7   An Act relating to ticket sales; creating the

7   Oklahoma Fraud and Ticketing Accountability Act;

8   providing short title; amending Sections 1 and 2,

8   Chapter 218, O.S.L. 2023 (15 O.S. Supp. 2025,

9   Sections 774 and 774.1), which relate to definitions,

9   and prohibited use or sale of software to be used on

10  ticket sellers' websites; updating statutory

10  reference; updating statutory language; defining

11  terms; prohibiting use or creation of certain bot;

11  requiring certain seller to disclose certain

12  requirements at certain point; prohibiting certain

12  seller from offering or selling certain ticket;

13  prohibiting certain resale of certain admission

13  ticket; allowing certain persons to restrict

14  transferability; allowing venue operators to enforce

14  certain policies; prohibiting certain seller from

15  facilitating sale of ticket above certain price;

15  requiring certain seller to issue certain refund;

16  allowing nonprofit organization to offer certain

16  choices for refund of certain ticket; requiring

17  certain venue to provide certain contact information

19  practice subject to the Oklahoma Consumer Protection

20  Act; allowing certain persons to bring certain civil

20  action; construing provisions; providing for

21  noncodification; providing for codification; and

21  providing an effective date.

1 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2   SECTION 1.     NEW LAW     A new section of law not to be

2

3 codified in the Oklahoma Statutes reads as follows:

3

4   This act shall be known and may be cited as the "Oklahoma Fraud

4

5 and Ticketing Accountability Act".

5

6   SECTION 2.     AMENDATORY  Section 1, Chapter 218, O.S.L.

6

7 2023 (15 O.S. Supp. 2025, Section 774), is amended to read as

7

8 follows:

8

9   Section 774. As used in this act Section 774 et seq. of this

9

1 0 title:

10

11  1. "Admission ticket" means any physical, electronic, or other

11

1 2 form of evidence of a right of entry to a venue or an entertainment

12

1 3 event for one or more events at a specified date and time;

13

14  2. "Bot" means any machine, device, computer program,

14

1 5 artificial intelligence, or software that bypasses security measures

15

1 6 or ticket purchase limits, alone or with human assistance, to

16

1 7 acquire admission tickets on a retail platform;

17

18  3. "Event" means a concert, theatrical performance, sporting

18

1 9 event, exhibition, show, or other similar activity held in this

19

2 0 state;

20

21  4. "Face value" means a price printed on the admission ticket

21

2 2 or listed by the primary ticket seller at the point of initial sale,

22

2 3 excluding taxes, service fees, or delivery charges;

1   3. 5. "Initial sale" means the first sale of an admission

1

2 ticket by the ticket seller, which may include the distribution of

2

3 admission tickets under an agreement between the ticker ticket

3

4 seller and the recipient;

4

5   4. 6. "Person" means any individual, partnership, corporation,

5

6 limited liability company, other organization, or any combination

6

7 thereof;

7

8   5. 7. "Place of entertainment" means any privately or publicly

8

9 owned or operated entertainment facility within this state, such as

9

1 0 a theater, stadium, museum, arena, park, racetrack, or other place

10

1 1 where concerts, theatrical performances, sporting events,

11

1 2 exhibitions, shows, or other similar activities are held and for

12

1 3 which an entry fee is charged;

13

14  6. 8. "Presale" means a sale of admission tickets at or below

14

1 5 the price printed on the ticket by, or with the permission of, a

15

1 6 ticket seller, prior to their release to the general public;

16

17  9. "Primary ticket seller" means a venue, promoter, or provider

17

1 8 authorized to sell tickets to the public at the point of initial

18

1 9 sale including, but not limited to, public school districts and

19

2 0 nonprofit organizations;

20

21  7. 10. "Promoter" means a person who organizes financing and

21

2 2 publicity for an entertainment event; and

22

23  11. "Resale" means any second or subsequent sale of an

23

2 4 admission ticket, by any method including, but not limited to, in-

24

1 person, telephone, electronic mail, facsimile, or electronic

1

2 platforms. Resale shall not include tickets returned to or

2

3 exchanged by the primary ticket seller;

3

4   12. "Reseller" means a person or entity that offers or sells an

4

5 admission ticket after its initial sale;

5

6   13. "Secondary ticket exchange" means a marketplace, online

6

7 platform, or other entity facilitating resale of admission tickets;

7

8   14. "Speculative ticket" means an admission ticket offered for

8

9 sale that the reseller does not own, possess, or have the

9

1 0 contractual right to deliver;

10

11  15. "Sports" means any athletic competition, contest, or event

11

1 2 in which individuals or teams participate in games, matches, or

12

1 3 exhibitions of skill, agility, strength, or endurance whether

13

1 4 amateur, collegiate, or professional. Sports shall not mean

14

1 5 theatrical, musical, or other live entertainment performances, even

15

1 6 if occurring in a sports venue;

16

17  8. 16. "Ticket seller" means a person that makes admission

17

1 8 tickets available, directly or indirectly, at an initial presale or

18

1 9 sale to the general public, and may include an owner or operator of

19

2 0 a place of entertainment, a sponsor or promoter of an event, a

20

2 1 sports team participating in an event, a theater company, a musical

21

2 2 group, or similar participant in an event, or an employee or agent

22

2 3 of any such person; and

1   17. "Total price" means the price paid for an admission ticket,

1

2 including all mandatory fees, service charges, and taxes, and

2

3 excluding shipping charges and government-imposed fees.

