9 2025, Sections 6-105 and 6-110), which relate to
9 driver licenses; allowing certain persons to apply
10 for certain permit; requiring Service Oklahoma to
10 enter into certain agreements; updating statutory
11 language; updating statutory references; and
11 providing an effective date.

1 4 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14
15 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6-105, as
15
1 6 last amended by Section 38, Chapter 452, O.S.L. 2024 (47 O.S. Supp.
16
1 7 2025, Section 6-105), is amended to read as follows:
17
18 Section 6-105. A. Unless a legal custodial parent or legal
18
1 9 guardian has filed an objection to licensure pursuant to Section 6-
19
2 0 103.1 of this title, any person under eighteen (18) years of age may
20
2 1 be permitted to operate:
21
22 1. A Class D motor vehicle under the graduated driver license
22
2 3 provisions prescribed in subsections B through E of this section;
23

1 2. A motorcycle under the provisions prescribed in subsection H
1
2 of this section; or
2
3 3. A farm vehicle under the provisions prescribed in subsection
3
4 I of this section.

5 B. Any person who is at least fifteen (15) years of age may
5
6 drive during a session in which the driver is being instructed in a
6
7 driver education course, as set out in subparagraphs a, b, c, d and
7
8 e of paragraph 1 of subsection C of this section, by a certified
8
9 driver education instructor who is seated in the right front seat of
9
1 0 the motor vehicle.
10
11 C. Any person:
11
12 1. Who is at least fifteen and one-half (15 1/2) years of age
12
1 3 and is currently receiving instruction in or has successfully
13
1 4 completed driver education. For purposes of this section, the term
14
1 5 "driver education" shall mean:
15
16 a. a prescribed secondary school driver education course,
16
17 as provided for in Sections 19-113 through 19-121 of
17
18 Title 70 of the Oklahoma Statutes,
18
19 b. a driver education course, certified by Service
19
20 Oklahoma, from a parochial, private, or other
20
21 nonpublic secondary school,
21
22 c. a commercial driver training course, as defined by
22
23 Sections 801 through 808 of this title,
23

1 d. a parent-taught driver education course, certified by
1
2 Service Oklahoma, in conjunction with the Department
2
3 of Public Safety. Service Oklahoma shall promulgate
3
4 rules for any parent-taught driver education course,
4
5 or
5
6 e. a driver education course certified by a state other
6
7 than Oklahoma; or
7
8 2. Who is at least sixteen (16) years of age,
8
9 may, upon successfully passing all parts of the driver license
9
1 0 examination administered by Service Oklahoma, or an approved written
10
1 1 examination proctor, except the driving examination, be issued a
11
1 2 learner permit which will grant the permittee the privilege to
12
1 3 operate a Class D motor vehicle upon the public highways only
13
1 4 between the hours of 5:00 a.m. and 10:00 p.m. and while accompanied
14
1 5 by a licensed driver who is at least twenty-one (21) years of age
15
1 6 and who is actually occupying a seat beside the permittee; provided,
16
1 7 the written examination for a learner permit may be waived by
17
1 8 Service Oklahoma upon verification that the person has successfully
18
1 9 completed driver education.
19
20 D. 1. Any person:
20
21 a. who has applied for, been issued, and has possessed a
21
22 learner permit for a minimum of one hundred eighty
22
23 (180) days,

1 b. whose custodial legal parent or legal guardian
1
2 certifies to Service Oklahoma by sworn affidavit that
2
3 the person has received a minimum of fifty (50) hours
3
4 of actual behind-the-wheel training, of which at least
4
5 ten (10) hours of such training was at night, from a
5
6 licensed driver who was at least twenty-one (21) years
6
7 of age and who was properly licensed to operate a
7
8 Class D motor vehicle for a minimum of two (2) years,
8
9 and
9
10 c. who has completed a free course approved by the
10
11 Oklahoma Department of Transportation on teen driver
11
12 work zone and first responder safety,
12
1 3 may be issued an intermediate Class D license upon successfully
13
1 4 passing all parts of the driver license examinations administered by
14
1 5 Service Oklahoma; provided, the written examination, if it has not
15
1 6 previously been administered or waived, may be waived by Service
16
1 7 Oklahoma upon verification that the person has successfully
17
1 8 completed driver education or the driving examination may be waived
18
1 9 by Service Oklahoma upon successful passage of the examination
19
2 0 administered by a certified designated examiner, as provided for in
20
2 1 Section 6-110 of this title. However, notwithstanding the date of
21
2 2 issuance of the learner permit, if the person has been convicted of
22
2 3 a traffic offense which is reported on the driving record of that
23
2 4 person, the time period specified in subparagraph a of this
24

