 74 O.S. 2021, Section 2282, is
17
1 8 amended to read as follows:
18
19 Section 2282. A. The On or after the effective date of this
19
2 0 act, the Oklahoma Tourism and Recreation Commission may shall not
20
2 1 establish and or designate state trails on lands under the
21
2 2 jurisdiction of a federal agency when, in the opinion of the federal
22
2 3 agency, such lands may be so developed under the provisions of
23

1 federal law pursuant to 54 U.S.C., Section 300101 et seq. without
1
2 the prior approval of the Legislature.

3 B. Nothing in the Oklahoma Trails System Act shall prevent a
3
4 segment of the state trails system from being a part of the National
4
5 Scenic or Recreation Trails System. The Commission shall coordinate
5
6 the state trails system with the National Trails System and will
6
7 encourage and assist any federal studies for inclusion of state
7
8 trails into the National Trails System No funds shall be expended or
8
9 transferred from the state or a political subdivision towards any
9
1 0 state trails designated pursuant to subsection A of this section
10
1 1 without the prior approval of the Legislature.

12 SECTION 3. This act shall become effective November 1, 2026.
