8 An Act relating to firearms; amending 21 O.S. 2021,
8 Section 1272, which relates to unlawful carry;
9 authorizing certain transport of firearm on water
9 vessel; defining term; updating statutory language;
10 and providing an effective date.

1 4 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14
15 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1272, is
15
1 6 amended to read as follows:
16
17 Section 1272.

18 UNLAWFUL CARRY
18
19 A. Notwithstanding any other provision of law, it shall be
19
2 0 unlawful for any person to carry upon or about his or her person, or
20
2 1 in a purse or other container belonging to the person, any pistol,
21
2 2 revolver, shotgun, or rifle, whether loaded or unloaded, or any
22
2 3 blackjack, loaded cane, hand chain, metal knuckles, or any other
23

1 offensive weapon, whether such weapon be concealed or unconcealed,
1
2 except this section shall not prohibit:
2
3 1. The proper use of guns and knives for self-defense, hunting,
3
4 fishing, or educational or recreational purposes;
4
5 2. The carrying or use of weapons in a manner otherwise
5
6 permitted by statute or authorized by the Oklahoma Self-Defense Act;
6
7 3. The carrying, possession, and use of any weapon by a peace
7
8 officer or other person authorized by law to carry a weapon in the
8
9 performance of official duties and in compliance with the rules of
9
1 0 the employing agency;
10
11 4. The carrying or use of weapons in a courthouse by a district
11
1 2 judge, associate district judge, or special district judge within
12
1 3 this state, who is in possession of a valid handgun license issued
13
1 4 pursuant to the provisions of the Oklahoma Self-Defense Act and
14
1 5 whose name appears on a list maintained by the Administrative
15
1 6 Director of the Courts;
16
17 5. The carrying and use of firearms and other weapons provided
17
1 8 in this subsection when used for the purpose of living history
18
1 9 reenactment. For purposes of this paragraph, "living history
19
2 0 reenactment" means depiction of historical characters, scenes,
20
2 1 historical life, or events for entertainment, education, or
21
2 2 historical documentation through the wearing or use of period,
22
2 3 historical, antique, or vintage clothing, accessories, firearms,
23
2 4 weapons, and other implements of the historical period; or

1 6. The transporting by vehicle on a public roadway or by vessel
1
2 on the waters of this state or the carrying of a firearm, concealed
2
3 or unconcealed, loaded or unloaded, by a person who is twenty-one
3
4 (21) years of age or older or by a person who is eighteen (18) years
4
5 of age but not yet twenty-one (21) years of age and the person is a
5
6 member or veteran of the United States Armed Forces, Reserves, or
6
7 National Guard or was discharged under honorable conditions from the
7
8 United States Armed Forces, Reserves, or National Guard, and the
8
9 person is otherwise not disqualified from the possession or purchase
9
1 0 of a firearm under state or federal law and is not carrying the
10
1 1 firearm in furtherance of a crime. For purposes of this paragraph,
11
1 2 "vessel" means any device, other than a seaplane on the water, used
12
1 3 or capable of being used as a means of transportation on water.
13
14 Except as provided in subsection B of Section 1283 of this
14
1 5 title, a person who has been convicted of any one of the following
15
1 6 offenses in this state or a violation of the equivalent law of
16
1 7 another state:
17
18 a. assault and battery pursuant to the provisions of
18
19 Section 644 of this title which caused serious
19
20 physical injury to the victim,
20
21 b. aggravated assault and battery pursuant to the
21
22 provisions of Section 646 of this title,
22
23 c. assault and battery that qualifies as domestic abuse
23
24 as defined in Section 644 of this title,

1 d. stalking pursuant to the provisions of Section 1173 of
1
2 this title,
2
3 e. a violation of an order issued under the Protection
3
4 from Domestic Abuse Act or a domestic abuse protection
4
5 order issued by another state, or
5
6 f. a violation relating to illegal drug use or possession
6
7 under the provisions of the Uniform Controlled
7
8 Dangerous Substances Act,
8
9 shall be prohibited from carrying a firearm under the provisions of
9
1 0 this paragraph. Any person who carries a firearm in the manner
10
1 1 provided for in this paragraph shall be prohibited from carrying the
11
1 2 firearm into any of the places prohibited in subsection A of Section
12
1 3 1277 of this title or any other place currently prohibited by law.
13
1 4 Nothing in this section shall modify or otherwise change where a
14
1 5 person may legally carry a firearm.
15
16 B. Any person convicted of violating the foregoing provision
16
1 7 subsection A of this section shall, upon conviction, be guilty of a
17
1 8 misdemeanor punishable as provided in Section 1276 of this title.
18
19 SECTION 2. This act shall become effective November 1, 2026.