1 paragraph shall be recalculated to begin from the date of conviction
1
2 for the traffic offense, and must shall elapse before that person
2
3 may be issued an intermediate Class D license. If the person has
3
4 been convicted of more than one traffic offense which is reported on
4
5 the driving record of that person, the time period specified in
5
6 subparagraph a of this paragraph shall be recalculated to begin from
6
7 the most recent date of conviction, and must shall elapse before
7
8 that person may be issued an intermediate Class D license.
8
9 2. A person who has been issued an intermediate Class D license
9
1 0 under the provisions of this subsection:
10
11 a. shall be granted the privilege to operate a Class D
11
12 motor vehicle upon the public highways:
12
13 (1) only between the hours of 5:00 a.m. and 10:00
13
14 p.m., except for driving to and from work,
14
15 school, school activities, and church activities,
15
16 or
16
17 (2) at any time, if a licensed driver who is at least
17
18 twenty-one (21) years of age is actually
18
19 occupying a seat beside the intermediate Class D
19
20 licensee, or if the intermediate Class D licensee
20
21 is a farm or ranch resident, and is operating a
21
22 motor vehicle while engaged in farming or
22
23 ranching operations outside the limits of a
23
24 municipality, or driving to and from work,

1 school, school activities, or church activities,
1
2 and
2
3 b. shall not operate a motor vehicle with more than one
3
4 passenger unless:
4
5 (1) all passengers live in the same household as the
5
6 custodial legal parent or legal guardian, or
6
7 (2) a licensed driver at least twenty-one (21) years
7
8 of age is actually occupying a seat beside the
8
9 intermediate Class D licensee.
9
10 E. Any person who has been issued an intermediate Class D
10
1 1 license for a minimum of:
11
12 1. One (1) year; or
12
13 2. One hundred eighty (180) days, if the person has completed
13
1 4 both the driver education and the parent-certified behind-the-wheel
14
1 5 training provisions of subparagraph b of paragraph 1 of subsection D
15
1 6 of this section,
16
1 7 may be issued a Class D license. However, notwithstanding the date
17
1 8 of issuance of the Class D license, if the person has been convicted
18
1 9 of a traffic offense which is reported on the driving record of that
19
2 0 person, the time periods specified in paragraph 1 or 2 of this
20
2 1 subsection, as applicable, shall be recalculated to begin from the
21
2 2 date of conviction for the traffic offense, and must shall elapse
22
2 3 before that person may be issued a Class D license. If the person
23
2 4 has been convicted of more than one traffic offense which is

1 reported on the driving record of that person, the time periods
1
2 specified in paragraph 1 or 2 of this subsection, as applicable,
2
3 shall be recalculated to begin from the most recent date of
3
4 conviction, and must shall elapse before that person may be issued a
4
5 Class D license.
5
6 F. Learner permits and intermediate Class D licenses shall be
6
7 issued for the same period as all other driver licenses. The
7
8 licenses may be suspended or canceled at the discretion of the
8
9 Department of Public Safety, with notice to Service Oklahoma for
9
1 0 violation of restrictions, for failing to give the required or
10
1 1 correct information on the application, for knowingly giving false
11
1 2 or inaccurate information on the application or any subsequent
12
1 3 documentation related to the granting of driving privileges, for
13
1 4 using a hand-held handheld electronic device while operating a motor
14
1 5 vehicle for non-life-threatening emergency purposes or for violation
15
1 6 of any traffic laws of this state pertaining to the operation of a
16
1 7 motor vehicle.
17
18 G. Service Oklahoma shall promulgate rules establishing
18
1 9 procedures for removal of learner permit and intermediate Class D
19
2 0 license restrictions from the permit or license upon the permittee
20
2 1 or licensee qualifying for a less restricted or an unrestricted
21
2 2 license.
22
23 H. Any person fourteen (14) years of age or older may apply for
23
2 4 a restricted Class D license with a motorcycle-only restriction.