4   SECTION 3.     AMENDATORY    Section 2, Chapter 218, O.S.L.

4

5 2023 (15 O.S. Supp. 2025, Section 774.1), is amended to read as

5

6 follows:

6

7   Section 774.1. A. A person shall not:

7

8   1. Use software or a bot to circumvent, thwart, interfere with,

8

9 or evade a security measure, access control system, or other control

9

1 0 measure on a ticket seller's Internet website; or

10

11  2. Sell software or a bot that is advertised for profit with

11

1 2 the express purpose to circumvent, thwart, interfere with, or evade

12

1 3 a security measure, access control system, or other control or

13

1 4 measure on a ticket seller's Internet website; or

14

15  3. Use or create a bot to:

15

16          a. purchase tickets for any single Internet admission

16

17                 ticket sale,

17

18          b. use multiple Internet protocol (IP) addresses,

18

19                 purchaser accounts, or electronic mail addresses to

19

20                 exceed posted ticket limits, or

20

21          c. circumvent electronic queues, presale codes, sales

21

22                 volume limitations, security or access control

22

23                 measures.

1   B. The user or seller shall be in violation of subsection A of

1

2 this section if the user or seller knows or should know that:

2

3   1. The purpose of the software or bot is to circumvent, thwart,

3

4 interfere with, or evade a security measure, access control system,

4

5 or other control or measure on a ticket seller's Internet website in

5

6 order to purchase admission tickets during the initial sale or

6

7 presale for an event held at a place of entertainment; or

7

8   2. The use of the software or bot led to the admission tickets

8

9 being resold on the initial seller's Internet website or an Internet

9

1 0 site used for the resell resale of admission tickets for a price

10

1 1 above the admission ticket's initial cost.

11

12  C. Any violation of this section shall constitute an unlawful

12

1 3 business unfair or deceptive trade practice and shall be subject to

13

1 4 the provisions of the Oklahoma Consumer Protection Act.

14

15  SECTION 4.     NEW LAW  A new section of law to be codified

15

1 6 in the Oklahoma Statutes as Section 774.2 of Title 15, unless there

16

1 7 is created a duplication in numbering, reads as follows:

17

18  A. A primary ticket seller, secondary ticket exchange, or

18

1 9 reseller shall clearly and conspicuously disclose at the point of

19

2 0 selection:

20

21  1. The total price, including all mandatory fees and taxes;

21

22  2. Itemization of base price, face value, service fees, and

22

2 3 taxes; and

1   3. Seat location or section, row, and seat number, if

1

2 applicable.

2

3   B. 1. No reseller shall offer or sell a speculative ticket or

3

4 more than one copy of the same ticket for an event.

4

5   2. Admission tickets shall not be resold prior to the initial

5

6 public sale. Complimentary admission tickets shall not be resold by

6

7 ticket exchanges.

7

8   3. Artists, venues, and private ticketing providers may

8

9 restrict transferability if terms and conditions are clearly

9

1 0 disclosed and acknowledged by the purchaser prior to sale.

10

11  4. Tickets shall be considered licenses. Venue operators may

11

1 2 enforce policies regarding conduct, behavior, public health, safety,

12

1 3 or age, and may establish limits on the quantity of tickets

13

1 4 purchased.

14

15  5. No primary ticket seller, secondary ticket exchange, or

15

1 6 reseller shall sell, offer, or facilitate resale of any admission

16

1 7 ticket at a total price greater than one hundred ten percent (110%)

17

1 8 of the total price of the original ticket, including applicable fees

18

1 9 and taxes. This paragraph shall not apply to charitable fundraising

19

2 0 events, school auctions, or other fundraising activities with

20

2 1 explicit written permission from the place of entertainment,

21

2 2 promoter, venue, or artist to exceed ticket resale above one hundred

22

2 3 ten percent (110%).

1   6. For admission tickets purchased for a series of events,

1

2 resale of a single event admission ticket shall not exceed the total

2

3 price of a comparable admission ticket, including fees and taxes.

3

4   C. 1. A primary ticket seller, secondary ticket exchange, or

4

5 reseller shall issue a full refund within ten (10) days if the:

5

6   a. event is canceled,

6

7   b. ticket is counterfeit or invalid,

7

8   c. ticket location does not conform to the description

8

9                  provided at the time of purchase, or

9

10  d. ticket is not made available prior to the event.

10

11  2. Pursuant to paragraph 1 of this subsection, a nonprofit

11

1 2 organization may offer the choice to donate the cost of the

12

1 3 admission ticket to the nonprofit organization, exchange to another

13

1 4 performance or event, or receive a refund subject to the terms of

14

1 5 the organization's refund policy.

15

16  3. The venue shall provide contact information for the Attorney

16

1 7 General if the purchaser presents an invalid ticket.

17

18  4. Nothing in this subsection shall be construed to alter any

18

1 9 rights or obligations under federal payment card laws including, but

19

2 0 not limited to, Regulation E of 12 C.F.R., Part 1005.

20

21  D. No person, resale platform, reseller, or operator of any

21

2 2 website purporting to sell or offer for sale event tickets shall:

1   1. Use or display, without authorization, the name, mark, logo,

1

2 likeness, or intellectual property of an artist, venue, or event

2

3 organizer in promotional materials, social media, or advertisement;

3

4   2. Imply affiliation or endorsement with a venue, team, or

4

5 artist, including the use of the word "official", unless authorized

5

6 in writing; or

6

7   3. Engage in commercial representations that are reasonably

7

8 likely to mislead consumers.

8

9   E. Any violation of this act shall constitute an unfair or

9

1 0 deceptive trade practice and shall be subject to the provisions of

10

1 1 the Oklahoma Consumer Protection Act.

11

12  F. Any aggrieved person may bring a civil action for actual

12

1 3 damages and restitution. The court may award court costs and

13

1 4 attorney fees to a prevailing party.

14

15  G. Nothing in this act shall be construed to include sports in

15

1 6 the provisions of this act.

16

17  SECTION 5. This act shall become effective November 1, 2026.
