7 An Act relating to nondisclosure agreements;
7 prohibiting state government entities from entering
8 into certain agreements; providing certain propriety
8 information not subject to disclosure; providing for
9 codification; and providing an effective date.

1 1 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
13
1 3 in the Oklahoma Statutes as Section 9020 of Title 62, unless there
14
1 4 is created a duplication in numbering, reads as follows:
15
15 A. Except as provided by subsection B of this section, no state
16
1 6 governmental entity or public trust having the state as its
17
1 7 beneficiary may enter into any agreement with a person, partnership,
18
1 8 limited partnership, limited liability partnership, corporation,
19
1 9 limited liability company, trust, or other legal entity that would
20
2 0 prohibit the state governmental entity or public trust from making
21
2 1 disclosure of the terms of any agreement with such entity to make
22
2 2 payment to or confer value upon the entity using an incentive, tax
23
2 3 credit, direct or indirect payment, grant, or similar benefit
24

1 offered to the entity if the benefit is provided through the use of

2 state taxes.

3 B. The provisions of subsection A of this section shall not
3
4 require a state governmental entity or a public trust having the
4
5 state as its beneficiary to disclose information of a proprietary
5
6 nature with respect to a for-profit business entity if the
6
7 information has been provided to the state governmental entity or
7
8 public trust by or on behalf of the for-profit business entity, such
8
9 as trade secrets, the cost of inputs used or consumed by the
9
1 0 business entity, the labor costs of the for-profit business entity,
10
1 1 or information related to profit margins on goods or services sold
11
1 2 by the for-profit business entity.

13 SECTION 2. This act shall become effective November 1, 2026.
