7 An Act relating to digital identification; defining
7 term; providing that no person be denied access to
8 certain services on certain basis; providing for
8 codification; and declaring an emergency.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 110 of Title 75A, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. As used in this section, "digital ID" means an electronic
15
16 representation of personally identifying information, stored and
16
17 accessed through a mobile device or cloud platform, that may be used
17
18 to verify the identity of a person. For the purposes of this
18
19 section, digital ID shall not be construed as meaning a digitized
19
20 identification card, as defined in Section 791 of Title 15 of the
20
21 Oklahoma Statutes.

22 B. No person shall be denied access to the services of any
22
23 agency, department, or political subdivision of this state, or any
23

1 building operated by such, on the basis of not possessing or

2 utilizing a digital ID.

3 C. No person shall be denied service by a business or private
3
4 entity in this state on the basis of not possessing or utilizing a
4
5 digital ID.

6 SECTION 2. It being immediately necessary for the preservation
6
7 of the public peace, health or safety, an emergency is hereby
7
8 declared to exist, by reason whereof this act shall take effect and
8
9 be in full force from and after its passage and approval.
