7   An Act relating to school elections; amending 26 O.S.

7   2021, Section 13A-106, which relates to eligibility

8   for the board of education of a school district or

8   technology center school district; and prohibiting

9   persons engaged in certain activities from being

9   eligible to be a candidate for or elected to certain

10  boards of education beginning on certain date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      AMENDATORY  26 O.S. 2021, Section 13A-106, is

14

15 amended to read as follows:
15

16  Section 13A-106. A. To be eligible to be a candidate for

16

17 member of the board of education of a school district or technology
17

18 center school district, a person must have resided in the district
18

19 or, if the board seat is in an independent district, have resided in
19

20 that district for at least six (6) months preceding the first day of
20

21 the filing period, and have been a registered voter registered with
21

22 the county election board at an address located within the
22

23 geographical boundaries of the district for six (6) months preceding
23

24 the first day of the filing period.

1   B. 1. Beginning May 1, 1990, no person shall be eligible to be

2 a candidate for or elected to be a member of the board of education
2

3 of a school district or technology center school district unless the
3

4 person has been awarded a high school diploma or certificate of high
4

5 school equivalency. In school districts that are divided into
5

6 election districts, a candidate must have resided in the district
6

7 for at least six (6) months preceding the first day of the filing
7

8 period and have been a registered voter registered with the county
8

9 election board at an address located within the geographical
9

10 boundaries of the election district for six (6) months preceding the
10

11 first day of the filing period. Beginning May 1, 1990, no person
11

12 shall be eligible to be a candidate for or elected to be a member of
12

13 the board of education unless the person has been awarded a high
13

14 school diploma or certificate of high school equivalency.

15  2. Beginning on the effective date of this act, no person shall

15

16 be eligible to be a candidate for or elected to be a member of the
16

17 board of education of a school district or technology center school
17

18 district if the person has an interest of five percent (5%) or more
18

19 in a company, individual, or business concern engaged in:
19

20  a. the issuance of bonds for school districts or

20

21                 technology center school districts in this state, or

21

22  b. the construction or remodeling of facilities for

22

23                 school districts or technology center school districts

23

24                 in this state.

1   B. C. To be eligible to vote in a school district election or a

1

2 technology center school district election, a person must be
2

3 registered with the county election board at an address located
3

4 within the geographical boundaries of the district. To be eligible
4

5 to vote in an election district election within a school district, a
5

6 person must be registered with the county election board at an
6

7 address located within the geographical boundaries of the election
7

8 district.
