7 An Act relating to the Supplemental Nutrition
7 Assistance Program (SNAP); amending 56 O.S. 2021,
8 Section 241.3, which relates to limitation of
8 benefits; modifying applicability of work
9 requirement; modifying certain prohibition on waiver
9 requests; updating statutory language; and declaring
10 an emergency.

1 3 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 56 O.S. 2021, Section 241.3, is
14
1 5 amended to read as follows:
15
16 Section 241.3. A. Except as otherwise provided by law or
16
1 7 waiver, all able-bodied recipients eighteen (18) years of age to
17
1 8 fifty (50) years of age, who are not disabled or raising minor
18
1 9 children, An individual who does not qualify for an exception
19
2 0 provided by 7 U.S.C., Section 2015(o)(3) may receive food stamps
20
2 1 Supplemental Nutrition Assistance Program (SNAP) benefits for only
21
2 2 three (3) months in each thirty-six-month period except in months in
22
2 3 which such recipients are employed for at least twenty (20) or more
23
2 4 hours per week individual meets the work requirement established by
24

1 7 U.S.C., Section 2015(o)(2). The Department of Human Services
1
2 shall enforce the provisions of this section and any approved
2
3 waivers or other provisions pursuant to law in effect for this state
3
4 as of the effective date of this act in designated areas and
4
5 populations 7 U.S.C., Section 2015(o).

6 B. 1. A family household applying for food stamps SNAP
6
7 benefits after the fifteenth (15th) day of each month shall be
7
8 eligible to receive the total amount of their the household's
8
9 initial allotment and their its regular first allotment.
9
10 2. A household allotment of food stamps SNAP benefits may be
10
1 1 reduced by up to twenty-five percent (25%) if a family the household
11
1 2 is sanctioned in another program established pursuant to the
12
1 3 Statewide Temporary Assistance Responsibility System.
13
14 3. An individual in a treatment center shall designate the
14
1 5 treatment center as the recipient of such individual's food stamp
15
1 6 SNAP benefit allotment.
16
17 4. Operating procedures for the food stamp programs SNAP in
17
1 8 local offices may vary to reflect local differences.
18
19 5. The Department is authorized to use the amount of a
19
2 0 household food stamp SNAP benefit allotment to subsidize a job under
20
2 1 a work supplementation or support program.
21
22 C. Beginning October 1, 2013, the The Department of Human
22
2 3 Services shall not request a waiver to provide Supplemental
23
2 4 Nutrition Assistance Program services to able-bodied adults without
24

1 dependents of the SNAP work requirement under 7 U.S.C., Section
1
2 2015(o)(4).

3 SECTION 2. It being immediately necessary for the preservation
3
4 of the public peace, health or safety, an emergency is hereby
4
5 declared to exist, by reason whereof this act shall take effect and
5
6 be in full force from and after its passage and approval.
