7 An Act relating to alcohol and drug substance abuse
7 counseling; amending 43A O.S. 2021, Section 3-460,
8 which relates to alcohol and drug assessment and
8 evaluation programs; increasing certain assessment
9 and evaluation fee; updating statutory references;
9 removing obsolete language; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 43A O.S. 2021, Section 3-460, is
14
15 amended to read as follows:
15
16 Section 3-460. A. The Department of Mental Health and
16
17 Substance Abuse Services shall certify assessment personnel for the
17
18 purpose of conducting alcohol and drug assessment and evaluation
18
19 programs related to driver license revocation.
19
20 B. Application fees for certification of assessment personnel
20
21 shall be set by the Department to defray the costs of administering
21
22 the program and shall be:

23 1. Not less than One Hundred Dollars ($100.00) and not more
23
24 than Two Hundred Dollars ($200.00) upon initial application; and

1 2. Not less than Twenty-five Dollars ($25.00) and not more than

2 One Hundred Fifty Dollars ($150.00) upon triennial renewal.

3 C. The fee for those undergoing an assessment and evaluation
3
4 pursuant to this section shall be One Hundred Sixty Dollars
4
5 ($160.00) Two Hundred Dollars ($200.00). A fee of Fifteen Dollars
5
6 ($15.00) shall be remitted by the individual undergoing an
6
7 assessment and evaluation directly to the Department of Public
7
8 Safety Service Oklahoma pursuant to Section 6-212 of Title 47 of the
8
9 Oklahoma Statutes.

10 1. The Department of Public Safety Service Oklahoma shall remit
10
11 ninety percent (90%) of the fifteen-dollar fee collected pursuant to
11
12 this section to the State Treasurer to be credited to the Community-
12
13 based Substance Abuse Revolving Fund in the State Treasury and shall
13
14 be used by the Department of Mental Health and Substance Abuse
14
15 Services.

16 2. Ten percent (10%) of each fifteen-dollar fee collected by
16
17 the Department of Public Safety Service Oklahoma pursuant to this
17
18 section shall be deposited into the Department of Public Safety
18
19 Restricted Revolving Fund Service Oklahoma Revolving Fund, as
19
20 created in Section 2-145 Section 3-106 of Title 47 of the Oklahoma
20
21 Statutes, to be used for administrative costs associated with the
21
22 duties imposed by this section.

23 D. The Board of Mental Health and Substance Abuse Services is
23
24 authorized to promulgate such rules as are necessary to implement

1 the provisions of Section 3-451 et seq. of this title. Failure to
1
2 comply with rules and standards promulgated by the Board shall be
2
3 grounds for revocation, suspension, or nonrenewal of certification.
3
4 E. The Director of the Office of Management and Enterprise
4
5 Services shall transfer any unobligated monies generated by the fees
5
6 in subsection C of this section, deposited before November 1, 2005,
6
7 from the Department of Mental Health and Substance Abuse Services
7
8 Revolving Fund to the Community-based Substance Abuse Revolving
8
9 Fund, in amounts calculated by the Department.

10 F. No alcohol or drug assessment personnel shall operate or
10
11 continue to operate as such unless the alcohol or drug assessment
11
12 personnel comply with the rules promulgated by the Board and are
12
13 certified as required by this section.
13
14 SECTION 2. This act shall become effective November 1, 2026.
