7 An Act relating to credit sales; defining terms;
7 prohibiting the charge of network fees and
8 interchange transaction fees on certain transactions
8 or portions of transactions; and providing an
9 effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 2-418 of Title 14A, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. As used in this section:

17 1. "Interchange transaction fee" means the same as the term is
17
18 defined in 15 U.S.C., Section 1693o-2; and
18
19 2. "Network fee" means the same as the term is defined in 15
19
20 U.S.C., Section 1693o-2.

21 B. No interchange transaction fee or network fee shall be
21
22 charged to a merchant for the following credit card transactions or
22
23 portion of transactions:

1 1. The transaction or portion of the transaction that pays
1
2 sales tax, excise tax, and customer tips; and
2
3 2. The transaction or portion of the transaction that pays a
3
4 donation to any nonprofit organization exempt from taxation pursuant
4
5 to the provisions of 26 U.S.C., Section 501(c)(3).

6 SECTION 2. This act shall become effective November 1, 2025.