1 After the person has successfully passed all parts of the motorcycle
1
2 examination other than the driving examination, has successfully
2
3 completed a certified state-approved motorcycle basic rider course
3
4 approved by the Department of Public Safety, in conjunction with
4
5 Service Oklahoma, and has met all requirements provided for in the
5
6 rules of the Department and Service Oklahoma, Service Oklahoma shall
6
7 issue to the person a restricted Class D license with a motorcycle-
7
8 only restriction which shall grant to the person, while having the
8
9 license in the person's immediate possession, the privilege to
9
1 0 operate a motorcycle or motor-driven cycle:
10
11 1. With a piston displacement not to exceed three hundred cubic
11
1 2 centimeters (300 cc) or a sixteen and eight-tenths (16.8) kilowatt
12
1 3 electric power source;
13
14 2. Between the hours of 4:30 a.m. to 9:00 p.m. only;
14
15 3. While wearing approved protective headgear; and
15
16 4. While accompanied by and receiving instruction from any
16
1 7 person who is at least twenty-one (21) years of age and who is
17
1 8 properly licensed pursuant to the laws of this state to operate a
18
1 9 motorcycle or motor-driven cycle, and who has visual contact with
19
2 0 the restricted licensee.
20
21 The restricted licensee may apply on or after thirty (30) days
21
2 2 from date of issuance of the restricted Class D license with a
22
2 3 motorcycle-only restriction to have the restriction of being
23
24

1 accompanied by a licensed driver removed by successfully completing
1
2 the driving portion of an examination.
2
3 The written examination and driving examination for a restricted
3
4 Class D license with a motorcycle-only endorsement shall be waived
4
5 by Service Oklahoma upon verification that the person has
5
6 successfully completed a certified state-approved motorcycle basic
6
7 rider course approved by the Department and Service Oklahoma.
7
8 I. 1. Any person who is less than seventeen (17) years of age
8
9 but is at least fourteen (14) years of age, or who is less than
9
1 0 sixteen (16) years of age but is at least fourteen (14) years of age
10
1 1 and is currently receiving instruction in or has completed driver
11
1 2 education as defined in subsection C of this section, and who
12
1 3 resides upon a farm in this state or is employed for compensation
13
1 4 upon a farm in this state may apply to Service Oklahoma for a farm
14
1 5 permit authorizing such person, while possessing the permit, to
15
1 6 operate any Class D motor vehicle.
16
17 2. a. A farm permit shall entitle the licensee, who is at
17
18 least fourteen (14) years of age but less than sixteen
18
19 (16) years of age, to operate the appropriate motor
19
20 vehicles at any time:
20
21 (1) while going to or from or in connection with any
21
22 farm job, employment, or other farm-related work,
22
23 (2) on days while school is in session, over the most
23
24 direct and accessible route between the

1 licensee's residence and school of enrollment for
1
2 the purpose of school attendance; provided, that
2
3 the privilege shall only extend to those
3
4 licensees who reside on a farm and commute
4
5 directly from their place of residence to the
5
6 school in which they are enrolled, or
6
7 (3) when the licensee is operating a passenger car at
7
8 any time when accompanied by an adult who is the
8
9 holder of a valid commercial driver license,
9
10 Class A, B, C, or D driver license and who is
10
11 actually occupying a seat beside the driver.
11
12 b. For a period of six (6) months, a farm permit shall
12
13 entitle the licensee who is at least sixteen (16)
13
14 years of age to operate the appropriate motor vehicles
14
15 at any time:
15
16 (1) from 5:00 a.m. to 9:00 p.m.,
16
17 (2) while going to or from or in connection with any
17
18 farm job, employment, or other farm-related work,
18
19 (3) while going to or from authorized school
19
20 activities,
20
21 (4) while going directly to or from any religious
21
22 worship service held by a religious organization,
22
23 or
23
24

1 (5) while the licensee is operating a passenger car
1
2 at any time while accompanied by an adult who is
2
3 the holder of a valid commercial driver license,
3
4 Class A, B, or C driver license, and who is
4
5 actually occupying a seat beside the driver.
5
6 After such six-month period, if the licensee has complied with the
6
7 provisions of this subsection, such farm permit shall entitle the
7
8 licensee to operate the appropriate motor vehicles at any time
8
9 without the restrictions required by this subsection.
9
10 3. A farm permit shall be issued only if:
10
11 a. the applicant can prove that such applicant resides or
11
12 works on a farm by submitting the signed affidavit of
12
13 either a parent or guardian stating that the applicant
13
14 lives on a farm,
14
15 b. the applicant has successfully completed the
15
16 examination requirements in Section 6-110 of this
16
17 title, and
17
18 c. the applicant does not live on a farm but works on a
18
19 farm and the applicant submits the signed affidavit of
19
20 the applicant's employer and parent or guardian
20
21 attesting to such employment.
21
22 4. Any licensee issued a farm permit under this subsection:
22
23

