7 An Act relating to cockfighting; amending 21 O.S.
7 2021, Sections 1692.1, 1692.2, 1692.3, 1692.4, and
8 1692.8, which relate to cockfighting definitions,
8 offenses, and penalties; modifying definition;
9 deleting definition; reducing penalties for certain
9 offenses; adding punishment for additional offenses;
10 updating statutory references; repealing 21 O.S.
10 2021, Sections 1692.5, 1692.6, and 1692.7, which
11 relate to criminal offenses and asset forfeitures
11 related to cockfighting violations; and providing an
12 effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1692.1, is
16
17 amended to read as follows:
17
18 Section 1692.1. As used in this act:
18
19 A. "Cockfight" or "cockfighting" is a fight between birds,
19
20 whether or not fitted with artificial spurs, knives, or gaffs, and
20
21 whether or not bets or wagers are made on the outcome of the fight,
21
22 and includes any training fight in which birds are intended or
22
23 encouraged to attack or fight with one another.

1 B. "Equipment used for training or handling a fighting bird"
1
2 includes knives or gaffs, cages, pens, feeding apparatuses, training
2
3 pens and other related devices and equipment, and is hereby declared
3
4 contraband and subject to seizure.

5 SECTION 2. AMENDATORY 21 O.S. 2021, Section 1692.2, is
5
6 amended to read as follows:
6
7 Section 1692.2. Every person who willfully instigates or
7
8 encourages any is actively participating in a cockfight, upon
8
9 conviction, shall be guilty of a felony misdemeanor. The penalty
9
10 for a violation of this section shall be as provided in Section 8 of
10
11 this act 1692.8 of this title.

12 SECTION 3. AMENDATORY 21 O.S. 2021, Section 1692.3, is
12
13 amended to read as follows:
13
14 Section 1692.3. Every person who keeps or provides any pit,
14
15 building, or other place, or knowingly provides any equipment or
15
16 facilities to be used in permitting any cockfight, upon conviction,
16
17 shall be guilty of a felony misdemeanor. The penalty for a
17
18 violation of this section shall be as provided in Section 8 of this
18
19 act 1692.8 of this title.

20 SECTION 4. AMENDATORY 21 O.S. 2021, Section 1692.4, is
20
21 amended to read as follows:

22 Section 1692.4. Every person who does any act or performs any
22
23 service in the furtherance of or to facilitate any cockfight,
23
24 referees a cockfight upon conviction, shall be guilty of a felony

1 misdemeanor. Such activities and services specifically prohibited
1
2 by this section include, but are not limited to: promoting or
2
3 refereeing of birds at a cockfight, advertising a cockfight, or
3
4 serving as a stakes holder of any money wagered on any cockfight.
4
5 The penalty for a violation of this section shall be as provided in
5
6 Section 8 of this act 1692.8 of this title.

7 SECTION 5. AMENDATORY 21 O.S. 2021, Section 1692.8, is
7
8 amended to read as follows:
8
9 Section 1692.8. A. Every person who is guilty of a felony
9
10 under any of the provisions of Sections 2, 3, 4, or 5 of this act
10
11 shall be punished by imprisonment in the state penitentiary for not
11
12 less than one (1) year nor more than ten (10) years, or shall be
12
13 fined not less than Two Thousand Dollars ($2,000.00) nor more than
13
14 Twenty-five Thousand Dollars ($25,000.00), or by both such fine and
14
15 imprisonment.

16 B. Every person who upon conviction is guilty of any of the
16
17 provisions of Section 6 of this act Sections 1692.2, 1692.3, and
17
18 1692.4 of this title shall be punished by imprisonment in the county
18
19 jail for not more than one (1) year, or shall be guilty of a
19
20 misdemeanor and fined not more than Five Hundred Dollars ($500.00),
20
21 or by both such fine and imprisonment. Upon a second conviction,
21
22 the person shall be guilty of a misdemeanor punishable by
22
23 imprisonment in the county jail for not more than one (1) year, by a
23
24 fine not more than Two Thousand Five Hundred Dollars ($2,500.00), or

1 by both such imprisonment and fine. Upon a third and subsequent

2 conviction, the person shall be guilty of a felony punishable by
2
3 imprisonment in the custody of the Department of Corrections for not
3
4 more than two (2) years or by a fine not less than Five Thousand
4
5 Dollars ($5,000.00), or by both such imprisonment and fine.
5
6 SECTION 6. REPEALER 21 O.S. 2021, Sections 1692.5,
6
7 1692.6, and 1692.7, are hereby repealed.
7
8 SECTION 7. This act shall become effective November 1, 2025.
