7 An Act relating to ballots; requiring certain
7 language to be printed on ballots with propositions
8 that levy or authorize the levy of a tax; amending 26
8 O.S. 2021, Section 6-113, which relates to ballots
9 for state questions; requiring certain language to be
9 printed on ballots with state questions that levy or
10 authorize the levy of a tax; providing for
10 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 6-113.1 of Title 26, unless
15
16 there is created a duplication in numbering, reads as follows:

17 Any proposal that provides for an increase to any tax levy,
17
18 extends the levy of a tax, or authorizes this state, any political
18
19 subdivision of this state, or any entity to levy a tax, which is
19
20 submitted to voters for approval shall be printed in such a manner
20
21 as to include, above the proposition, the following language: "THIS
21
22 IS A TAX INCREASE." The language shall be conspicuous as the term
22
23 is defined in Section 1-201 of Title 12A of the Oklahoma Statutes.

1 SECTION 2. AMENDATORY 26 O.S. 2021, Section 6-113, is

2 amended to read as follows:

3 Section 6-113. A. Ballots Except as provided for in subsection
3
4 B of this section, ballots for state questions shall be printed in
4
5 such a manner as to include the number of the state question, the
5
6 ballot title, and the following language,: "SHALL THE PROPOSAL BE
6
7 APPROVED?" followed by the words "FOR THE PROPOSAL - YES" and
7
8 "AGAINST THE PROPOSAL - NO", one above the other.

9 B. If the state question provides for an increase to any tax
9
10 levy, extends the levy of a tax, or authorizes this state, any
10
11 political subdivision of this state, or any entity to levy a tax,
11
12 the ballot shall include above the ballot title and below the number
12
13 of the state question the following language: "THIS IS A TAX
13
14 INCREASE." The language shall be conspicuous as the term is defined
14
15 in Section 1-201 of Title 12A of the Oklahoma Statutes.

16 SECTION 3. This act shall become effective November 1, 2025.