1 a. who is less than sixteen (16) years of age shall not
1
2 operate any motor vehicle with nonsibling minor
2
3 passengers,
3
4 b. who is at least sixteen (16) years of age, for a
4
5 period of six (6) months after reaching sixteen (16)
5
6 years of age, shall not operate any motor vehicle with
6
7 more than one passenger who is less than eighteen (18)
7
8 years of age and who is not a member of the licensee's
8
9 immediate family, or
9
10 c. who is at least fourteen (14) years of age, but less
10
11 than sixteen (16) years of age, shall not operate any
11
12 motor vehicle on interstate or turnpike highway
12
13 systems, nor shall a licensee operate a motor vehicle
13
14 within the limits of a city with a population in
14
15 excess of one hundred thousand (100,000) persons
15
16 according to the latest Federal Decennial Census.
16
1 7 Any conviction for violating this paragraph shall be construed as a
17
1 8 moving traffic violation. Service Oklahoma may, in its discretion,
18
1 9 suspend the permit of an individual for violation of this paragraph.
19
20 5. Any licensee issued a farm permit under this subsection
20
2 1 shall not operate a wireless communication device while driving a
21
2 2 motor vehicle, except that a licensee may operate a wireless
22
2 3 communication device while driving a motor vehicle to report illegal
23
2 4 activity or to summon medical or other emergency help.

1 6. As used in this subsection, "farm" means any parcel of land
1
2 for which the owner has an agricultural exemption permit issued by
2
3 the Oklahoma Tax Commission.
3
4 7. a. A farm permit issued under this subsection is subject
4
5 to suspension or revocation in the same manner as any
5
6 other driver license.
6
7 b. A farm permit may be suspended in accordance with
7
8 Section 6-113 of this title for any violation of
8
9 restrictions under this subsection.
9
10 c. Service Oklahoma shall suspend the farm permit upon
10
11 receiving satisfactory evidence that the licensee has
11
12 been involved in two or more accidents chargeable to
12
13 the licensee and such suspended license shall not be
13
14 reinstated for one (1) year.
14
15 8. Any licensee issued a farm permit under this subsection
15
1 6 shall provide, prior to reaching sixteen (16) years of age, a signed
16
1 7 affidavit of either a parent or guardian stating that the applicant
17
1 8 has completed at least fifty (50) hours of adult-supervised driving
18
1 9 with at least ten (10) of those hours being at night. The adult-
19
2 0 supervised driving required by this paragraph shall be conducted by
20
2 1 an adult who is at least twenty-one (21) years of age and is the
21
2 2 holder of a valid commercial driver license, Class A, B, C, or D
22
2 3 driver license. Evidence of failure of any licensee who was
23
2 4 required to complete the fifty (50) hours of adult-supervised
24

1 driving under this subsection shall not be admissible in any action
1
2 for the purpose of determining any aspect of comparative negligence
2
3 or mitigation of damages.
3
4 9. Any licensee issued a farm permit under this subsection who:
4
5 a. is under sixteen (16) years of age and is convicted of
5
6 two or more moving traffic violations committed on
6
7 separate occasions shall not be eligible to receive a
7
8 driver license which is not restricted, in accordance
8
9 with the provisions of subparagraph a of paragraph 2
9
10 of this subsection, until the person reaches seventeen
10
11 (17) years of age,
11
12 b. is at least sixteen (16) years of age but less than
12
13 seventeen (17) years of age and is convicted of two or
13
14 more moving traffic violations committed on separate
14
15 occasions shall not be eligible to receive a driver
15
16 license which is not restricted, in accordance with
16
17 the provisions of subparagraph b of paragraph 2 of
17
18 this subsection, until the person reaches eighteen
18
19 (18) years of age, or
19
20 c. fails to provide the affidavit required under
20
21 paragraph 8 of this subsection shall not be eligible
21
22 to receive a driver license which is not restricted,
22
23 in accordance with the provisions of subparagraph a of
23
24 paragraph 2 of this subsection, until the person

