7 An Act relating to driver licenses; amending Section
7 3, Chapter 282, O.S.L. 2022, as amended by Section 3,
8 Chapter 47, 1st Extraordinary Session, O.S.L. 2023
8 (47 O.S. Supp. 2025, Section 3-103), which relates to
9 the Executive Director of Service Oklahoma; providing
9 for removal in certain circumstance; updating
10 statutory language; updating statutory reference;
10 defining term; requiring certain personal information
11 be stored in certain database; providing for certain
11 waiver; providing certain permissible use of certain
12 information in certain period; requiring Service
12 Oklahoma to delete certain information after certain
13 period; allowing for certain use of certain driver
13 license or identification card; creating process for
14 Service Oklahoma to issue certain license or
14 identification card without a photo; requiring
15 certain attestation from Service Oklahoma; providing
15 for certain review by the Chief Information Officer
16 and the State Auditor and Inspector; requiring
16 removal of the Executive Director of Service Oklahoma
17 in certain circumstance; providing for promulgation
17 of rules; providing for codification; and declaring
18 an emergency.

20 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
20
21 SECTION 1. AMENDATORY Section 3, Chapter 282, O.S.L.
21
22 2022, as amended by Section 3, Chapter 47, 1st Extraordinary
22
23 Session, O.S.L. 2023 (47 O.S. Supp. 2025, Section 3-103), is amended
23
24 to read as follows:

1 Section 3-103. A. The Executive Director of Service Oklahoma
1
2 shall be appointed by the Governor with the advice and consent of
2
3 the Senate. The Executive Director shall serve at the pleasure of
3
4 the Governor and may be removed or replaced without cause.
4
5 Compensation for the Executive Director shall be determined pursuant
5
6 to Section 3601.2 of Title 74 of the Oklahoma Statutes. The
6
7 Executive Director may be removed from office by a two-thirds (2/3)
7
8 vote of the members elected to and constituting each chamber of the
8
9 Oklahoma Legislature or as provided for in Section 2 of this act.
9
10 B. The Executive Director of Service Oklahoma shall be the
10
11 chief executive officer of Service Oklahoma and shall act for
11
12 Service Oklahoma in all matters except as may be otherwise provided
12
13 by law. The powers and duties of the Executive Director shall
13
14 include, but not be limited to:
14
15 1. Organize Service Oklahoma in a manner to efficiently achieve
15
16 the objectives of Service Oklahoma;
16
17 2. Supervise all activities of Service Oklahoma;
17
18 3. Administer programs and policies of Service Oklahoma;
18
19 4. Employ, discharge, appoint, contract, and fix duties and
19
20 compensation of employees at the discretion of the Executive
20
21 Director;
21
22 5. Appoint assistants, deputies, officers, investigators,
22
23 attorneys, and other employees as may be necessary to carry out
23
24 functions of Service Oklahoma;

1 6. Prescribe rules and regulations for the operation of Service

2 Oklahoma;

3 7. Provide input and recommendations to the Service Oklahoma
3
4 Operator Board on all matters including branding and physical
4
5 standardization requirements, customer service metrics, analysis,
5
6 and improvement processes for licensed operators, and processes for
6
7 termination of licensed operators for failure to comply with the
7
8 customer service metrics;
8
9 8. Establish internal policies and procedures;
9
10 9. Prescribe and provide suitable forms deemed necessary to
10
11 carry out the functions of Service Oklahoma and any other laws the
11
12 enforcement and administration of which are vested in Service
12
13 Oklahoma;
13
14 10. Establish such divisions, sections, committees, advisory
14
15 committees, offices, and positions in Service Oklahoma as the
15
16 Executive Director deems necessary to carry out the functions of
16
17 Service Oklahoma;
17
18 11. Accept and disburse grants, allotments, gifts, devises,
18
19 bequests, funds, appropriations, and other property made or offered
19
20 to Service Oklahoma; and
20
21 12. Create the budget for Service Oklahoma to be submitted to
21
22 the Legislature each year.
22
23 C. The salary and other expenses for the Executive Director
23
24 shall be budgeted as a separate line item through Service Oklahoma.

1 The operating expenses of Service Oklahoma shall be set by the

2 Executive Director and shall be budgeted as a separate line item
2
3 through Service Oklahoma.

4 D. 1. The Executive Director of Service Oklahoma shall direct
4
5 all purchases, hiring, procurement, and budget for Service Oklahoma
5
6 and establish, implement, and enforce policies and procedures
6
7 related thereto, consistent with the Oklahoma Central Purchasing
7
8 Act. Service Oklahoma and the Executive Director shall be subject
8
9 to the requirements of the Public Competitive Bidding Act of 1974,
9
10 the Oklahoma Lighting Energy Conservation Act, and the Public
10
11 Facilities Act.
11
12 2. The Executive Director of Service Oklahoma, or any employee
12
13 or agent of the Executive Director of Service Oklahoma acting within
13
14 the scope of delegated authority, shall have the same power and
14
15 authority related to purchases, hiring, procurement, and budget for
15
16 Service Oklahoma as outlined in paragraph 1 of this subsection for
16
17 Service Oklahoma as the State Purchasing Director has for all
17
18 acquisitions used or consumed by state agencies as established in
18
19 the Oklahoma Central Purchasing Act. Such authority shall,
19
20 consistent with the authority granted to the State Purchasing
20
21 Director, include the power to designate financial or proprietary
21
22 information submitted by a bidder confidential and reject all
22
23 requests to disclose the information so designated, if the Executive
23
24 Director of Service Oklahoma requires the bidder to submit the

1 financial or proprietary information with a bid, proposal, or
1
2 quotation.

