7   An Act relating to alien ownership of land; amending

7   60 O.S. 2021, Section 122, which relates to

8   exceptions; defining terms; updating statutory

8   language; making language gender neutral; and

9   declaring an emergency.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.     AMENDATORY   60 O.S. 2021, Section 122, is

12

13 amended to read as follows:
13

14  Section 122. A. For purposes of this section:

14

15  1. "Bona fide resident" shall be a lawful permanent resident of

15

16 the United States; and
16

17  2. "Lawful permanent resident" means a foreign national who has

17

18 been granted the right to reside permanently in the United States.
18

19  B. This article shall not apply to lands now owned in this

19

20 state by aliens so long as they are held by the present owners, nor
20

21 to any alien who is or shall take up bona fide residence in this
21

22 state: and any alien who is or shall become a bona fide resident of
22

23 the State of Oklahoma this state shall have the right to acquire and
23

24 hold lands in this state upon the same terms as citizens of the

1 State of Oklahoma this state during the continuance of such bona
1

2 fide residence of such alien in this state: Provided, that if any
2

3 such resident alien shall cease to be a bona fide inhabitant of this
3

4 state, such alien shall have five (5) years from the time he or she
4

5 ceased to be such bona fide resident in which to alienate such
5

6 lands.

7   SECTION 2. It being immediately necessary for the preservation

7

8 of the public peace, health or safety, an emergency is hereby
8

9 declared to exist, by reason whereof this act shall take effect and
9

10 be in full force from and after its passage and approval.