1 provides such affidavit to Service Oklahoma or the
1
2 person reaches seventeen (17) years of age, whichever
2
3 occurs first.
3
4 J. As used in this section:
4
5 1. "Hand-held "Handheld electronic device" means a mobile
5
6 telephone or electronic device with which a user engages in a
6
7 telephone call, plays or stores media, including but not limited to
7
8 music and video, or sends or reads a text message while requiring
8
9 the use of at least one hand; and
9
10 2. "Using a hand-held handheld electronic device" means
10
1 1 engaging any function on an electronic device.
11
12 K. All driver education courses provided for in paragraph 1 of
12
1 3 subsection C of this section shall include education regarding the
13
1 4 dangers of texting while driving and the effects of being under the
14
1 5 influence of alcohol or other intoxicating substance while driving.
15
16 SECTION 2. AMENDATORY 47 O.S. 2021, Section 6-110, as
16
1 7 last amended by Section 4, Chapter 450, O.S.L. 2024 (47 O.S. Supp.
17
1 8 2025, Section 6-110), is amended to read as follows:
18
19 Section 6-110. A. 1. Service Oklahoma shall establish
19
2 0 procedures to ensure every applicant for an original Class A, B, C,
20
2 1 or D license and for any endorsements thereon is examined by Service
21
2 2 Oklahoma, or an approved written examination proctor, except as
22
2 3 otherwise provided in Section 6-101 et seq. of this title or as
23
2 4 provided in paragraph 2 of this subsection or in subsections D and E
24

1 of this section. Service Oklahoma is authorized to shall authorize,
1
2 approve, and enter into agreements with third parties including, but
2
3 not limited to, public school districts, technology center districts
3
4 overseen by the Oklahoma Department of Career and Technology
4
5 Education, institutions of higher education, or commercial driver
5
6 training schools, to act as approved written examination proctors
6
7 with regard to any written examination required by this section.
7
8 The examination shall include a test of the applicant's:
8
9 a. eyesight,
9
10 b. ability to read and understand highway signs
10
11 regulating, warning, and directing traffic,
11
12 c. knowledge of the traffic laws of this state including
12
13 a portion on bicycle and motorcycle safety, and
13
14 d. ability, by actual demonstration, to exercise ordinary
14
15 and reasonable control in the operation of a motor
15
16 vehicle. The actual demonstration shall be conducted
16
17 in the type of motor vehicle for the class of driver
17
18 license being applied for.
18
1 9 The Department of Public Safety, in conjunction with Service
19
2 0 Oklahoma, may create a knowledge test that may be taken on the
20
2 1 Internet by an applicant applying for a Class D license.
21
2 2 Any licensee seeking to apply for a driver license of another class
22
2 3 which is not covered by the licensee's current driver license shall
23
2 4 be considered an applicant for an original license for that class.

1 2. Service Oklahoma shall have the authority to waive the
1
2 requirement of any part of the examination required in paragraph 1
2
3 of this subsection for those applicants whose driving record meets
3
4 the standards set by the Department of Public Safety and surrender
4
5 either of the following:
5
6 a. a valid unexpired driver license issued by any state
6
7 or country for the same type or types of vehicles, or
7
8 b. an expired driver license that:
8
9 (1) is not expired more than six (6) months past the
9
10 expiration date listed on the driver license, and
10
11 (2) is not a Class A, B, or C commercial driver
11
12 license or commercial driver license permit.
12
13 3. Service Oklahoma shall accept skills test results from
13
1 4 another state for Class A, B, or C license applicants who have
14
1 5 successfully completed commercial motor vehicle driver training in
15
1 6 that state and successfully passed the skills test in that state;
16
1 7 provided, Service Oklahoma shall not accept skills test results from
17
1 8 another state when the applicant has not successfully completed
18
1 9 commercial motor vehicle driver training in that state. Nothing in
19
2 0 this section shall be construed to prohibit Service Oklahoma from
20
2 1 administering the skills test to any applicant who has successfully
21
2 2 completed commercial vehicle driver training in another state.
22
23 4. All applicants requiring a hazardous materials endorsement
23
2 4 shall be required, for the renewal of the endorsement, to
24

