7 An Act relating to nuisances; creating the Racing
7 Facility and Racetrack Nuisance Immunity Act;
8 providing short title; defining term; prohibiting
8 action for nuisance against racing facility under
9 certain circumstances; providing exception from
9 liability limitation for violations of applicable
10 laws or regulations; providing for noncodification;
10 providing for codification; and providing an
11 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law not to be
15
16 codified in the Oklahoma Statutes reads as follows:
16
17 This act shall be known and may be cited as the "Racing Facility
17
18 and Racetrack Nuisance Immunity Act".

19 SECTION 2. NEW LAW A new section of law to be codified
19
20 in the Oklahoma Statutes as Section 1.2 of Title 50, unless there is
20
21 created a duplication in numbering, reads as follows:

22 A. As used in this section, "racing facility" means a
22
23 designated area where competitive vehicle and motorsport races are
23
24 conducted including, but not limited to, the track, spectator areas,

1 garages, and any associated grounds, buildings, or appurtenances

2 used to operate the races.

3 B. No action for nuisance shall be brought against a racing
3
4 facility by an owner of real property within a three-mile radius of
4
5 the racing facility if the developer of the facility obtained all
5
6 permits required for construction, and established a vested right in
6
7 the development of the property or contiguous group of properties
7
8 where the racing facility is located, prior to the date of the owner
8
9 purchasing real property or constructing any building within the
9
10 three-mile radius of the racing facility. Provided, however, such
10
11 liability protection shall not apply if the racing facility fails to
11
12 operate in substantial compliance with federal, state, and local
12
13 laws and regulations applicable to activities occurring at the
13
14 facility.

15 SECTION 3. This act shall become effective November 1, 2026.