3 E. Service Oklahoma shall determine the compensation to be
3
4 retained by licensed operators.
4
5 1. Before the last day in September in every even-numbered
5
6 year, Service Oklahoma shall review the compensation paid to
6
7 licensed operators and, if necessary, change the compensation.
7
8 Service Oklahoma shall engage an independent third party to evaluate
8
9 the compensation paid to licensed operators who shall provide any
9
10 recommendations no later than November 1 in the even-numbered year.
10
11 Any recommended change in licensed operator compensation shall be
11
12 finalized by Service Oklahoma no later than the third Tuesday of
12
13 November in the even-numbered year. Notice of such recommendation
13
14 shall be provided to the Governor, the President Pro Tempore and the
14
15 Chair of the Appropriations Committee of the Senate, and the Speaker
15
16 and the Chair of the Appropriations and Budget Committee of the
16
17 House of Representatives.

18 2. Any change in licensed operator compensation, unless
18
19 rejected or amended as provided by this subsection, shall become
19
20 effective on July 1 of the following calendar year. Any amendment
20
21 passed by a majority vote of each house of the Legislature shall
21
22 become effective as provided by the amendment unless vetoed by the
22
23 Governor.

1 SECTION 2. NEW LAW A new section of law to be codified
1
2 in the Oklahoma Statutes as Section 6-110.6 of Title 47, unless
2
3 there is created a duplication in numbering, reads as follows:
3
4 A. As used in this section, "personally identifiable
4
5 information" means an individual's:
5
6 1. Full legal name;
6
7 2. Date of birth;
7
8 3. Gender;
8
9 4. Driver license or identification card number;
9
10 5. Biometric data, including but not limited to digital facial
10
11 photographs, facial biometrics, finger images, and minutia data;
11
12 6. Address of principal residence; and
12
13 7. Signature.
13
14 This definition shall not be construed as including an
14
15 individual's Social Security number.
15
16 B. Personally identifiable information required to be provided
16
17 during the application process for a REAL ID Noncompliant Driver
17
18 License or Identification Card shall be stored in a separate and
18
19 siloed database from the database used to store personally
19
20 identifiable information provided to receive a REAL ID Compliant
20
21 Driver License or Identification Card.
21
22 C. 1. Any applicant for a REAL ID Noncompliant Driver License
22
23 or Identification Card, except as provided for in paragraph 3 of
23
24

1 this subsection, may request a biometric data waiver from Service
1
2 Oklahoma.

3 2. Upon the acceptance of such waiver, Service Oklahoma shall:
3
4 a. provide a paper receipt to the waiver applicant,
4
5 confirming acceptance of such waiver,
5
6 b. delete all personally identifiable information and any
6
7 duplication of such information related to the waiver
7
8 applicant within ninety (90) days of collection,
8
9 c. not utilize any personally identifiable information
9
10 related to the waiver applicant for any purpose other
10
11 than the performance of background checks to determine
11
12 if the applicant has a currently issued license or
12
13 identification card under a different name or
13
14 identity,
14
15 d. not provide any personally identifiable information
15
16 related to the waiver applicant to any third-party
16
17 entity for any purpose, and
17
18 e. not provide any personally identifiable information
18
19 related to the waiver applicant to any court,
19
20 governmental entity, or law enforcement agency without
20
21 a valid warrant.
21
22 3. An applicant for a REAL ID Noncompliant Driver License or
22
23 Identification Card with a felony conviction shall be disqualified
23
24 from requesting such waiver.

1 D. No applicant for a renewal of a REAL ID Noncompliant Driver
1
2 License or Identification Card shall be required to provide
2
3 additional personally identifiable information at the time of
3
4 renewal if such applicant can produce the valid REAL ID Noncompliant
4
5 Driver License or Identification Card the applicant is seeking to
5
6 renew.
6
7 E. Service Oklahoma shall issue a REAL ID Noncompliant Driver
7
8 License or Identification Card that lacks a photo to an otherwise
8
9 qualified applicant who requests an exemption from such photo on the
9
10 basis of religious belief. The application process for such
10
11 applicant shall instead require the fingerprinting of each of the
11
12 applicant's index fingers; the results of such fingerprinting and
12
13 any duplications of such shall be deleted within ninety (90) days of
13
14 collection.

15 F. 1. Every six (6) months after the effective date of this
15
16 act, Service Oklahoma shall attest via an electronic report to the
16
17 Governor, the President Pro Tempore of the Senate, and the Speaker
17
18 of the House of Representatives that it is in compliance with the
18
19 provisions of this section.
19
20 2. The Chief Information Officer of the Information Services
20
21 Division of the Office of Management and Enterprise Services and the
21
22 State Auditor and Inspector shall annually perform a joint review of
22
23 Service Oklahoma's compliance with the provisions of this section
23
24 and electronically report the results of such review to the

1 Governor, the President Pro Tempore of the Senate, and the Speaker
1
2 of the House of Representatives.

3 3. If Service Oklahoma is found to be out of compliance with
3
4 the provisions of this section in the joint review provided for in
4
5 subparagraph 2 of this subsection, the Executive Director of Service
5
6 Oklahoma shall be removed from office effective on the date the
6
7 review was reported to the Governor, the President Pro Tempore of
7
8 the Senate, and the Speaker of the House of Representatives.
8
9 G. Service Oklahoma shall promulgate rules as necessary to
9
10 implement the provisions of this section.
10
11 SECTION 3. It being immediately necessary for the preservation
11
12 of the public peace, health or safety, an emergency is hereby
12
13 declared to exist, by reason whereof this act shall take effect and
13
14 be in full force from and after its passage and approval.