1 successfully complete the examination and to submit to a security
1
2 threat assessment performed by the Transportation Security
2
3 Administration of the Department of Homeland Security as required by
3
4 and pursuant to 49 C.F.R., Part 1572, which shall be used to
4
5 determine whether the applicant is eligible for renewal of the
5
6 endorsement pursuant to federal law and regulation.
6
7 5. Service Oklahoma, or an approved written examination
7
8 proctor, shall give the complete examination as provided for in this
8
9 section within thirty (30) days from the date the application is
9
1 0 received, and the examination shall be given at a location within
10
1 1 one hundred (100) miles of the residence of the applicant. Service
11
1 2 Oklahoma shall make every effort to make the examination locations
12
1 3 and times convenient for applicants. Service Oklahoma shall
13
1 4 consider giving the examination at any public or private site, if
14
1 5 economically feasible and practicable, and if Service Oklahoma and
15
1 6 the owner or the governing body agree.
16
17 B. Any person holding a valid Oklahoma Class D license or
17
1 8 provisional driver license pursuant to Section 6-212 of this title
18
1 9 and applying for a Class A, B or C commercial license shall be
19
2 0 required to successfully complete all examinations as required for
20
2 1 the specified class. Failure to submit to Service Oklahoma
21
2 2 federally required medical certification information pursuant to 49
22
2 3 C.F.R., Part 391.41 et seq. shall result in an automatic downgrade
23
2 4 of a commercial license to a Class D license. Provided, however,
24

1 once the required medical certification information has been
1
2 received by Service Oklahoma, the license shall be reinstated to the
2
3 classification of the commercial license prior to the downgrade and
3
4 the holder of such a license shall not be required to reapply.
4
5 C. Except as provided in subsection E of Section 6-101 of this
5
6 title, any person holding a valid Oklahoma Class A, B or C
6
7 commercial license shall, upon time for renewal thereof, be entitled
7
8 to a Class D license without any type of testing or examination,
8
9 except for any endorsements thereon as otherwise provided for by
9
1 0 Section 6-110.1 of this title.
10
11 D. 1. Any certified driver education instructor who is
11
1 2 currently an operator or an employee of a commercial driver training
12
1 3 school in this state or any driver education instructor employed by
13
1 4 any school district in this state shall be eligible to apply to be a
14
1 5 designated examiner of Service Oklahoma for the purposes of
15
1 6 administering the Class D driving skills portion of the Oklahoma
16
1 7 driving examination to any person who is eligible to take the
17
1 8 Oklahoma driving examination including, but not limited to, a person

1 9 who has been issued a learner permit or farm permit. Service
19
2 0 Oklahoma shall to the maximum extent possible accept electronic
20
2 1 signatures for all applications to be a designated examiner.
21
22 2. The Department of Public Safety, in conjunction with Service
22
2 3 Oklahoma, shall adopt a curriculum of required courses and training
23
2 4 to be offered to applicants who are qualified to apply to be a

1 designated examiner. The courses and training for certification
1
2 shall meet the same standards as required for driver examiners of
2
3 Service Oklahoma. Within thirty (30) days of the effective date of
3
4 this act November 1, 2024, and by October 1 of each subsequent year,
4
5 Service Oklahoma shall publish a schedule for the subsequent
5
6 calendar year of courses and trainings which shall occur no less
6
7 than twice per calendar year. Service Oklahoma may schedule
7
8 additional courses and trainings based on demand. Service Oklahoma
8
9 shall disclose how many slots are available for each course or
9
1 0 training and any restrictions on how those slots may be allocated at
10
1 1 the time of publishing the schedule.
11
12 3. Each person applying to be a designated examiner shall be
12
1 3 required to pay an initial designated examiner certification fee of
13
1 4 One Thousand Dollars ($1,000.00). Upon successful completion of
14
1 5 training prescribed by paragraph 2 of this subsection, the person
15
1 6 shall be required to pay an annual designated examiner certification
16
1 7 fee of Five Hundred Dollars ($500.00). If an applicant for the
17
1 8 designated examiner program is employed by an Oklahoma public school
18
1 9 system that offers driver education, and he or she administers the
19
2 0 skills test only to students enrolled in a public school driver
20
2 1 education program, the certification fee may be waived by Service
21
2 2 Oklahoma. Each designated examiner certification shall expire on
22
2 3 the last day of the calendar year and may be renewed upon
23
2 4 application to Service Oklahoma. The designated examiner

