6 An Act relating to medical marijuana; requiring
6 certain licensees to submit certain odor control
7 plan; directing rule promulgation; providing for
7 codification; and providing an effective date.

10 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

11 SECTION 1. NEW LAW A new section of law to be codified
11
12 in the Oklahoma Statutes as Section 426.2 of Title 63, unless there
12
13 is created a duplication in numbering, reads as follows:
13
14 A. The Oklahoma Medical Marijuana Authority shall require all
14
15 licensed medical marijuana commercial growers to submit an odor
15
16 control plan on or before January 1, 2027. An odor control plan
16
17 shall include:

18 1. Facility information including, but not limited to:
18
19 a. the name of the facility,
19
20 b. the contact information of the owner or operator,
20
21 c. the facility's physical and mailing address,
21
22 d. the facility type,
22
23 e. the facility's hours of operation, and
23
24 f. a description of the facility's operations;

1 2. Facility odor emissions information including, but not

2 limited to:
2
3 a. the facility floor plan,
3
4 b. odor-emitting activities, and
4
5 c. the timing and duration of odor-emitting activities;

6 and
6
7 3. Odor mitigation best management practices. This shall
7
8 include:
8
9 a. odor mitigation practices to be deployed to control
9
10 odor-emitting activities, sources, and locations,
10
11 b. how these practices will be utilized, and
11
12 c. during what times these practices will be utilized.

13 B. If a medical marijuana business receives three or more odor
13
14 nuisance complaints within a thirty-day period, the business shall
14
15 be required to submit an odor control plan to the Authority.
15
16 C. The Authority shall promulgate rules as necessary to
16
17 implement the provisions of this section.

18 SECTION 2. This act shall become effective November 1, 2025.
