7 An Act relating to higher education; amending 70 O.S.
7 2021, Section 3242.2, which relates to higher
8 education benefits for certain students; removing
8 exception to prohibition for certain students;
9 removing outdated language; updating statutory
9 language; providing for promulgation of rules;
10 repealing 70 O.S. 2021, Section 3242, which relates
10 to resident tuition eligibility for certain students;
11 providing an effective date; and declaring an
11 emergency.

1 4 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3242.2, is
15
1 6 amended to read as follows:
16
17 Section 3242.2. A. Except as otherwise provided in Section
17
1 8 3242 of Title 70 of the Oklahoma Statutes, an An individual who is
18
1 9 not lawfully present in the United States shall not be eligible on
19
2 0 the basis of residence within the this state for:
20
21 1. Any postsecondary education benefit, including, but not
21
2 2 limited to, scholarships or financial aid; or
22
23 2. Resident tuition.

1 B. The provisions of subsection A of this section shall not
1
2 apply to a student enrolled in a degree program at a postsecondary
2
3 educational institution within The Oklahoma State System of Higher
3
4 Education during the 2006-2007 school year or any prior year who
4
5 received a resident tuition benefit pursuant to Section 3242 of
5
6 Title 70 of the Oklahoma Statutes at that institution The Oklahoma
6
7 State Regents for Higher Education may promulgate rules to implement
7
8 the provisions of this section.

9 SECTION 2. REPEALER 70 O.S. 2021, Section 3242, is
9
1 0 hereby repealed.
10
11 SECTION 3. This act shall become effective July 1, 2026.
11
12 SECTION 4. It being immediately necessary for the preservation
12
1 3 of the public peace, health, or safety, an emergency is hereby
13
1 4 declared to exist, by reason whereof this act shall take effect and
14
1 5 be in full force from and after its passage and approval.