1 certification fees collected by Service Oklahoma pursuant to this
1
2 subsection shall be deposited to the credit of the Department of
2
3 Public Safety Restricted Revolving Fund to be used for the purposes
3
4 of this subsection, through October 31, 2022. Beginning November 1,
4
5 2022, the designated examiner certification fees collected by
5
6 Service Oklahoma pursuant to this subsection shall be deposited to
6
7 the credit of the Service Oklahoma Revolving Fund. No designated
7
8 examiner certification fee shall be refunded in the event that
8
9 certification is denied, suspended, or revoked.
9
10 4. A designated examiner may charge a fee for each Class D
10
1 1 driving skills examination given, whether the person being examined
11
1 2 passes or fails the examination.
12
13 5. Service Oklahoma shall conduct an annual complete nationwide
13
1 4 criminal history background check on each designated examiner and a
14
1 5 complete nationwide criminal history background check on each
15
1 6 designated examiner applicant. The fees for the background check
16
1 7 shall be borne by the designated examiner or designated examiner
17
1 8 applicant.
18
19 6. The Department of Public Safety, in conjunction with Service
19
2 0 Oklahoma, shall promulgate rules to implement and administer the
20
2 1 provisions of this subsection.
21
22 E. 1. Upon application and approval of Service Oklahoma, any
22
2 3 public or private commercial truck driving school that has or
23
2 4 maintains a program instructing students for a Class A, B or C
24

1 license, public transit agency, state, county, or municipal
1
2 government agency in this state, such as local school districts, the
2
3 Oklahoma Department of Career and Technology Education, or
3
4 institutions of higher education, or a private entity, shall be
4
5 authorized to hire or employ designated examiners approved by
5
6 Service Oklahoma to be third-party examiners of the Class A, B, or C
6
7 driving skills portion and/or or knowledge written portion, pursuant
7
8 to subsection A of this section, of the Oklahoma driving
8
9 examination. All designated examiners must successfully have
9
1 0 completed the courses and training as outlined in paragraph 2 of
10
1 1 this subsection. Service Oklahoma shall be required to approve at
11
1 2 least one public transit agency that has or maintains a program
12
1 3 instructing students for a Class A, B, or C license to hire or
13
1 4 employ third-party examiners pursuant to this section. It shall be
14
1 5 permissible for any public transit agency operating in this state to
15
1 6 utilize the third-party examiners hired or employed by a public
16
1 7 transit agency approved by Service Oklahoma.
17
18 2. The Department of Public Safety, in conjunction with Service
18
1 9 Oklahoma, shall adopt a curriculum of required courses and training
19
2 0 to be offered to third-party examiners. The courses and training
20
2 1 for certification shall meet the same standards as required for
21
2 2 commercial driver examiners of Service Oklahoma.
22
23 3. Service Oklahoma shall require each third-party examiner
23
2 4 applicant and commercial school driver education instructor

1 applicant to submit to an electronic national criminal history
1
2 record check pursuant to Section 150.9 of Title 74 of the Oklahoma
2
3 Statutes. On or before December 1, 2022, Service Oklahoma shall
3
4 require each third-party examiner or commercial school driver
4
5 education instructor to submit to an electronic national criminal
5
6 history record check pursuant to Section 150.9 of Title 74 of the
6
7 Oklahoma Statutes. The fees for the background check shall be borne
7
8 by the third-party examiner, third-party examiner applicant,
8
9 commercial school driver education instructor, or commercial school
9
1 0 driver education instructor applicant.
10
11 F. Service Oklahoma shall promulgate rules to:
11
12 1. Implement and administer the provisions of this section
12
1 3 based on requirements set forth in 49 C.F.R., Section 383.75 of
13
1 4 Title 49 of the Code of Federal Regulations;
14
15 2. Establish a process to inform any school, public transit
15
1 6 agency, examiner, or state, county, or municipal government agency,
16
1 7 who has been denied, within forty-five (45) days from the denial;
17
18 3. Create an appeal process for any school, public transit
18
1 9 agency, examiner, or state, county, or municipal government agency
19
2 0 denied; and
20
21 4. If the initial application for approval was denied, limit
21
2 2 the number of times an individual school, public transit agency,
22
2 3 individual examiner applicant, or state, county, or municipal
23
24

1 government agency may reapply in a calendar year to two
1
2 reapplications.

3 SECTION 3. This act shall become effective November 1, 2026.
